The Amish actually voted this year. Noticeably so for the first time in my life here in PA. I think it's in response to the FEDS raiding their farms over milk/blueberries. Those being 2 different cases that I know of.

When I was a kid you could order guns through the mail, as advertised in magazines, and that didn't present a problem. When my father was a kid you could buy a machine gun in a hardware store, and THAT wasn't a problem, either.

SELL THE GUNS YOU OWN TO YOUR FRIEND, AND KEEP A COPY OF THE BILL OF SALE. i use to use photoshop 7 to create drivers licenses . learn photo shop and snatch photos off the internet and put on the drivers license. just print it in black and white on plain paper. then cut it out. get a "bill of sale" form at office supply store, and put your gun down at fair market value. lay the paper license in it and make a photocopy of bill of sale and license on 1 sheet. get a burner phone from out of town 6 months in advance. run a paid ad to sell the gun with the ammo for it. have a friend avtivate the burner phone and be one of the first callers when the ad is published!! have your friend visit you on the day he calls you on the burner phone. he will stay for 30 minutes max and then leave and head to location where beggars are standing on the corner. have him give the phone to the beggar. beggar will use the phone and then toss it when the minutes expire! slowly take out money from your bank a little at a time, prior to implementing. break the $100 bills at grocery stores when buying $10 worth of food etc... this gives you the cash to buy your guns with. after you sell your guns, deposit the money from the sale in your bank. you want to create evidence that you really sold your guns!! then bury/hide your gun! maybe in the little ole ladies (next door) flower bed!!

You can trade a gun back and forth to your friend several times in a month and in the end the ownership changed hands many times but in the end was it ever actually sold or do you call that borrowing. Guns don't have a title and ownership is determined by who has control of it at the time. Prior to some of the states requiring a FFL to transfer a firearm millions of guns were traded back and forth like barter between farmers. There's no problem with that in my eyes.

The issue here is in the Amish community some of these guys treat guns like an old west trading post or a kind of gun exchange.. I would bet that most of the guns were like trades or swaps where it was mostly Amish to Amish consignment sales and lots of the communities citizens refuse to get photo State ID's/social security numbers or other identification making it virtually impossible for them to walk into a gun store and fill out the form for a gun.. Many years ago I went with some Amish friends to an Amish gun auction where there were hundreds of guns laid out and they had hidden minimum sale prices and the Amish would bid on them and if it did not hit the minimum price once the bidding was ended the highest bidder was taken aside and given the asking price if he wanted to go with that or pass.. The used guns would fetch quite high prices, sometimes more than what new would cost but you have to remember that many of these sold kind of on consignment are from widows or families that lost the son who owned the guns and the Amish feel that the high price is worth it because that is more money in the hands of the surviving family.. They do this with horses, buggies, farm equipment and whole farms as part of the keep it in the community mindset when taking care of their own.. This is why rarely is an Amish fam ever sold to a Yankee/us.. A bit of rambling but hope I got the point across..

The FFL was not passed into law as a Firearms SELLING License. The FFL law was justified as a license to PURCHASE firearms but it was not possible to require every buyer to obtain an FFL. Instead the FFL holder was required to track when the firearm was sold to a (potentially) unlicensed person.
In PA Amish country the majority of non Amish people are conservative country folk. They do a lot of hunting and very pro 2A. Very little crime in those areas. He was probably selling to the local area to law abiding people.

If he was selling guns within his religious community I don’t think he should have been punished at all. The Amish segregate from the “English” so he could not have become an FFL religiously. Native born Americian should not have to break their religious convictions to exercise their constitutional rights. If he was the one the community had allowed to interact with the gun sellers and arm the community then I see ATF and court overreach according to separation of church and state. It is a slippery slope I know but the strict interpretation of the 2nd amendment would allow the Amish to be armed and they should not have to interact with the English to do so

My dad had over a hundred guns when he died. I only saw him shoot 2-3 times growing up. Dad’s guns could only be handled when holding an oily rag in one hand. Dad would take one out, disassemble, clean, and reassemble the gun, and then put it back. FBI agents hunted on our farm, and knew of his collection. No big deal. I doubt any of dad’s guns committed a crime.
Interesting take on this. With all respect, I do not believe that most "private sales" are straw purchases or sales of collections. There is a lot of private sales of firearms that are done for the reason folks don't want to pay an FFL to do paperwork that the public believes can be traced by the Federal Government. This is because they don't trust the government. I am an FFL and I hear these things all the time. Certainly, there are some straw purchases happening and sales of gun collections at gun shows happening, but I believe that the vast majority of private sales are not for illegal purposes.
Someone else broke the law before the Amish because they don't believe in photo IDs and don't have them. Selling guns that have already been sold once is not illegal if the purchaser is allowed to buy one a gun . If you are selling for profit as a source of income it becomes an issue and the ATF will bring in the IRS
The recent ruling by the U.S. Supreme Court on the Chevron case places real doubt on the power of federal agencies to create laws and thus circumvent Congress. This ruling is going to have a real impact on how the ATF operates in the near future as each of it's regulations are challenged in court. If a regulation is deemed unconstitutional that regulation will be stricken and this will apply to any regulation from any federal agency.
Imagine if we all just started ignoring the unconstitutional ATF and made sure that if they were harassing people they got harassed back. The world would be a better place. 🤔

It wasn't thousands of guns that he had sold, most were shotguns with a few hunting rifles in the mix that is according to the charges that i read. Most were also older where he refinished the stocks or made new stocks for them if needed.
Most Amish sects do not allow graven images. As such, they do not have photo IDs. Due to current federal firearm laws, that disqualifies them from purchasing firearms. Hence, the need for an "illegal" supplier within the community. That, however, begs the question, where are all of the firearms coming from? My guess would be a network of "English" straw buyers.

