Thank you so much!!!! I went to IME doctor and he acted like a Defense Lawyer. He tried to trick me saying "did you do this.. that?" so much questions. Good things I am prepared and I am still treating my doctor so his testimonial will be invalid. These doctors should not be given a license because they are fraud and liars. Thanks for your comments. I don't have a problem with any doctor that truly gives an Independent Medical Examination. The problem is that a few bad apples spoil the whole process by subverting the system and always coming to the opinion that whenever the insurance company asks them to perform an examination, that every time, they find no permanent injury, or it was not caused by the accident. Many of these doctors make a fortune working for the insurance industry.

Thank you sir, I injured myself at work and have been out on worker’s compensation since August 2018, my employer tried to get me to file on my short term disability , which I filed it took them took them two months to give me the worker’s compensation . I actually had to call the department of worker’s compensation to start my claim the insurance company never reported my workplace injury. I’m being sent to Designated Doctor Exam on February 26,2019, so your video had helped me a lot . She. I first got hurt I went to dr on my own, and they said I had spinal stenosis but I’ve Berber had any issues , of course the insurance is trying to say it’s pre existing at this moment.
That is so true that the alleged independent medical exams were not independent by any standard. The new term of compulsory is more fitting, and the fact that these doctors have no duty to the patients exonerates them from malpractice liability for these exams.
It is outright fraud and it is pathetic that we have allowed this! If your really injured expect nothing and by the way once you started this process good luck on seeing a specialist on your dime. I have run out of money lost my job and now my home , all 6 pedicle screws are loose while one runs into my spinal column and the adjacent screw doesn't even run into bone and it gets worse. Hi Brian, Sorry to hear about what happened to you as a result of the workers compensation system. It is terrible how the insurance companies go out of their way to get employees to sign off their future benefits for pennies, then later when complications arise, they say, too bad for you. I have a friend whose law firm was very successful in suing insurance companies in civil cases until the insurance companies lobbied the DA for State of California to raid their offices - no charges were ever made but it disrupted their practice and they couldn't sue the DA because of qualified immunity. Insurance companies have the might of the Government helping them. - Very Sad

If you case was done under the workers compensation system, they may be allowed to use one of your treating doctors, or their team. In the US, if you are a patient of a doctor, the adverse insurance company can't even talk directly to your doctor without your permission. And you are right, in the US, they won't use your physician as any sort of IME doctor for them. There is a conflict of interest.

Your doctors findings are the most important findings about your health and they are admissible for the court and jury to understand the issues in your case.
My boyfriend went with me to the appointment and they left out parts of the exam where it showed I had balance issues. We had the exam recorded, but not video recorded. That would have been a better option
The Insurance doctors are experts at leaving important information out of their testing and reports. If they know some test or measurement will indicate you have an injury, they skip right over that one.

My work payed for a physiotherapist to see me after the appointment there was a form that they wanted me to fill out asking for the access to my medical records and for all information to be able to be given to my work. It wasn't compulsory so I didn't fill it out should I grant them access?
In the long run, all of your medical records will be needed to fully evaluate your claim. I suggest you modify any medical record release form to expire in 30 days, and require them to give you free copies of any records they obtain. And you might add to the release they will return all copies, and delete all electronic copies, including back ups within 10 days of closing your file.
And that is probably for just one person. Multiply that by how many that person does per week and then for how many years they have been doing this and you start to see how much insurance companies are willing to pay to say people are not injured.
The defendants have a right to a medical evaluation what hes saying is be careful with your words and actions because the objective of the insurance company is to spend the least possible on a claim. This is good to know before and during a injury claim of what to expect and how to respond to doctors trying to render a legal analysis which is not part of their job great video (am I getting old) lol

if after the interview the doctor tells to the insurance I am fit to work, does it mean I have to go back to work?my illness is invisible but when I get sick (and it doesn't take too much to get sick)it is very visible, I start throwing up and my employer says I look very pale and I am looking as I am going to pass out. If I go back to work my employer will need to send me home by taxi over and over again as it did happened in the past. Can the insurance deny the benefit when my employer know that I am sick (the employer paid the premium to the insurance protection plan). If the insurance doctor says you can return to work, but you don't think you can or should, and your employer agrees, I would suggest that you get and share with the insurance company a second opinion. You might go to your own doctor and have them rebut any report that the insurance company doctor might write. Just because one doctor says you are fine, does not mean that is correct. "It's their "Gravy Train" of income,, even if the doctor makes recommendations for treatment once workers compensation gets the assessment report... I think you are handling your situation well. By having your doctor see you before and after the insurance doctor exam, you will have good evidence to fight with if the IME cuts you off of benefits. Good luck.
@ Eli Toro , it is true that there are some who manipulate the system, but this IS a major problem. There are MANY people who suffer because of accidents & insurance companies try to scam them. This happens in the U.S. & in Canada. Please do some research before making assumptions. Truly disabled people DO need this advice, because like he said, the insurance company's doctor is not there for you. It is to make you look as bad as possible.
You arebpainting all examiners with a broad stroke and neglect to say they may add both a detailed analysis of tje injury as well as helpful recommendations on tratment
I wish in my experience the examiners working for insurance companies did care, and were reasonable, but sadly, after you look at 100 reports by the same doctor, the conclusions are all the same. "not injured, or if they are injured, it is minor and will heal, or if it is not a minor injury, it was there before the crash, etc.
MattLaw , determine if your client was terminated after filing comp. Or from light duty then terminated under FMLA for the same injury. It then becomes a HIPPA violation . So what is the penalty civilly There. Make sure the doctor is informed of the facts. If not, it will be a violation but considered accidental. No prosecution but they will verify the violation.

