      Americans sue for the littlest things....it's crazy (still should have had the sign you're suppose to post it before you start mopping), but if she really got hurt like broke something or had to go to the hospital then that would be totally different.....poor Lia glad you didn't get badly injured you handle that excellently. No, Americans Sue because if they didnt, corp and businesses would walk all over them and Not pay medical bills for injuries etc that they Cause. Or the fact we are Forced by law to pay insurance to crooks who then refuse to pay out as their contract implies. There reason we have Lawsuits as well as Fraud Suits (to protect from fraudulent litigation) because too many rich greedy assholes who made it that way...not crazy Americans, greedy ones. I'm not a sue happy kind of person, but had it been me and I fell because they didn't put out signs saying the floor was wet, and hurt myself and all the manager did was give me a hug and then a cookie, I would have certainly considered suing and I doubt any jury in the state of Texas would say Wendy's wasn't responsible. Falling because they mopped and didn't warn you the floor was wet, text book reason to sue.

    The Wendy's employee was so fast to check on you because not putting up the Yellow Caution Sign that Says 'WET FLOOR' when the floor is wet, is something that businesses have been sued for and it's an OSHA violation as well. Glad that Lia is doing better, but that just looked awful painful. Kinda wished Wendy's got sued for it...or you guys get a bunch of free stuff...a giant gift card or something...'please don't sue us' gifts do happen...
    Please stop making excuses for them. Just opening is not an excuse, they were there for at least an hour before opening. Not to mention the safety rules dictate that they HAVE to put out the Yellow Caution sign BEFORE they start mopping. Not after. Because things like that have happened, an employee turns their back just for one second to go fetch the sign and someone falls.

      Sorry lol I didnt see this before I commented. Oh I saw her fall and then the trying to put it on them not being ready to open as excuse, nice victim blaming (fr manager) n my head wanted to explode. My daughter managed a fast food and worked in two others and oh yeah, the shit they pull ugh. And they usually short staffed, its all greed. Worse in right to work states too...no enforcement of safety etc. You stated it very well👏👏👏 you know its funny that their food experience at White Castles was poor, I worked at one Years ago lol 😂 in my younger days (90s) in Indiana and it had The best OSHA enforcement And health inspection I had ever seen in fast food/food industry then. But in TX when I worked (young adult) it was horrid. CO havent worked in that industry but my kids have and its eh, depends on establishment. Not as bad as TX was but not as strict as it was in Indiana at least safety wise. But that was years ago, I think these arbitration clauses have made it worse for workers/consumers. Food safety is another one...Jack in Box where daughter worked was really good there. But...thanks to a lawsuit years ago. People may not like litigation but without it would be worse. Be nice if we all cared more for people than profit but sadly world not like that.

    Wendy's have tried over the years to be open for breakfast and offer unique things, but they just couldn't compete with Burger King and McDonald's. So they have tried, they just have decided they are a lunch and dinner restaurants. And that's pretty common among most fast food places, except for the rare 24-hour places like Jack In The Box and McDonalds. Breakfast requires a whole different variety of things that they just can't justify the cost to carry when they would rather be making hamburgers and or tacos Etc. But their lunch food usually is a step above the normal BK and McDonald's fare.

    You guys probably know this from your travels but Jack in the Box and Wendy’s are national restaurant chains and they’re all over the country. There are restaurants that are unique to Austin like Conners, where instead of BBQ they serve Mexican food and have breakfast. I recommend a warm flour tortilla filled with eggs, cheese, refried beans and fresh salsa wrapped in foil. If it sits in the foil wrapper for a few minutes, everything melts together and its delicious. Ask for a soft breakfast taco in a flour tortilla🍳

One difference I’ve noticed is that we Texans are very social (which is good as everyone I know have guns) A person can get into the longest conversations, even sharing personal things with perfect strangers. Or at least I do. I’m intensely interested in people hoping to be able to listen and help anyone. BUT, I HATE the heat! It gets over 100 degrees plus Fahrenheit here! I love watching you both! No its negligence on their part...what if had hit your head or what if an elderly person had fallen? You should send that footage to the corporate office. and to OSHA. Dont believe I spelled that right, but this is million dollar corporation that Knows better. They obviously are very short staffed (common in fast food cuzz corps are Greedy af) and thats due to corporate office. Sorry but that infuriates me. In our society we have deemed the people at fault to be responsible for those expenses instead of spreading the risk among everyone. No one gets free money from a lawsuit. I would love to see Lia try an American scone at a coffee shop sometime. I don’t see much similarity between the scones they serve here and southern biscuits. The scones I have had are much harder, and crumbly, and they often have dried fruit in them. Also, scones in the US are served room temperature. Southern biscuits are always served hot.

The lines were horrendous and so it took almost 30 minutes just to order and about that long again to get the food. I normally love greasy burgers and fries, but our food was swimming in orange grease and had very little flavor. The fries actually looked like they'd been double dipped (re-heated in the fryer), as they were translucent on the outside from grease and there was no soft potato in the middle left. We each took a few bites and couldn't stomach anymore. We're not normally picky eaters at all, but we were really disappointed. One day we will go back because I have to assume this was just a once-in-a-blue-moon horrible experience and for as long as they've been an institution, we figure they deserve another chance.

    Ok.. who mops before opening?? From my experience, most places mop as part of closing duties specifically for this reason.. that is awful. She was definitely trying to cover her butt. That wet floor sign should have been brought out WITH the mop and bucket. No excuse there. You were very kind to brush it off like that.

      I suspect the closing crew left a mess, hence the late opening and wet floors. No excuse!

      Lots of places that open later mop/spot clean before opening. They are supposed to leave floor signs out though, my boss would always talk about how he'd get fined when some inspectors would come in and see a wet spot with no sign when he first opened up the restaurant.

      it is not a law but someone should have put the sign up before they started mopping. also you have to actually be injured and have physical damage to sue , of course not to say you couldn't have demanded to go to the hospital and get checked out you could have sued and probably got a small settlement. big thing I noticed they didn't have you fill out an accident report

  • @michelepaccione8806
    @michelepaccione8806 5 ปีที่แล้ว +14

    The manager followed you into the loo to establish whether you were injured or not. The employees knew you were filming, so you'd have the fall on video. They had no signs up with a wet floor. If she can get you to say you're OK, that makes a lawsuit that much harder to win. "If there's anything I can do for you" could totally have been an offer of payment of some sort. Seriously. Sorry to be so cynical, but they're negligent for not putting up a sign if there's a wet floor.

    Not all fast food locations are open 24 hours, it depends on where they are located. Since this store was at a shopping mall, it probably was set up for shopping hours, lunch, dinner, and late night snacking.