In Pennsylvania it's legal to sell long guns to another resident without filing any paper work or record keeping.
Same in WV, hand guns, shotguns, or rifles are sold between residents with zero paper work.

You can trade a gun back and forth to your friend several times in a month and in the end the ownership changed hands many times but in the end was it ever actually sold or do you call that borrowing. Guns don't have a title and ownership is determined by who has control of it at the time. Prior to some of the states requiring a FFL to transfer a firearm millions of guns were traded back and forth like barter between farmers. There's no problem with that in my eyes.
I am always saying that people are no different and should be treated the same. But the Amish are different. Not in God's eyes, but in man's eyes, and the way they appear to live. So, if anybody deserves a pass, it's the Amish.

The issue here is in the Amish community some of these guys treat guns like an old west trading post or a kind of gun exchange.. I would bet that most of the guns were like trades or swaps where it was mostly Amish to Amish consignment sales and lots of the communities citizens refuse to get photo State ID's/social security numbers or other identification making it virtually impossible for them to walk into a gun store and fill out the form for a gun.. Many years ago I went with some Amish friends to an Amish gun auction where there were hundreds of guns laid out and they had hidden minimum sale prices and the Amish would bid on them and if it did not hit the minimum price once the bidding was ended the highest bidder was taken aside and given the asking price if he wanted to go with that or pass.. The used guns would fetch quite high prices, sometimes more than what new would cost but you have to remember that many of these sold kind of on consignment are from widows or families that lost the son who owned the guns and the Amish feel that the high price is worth it because that is more money in the hands of the surviving family.. They do this with horses, buggies, farm equipment and whole farms as part of the keep it in the community mindset when taking care of their own.. This is why rarely is an Amish fam ever sold to a Yankee/us.. A bit of rambling but hope I got the point across..

The FFL was not passed into law as a Firearms SELLING License. The FFL law was justified as a license to PURCHASE firearms but it was not possible to require every buyer to obtain an FFL. Instead the FFL holder was required to track when the firearm was sold to a (potentially) unlicensed person.

In PA Amish country the majority of non Amish people are conservative country folk. They do a lot of hunting and very pro 2A. Very little crime in those areas. He was probably selling to the local area to law abiding people.

If he was selling guns within his religious community I don’t think he should have been punished at all. The Amish segregate from the “English” so he could not have become an FFL religiously. Native born Americian should not have to break their religious convictions to exercise their constitutional rights. If he was the one the community had allowed to interact with the gun sellers and arm the community then I see ATF and court overreach according to separation of church and state. It is a slippery slope I know but the strict interpretation of the 2nd amendment would allow the Amish to be armed and they should not have to interact with the English to do so

My dad had over a hundred guns when he died. I only saw him shoot 2-3 times growing up. Dad’s guns could only be handled when holding an oily rag in one hand. Dad would take one out, disassemble, clean, and reassemble the gun, and then put it back. FBI agents hunted on our farm, and knew of his collection. No big deal. I doubt any of dad’s guns committed a crime.
Interesting take on this. With all respect, I do not believe that most "private sales" are straw purchases or sales of collections. There is a lot of private sales of firearms that are done for the reason folks don't want to pay an FFL to do paperwork that the public believes can be traced by the Federal Government. This is because they don't trust the government. I am an FFL and I hear these things all the time. Certainly, there are some straw purchases happening and sales of gun collections at gun shows happening, but I believe that the vast majority of private sales are not for illegal purposes.
Someone else broke the law before the Amish because they don't believe in photo IDs and don't have them. Selling guns that have already been sold once is not illegal if the purchaser is allowed to buy one a gun . If you are selling for profit as a source of income it becomes an issue and the ATF will bring in the IRS
The recent ruling by the U.S. Supreme Court on the Chevron case places real doubt on the power of federal agencies to create laws and thus circumvent Congress. This ruling is going to have a real impact on how the ATF operates in the near future as each of it's regulations are challenged in court. If a regulation is deemed unconstitutional that regulation will be stricken and this will apply to any regulation from any federal agency.

I think the judge knew what INFRUNGMENT means. Even a felon has a right to a gun. Just not with the laws? that were written long after the 2nd A was voted on. Congress should have to pass all laws and there be no regulations.
Please show us where in the Constitution our rights must be purchased, approved of and taxed by the government. If you can't, reconsider who the real criminals are. Same is true for driving, land ownership and hunting on your own property.

It wasn't thousands of guns that he had sold, most were shotguns with a few hunting rifles in the mix that is according to the charges that i read. Most were also older where he refinished the stocks or made new stocks for them if needed.

Most Amish sects do not allow graven images. As such, they do not have photo IDs. Due to current federal firearm laws, that disqualifies them from purchasing firearms. Hence, the need for an "illegal" supplier within the community. That, however, begs the question, where are all of the firearms coming from? My guess would be a network of "English" straw buyers.