No, they are hired by, selected by and paid by the insurance company trying to reduce your claim. If your attorney was involved in the selection, you might have a fair evaluation.
No, you should not secretly record the doctors, but you can tell them "I am going to record this encounter with you and you must consent to the recording, and that needs to be on the recording. Otherwise you may be breaking several laws, both state and Federal.
MattLaw i never went to medschool so I should be qualified. All I have to do is ask people to bend over and move their arm and say light duty or full duty. And then “forget” to write things in my notes.
That's not true IME company are not Insurance companies and do not work for insurance companies...They are acquired by the attorney and he can use any of the IME organization that's not connected to insurance companies.

You feel like the doctors hired by insurance companies give a full and fair evaluation of everyone's condition? Sadly, I see hundreds of reports by the same doctor for different people, and the reports all look the same. Same "no injury" and it resolved, and nothing permanent, no matter what happened to the patient.
aka; Seriously Injured goes to assessment. "Specific Complaint" Stabbing Midback Pain... on ice 24/7... The report sent to workers comp was / is... Injured worker "ONLY" wants to talk about his erectile dysfunction ... I Shit you NOT.... In my case this Prick failed to do any physical examination, didn't order any MRI or CT Scan.. then wrote... "No Sinister Pathology Found to explain a reason for pain... Required Psychiatrist to help return to work... 2 yrs later another spinal injury was finally diagnosed... of course WCB Bean Counters then denied specialists requests for treatment stating "We don't think surgery will help.... (2 yrs previously Physician requested retraining and WCB Bean counter stated.. No He's recoverable then denied specific diagnostic testing, requested to investigate the spinal injury... "Talk About a rigged system... It doesn't get more Crooked than this...
I just finished a one week jury trial. And it was sad to see how many millions of dollars the insurance companies pay to their testifying expert witnesses. Financial Bias is huge. I've been on NYS WC for 16 years now. Never heard of being able to video my exam. What a joke they are, and the worst are the psyches that meet for 30mins after canceling the appt, then blames you for it and then adds doctors you've never seen and says you're a drug addict that needs to see a psychiatrist, in patient rehab, change your meds every 2 weeks, after 14 failed surgeries and no red flags.
Wow, what a mess. I suggest having a sit down meeting with your attorney to make sure all of your rights are being protected. This sounds like a typical case of workers comp abuse that they get away with most of the time. Do you have a final hearing scheduled? If not, you may want to push your case and try to get in front of a hearing master or judge. Good luck.
@@MattlawAttorney Oh yes...my attny is a whole 'nother story...she recently set up a hearing date to fight against non-payment of a bill for a body part that's not even on my WC case. I've stood up in court (at the end of the hearing when the judge asks if you have any questions) and asked for things 3 different times, that my attorney refused to, and was granted each request, every time. That was sometime around 2007, before all the laws changed in 2010. They took great care to close any loopholes, smh. Not sure if I mentioned this is the previous post, but my Nurse Case Manager came onto my personal FB page, and declared on a public post, that I was in pain because I take pain emds, was an addict and should consider rehab. When I told this to my attny, her response was "What do you expect for posting things publicly!?" !? She insists I need to continuing weaning, even though the judge has said I do not, told me the only people who should be allowed to take OxyContin are cancer patients (how cancer pain is any different from mine, I' don't understand) and that I should "pray". I've tried to find a new attny, but no one will take my case. I'm very concerned that whatever settlement I eventually am allowed to get, will cause a problem with my SSD, as can happen and then you get even less...the settlement money is supposed to help me for the rest of my life-I"m only 50 yrs old. I'll be lucky to get $100K and will then be using it to pay for my own health care, as I haven't gotten much from WC, that's for sure. Unfortunately, the Insurance companies tend to not re-hire those doctors very often. Hi Jonathan, I suggest you hire a board certified workers compensation attorney immediately. You don't want to make any mistakes and lose any rights.

Fortunately, the law in Florida requires them to be called Compulsory Medical Exams. "CME"

I think you are handling your situation well. By having your doctor see you before and after the insurance doctor exam, you will have good evidence to fight with if the IME cuts you off of benefits. Good luck.

