- Election 2024: In a blow to the Congress party, the nomination of their Surat Lok Sabha candidate was rejected due to alleged discrepancies in proposers' signatures. Consequently, the BJP candidate clinched the seat unopposed, prompting Gujarat BJP President to congratulate Mukeshbhai Dalal on Twitter. Surat's District Election Officer confirmed the discrepancies, leading to the cancellation of both the Congress candidate's nomination and their substitute's. Congress, attributing the setback to BJP's influence, plans to challenge the decision in Gujarat High Court, seeking a stay on the election. What happened in Surat is the most ridiculous thing that can ever happen. Clearly, they all are hand in glove with each other. Well the election officer as well should have not accepted this. He has conveniently ignored the most important aspect of NOTA!
In the given situation...he should have still conducted the voting with at least 2 candidate names on the Ballot Box (1) BJP Candidate and (2) NOTA. Then they should have counted the votes and decided. That would have been the true and fair test of the candidate's eligibility.
Team, do let us know your thought. I strongly believe intellects including opposition parties should STRONGLY contest this on this ground to save the democracy!

How can this be possible in a democracy? Is it not unconstitutional to declare the winner as unopposed especially when there is a provision for "NOTA"?
What if the "NOTA" votes more than the votes of unopposed candidate?
First of all can ECI declare a candidate as Unopposed when there is an option for "NOTA"?
I think personally that candidate cannot be declared unopposed when there is a "NOTA" option. ECI should conduct voting in Surath, since there is an option for "NOTA".
If in case there is a provision to declare a candidate unopposed when there is no other competing candidate, what about the voters who don't want an Unopposed candidate as their MP, is it not depriving the voters to exercise their RIGHT TO VOTE?