@ Eli Toro , it is true that there are some who manipulate the system, but this IS a major problem. There are MANY people who suffer because of accidents & insurance companies try to scam them. This happens in the U.S. & in Canada. Please do some research before making assumptions. Truly disabled people DO need this advice, because like he said, the insurance company's doctor is not there for you. It is to make you look as bad as possible.

You arebpainting all examiners with a broad stroke and neglect to say they may add both a detailed analysis of tje injury as well as helpful recommendations on tratment
I wish in my experience the examiners working for insurance companies did care, and were reasonable, but sadly, after you look at 100 reports by the same doctor, the conclusions are all the same. "not injured, or if they are injured, it is minor and will heal, or if it is not a minor injury, it was there before the crash, etc.

MattLaw , determine if your client was terminated after filing comp. Or from light duty then terminated under FMLA for the same injury. It then becomes a HIPPA violation . So what is the penalty civilly There. Make sure the doctor is informed of the facts. If not, it will be a violation but considered accidental. No prosecution but they will verify the violation.

I apologise for my post-call rage, it was unprofessional, even if this is TH-cam.. You did a good job explaining the process, but I'm so tired of this unfair government ordeal! I have 17-20 yr olds w/DM1 w/no coverage nor money for their vital insulin and they go through hell when applying for Medicaid. And then there are these irresponsible obese poly substance abuse 40 yr olds that get Passport and SSI just because they know how to manipulate the system.

No, they are hired by, selected by and paid by the insurance company trying to reduce your claim. If your attorney was involved in the selection, you might have a fair evaluation.

Yes, this is anytime the company paying the benefits wants a "Second Opinion" about anyone's medical situation.
Can I secretly voice record these doctors?
No, you should not secretly record the doctors, but you can tell them "I am going to record this encounter with you and you must consent to the recording, and that needs to be on the recording. Otherwise you may be breaking several laws, both state and Federal.

That's not true IME company are not Insurance companies and do not work for insurance companies...They are acquired by the attorney and he can use any of the IME organization that's not connected to insurance companies.
Hi Wanda, once in a while as a plaintiff attorney, I will ask my client to get a second opinion. And we select the doctor carefully to make sure they will give us an honest and unbiased evaluation. When these Doctors Opnion's Defamate our Character and Hurt us Financially we shoulld be allowed to sue them, So This Vicious Circle Stops and they think twice about Making Such False Remarks on the backs of Hurt Workers Compensation Recipients. Is there a lawyer out there that would take such a case ?

Sadly, I see hundreds of reports by the same doctor for different people, and the reports all look the same. Same "no injury" and it resolved, and nothing permanent, no matter what happened to the patient.

aka; Seriously Injured goes to assessment. "Specific Complaint" Stabbing Midback Pain... on ice 24/7... The report sent to workers comp was / is... Injured worker "ONLY" wants to talk about his erectile dysfunction ... I Shit you NOT.... In my case this Prick failed to do any physical examination, didn't order any MRI or CT Scan.. then wrote... "No Sinister Pathology Found to explain a reason for pain... Required Psychiatrist to help return to work... 2 yrs later another spinal injury was finally diagnosed... of course WCB Bean Counters then denied specialists requests for treatment stating "We don't think surgery will help.... (2 yrs previously Physician requested retraining and WCB Bean counter stated.. No He's recoverable then denied specific diagnostic testing, requested to investigate the spinal injury... "Talk About a rigged system... It doesn't get more Crooked than this...
I just finished a one week jury trial. And it was sad to see how many millions of dollars the insurance companies pay to their testifying expert witnesses. Financial Bias is huge. I've been on NYS WC for 16 years now. Never heard of being able to video my exam. What a joke they are, and the worst are the psyches that meet for 30mins after canceling the appt, then blames you for it and then adds doctors you've never seen and says you're a drug addict that needs to see a psychiatrist, in patient rehab, change your meds every 2 weeks, after 14 failed surgeries and no red flags.
Wow, what a mess. I suggest having a sit down meeting with your attorney to make sure all of your rights are being protected.
This sounds like a typical case of workers comp abuse that they get away with most of the time. Do you have a final hearing scheduled? If not, you may want to push your case and try to get in front of a hearing master or judge. Good luck.
@@MattlawAttorney Oh yes...my attny is a whole 'nother story...she recently set up a hearing date to fight against non-payment of a bill for a body part that's not even on my WC case. I've stood up in court (at the end of the hearing when the judge asks if you have any questions) and asked for things 3 different times, that my attorney refused to, and was granted each request, every time. That was sometime around 2007, before all the laws changed in 2010. They took great care to close any loopholes, smh.
Not sure if I mentioned this is the previous post, but my Nurse Case Manager came onto my personal FB page, and declared on a public post, that I was in pain because I take pain emds, was an addict and should consider rehab.
When I told this to my attny, her response was "What do you expect for posting things publicly!?" !?
She insists I need to continuing weaning, even though the judge has said I do not, told me the only people who should be allowed to take OxyContin are cancer patients (how cancer pain is any different from mine, I' don't understand) and that I should "pray".
I've tried to find a new attny, but no one will take my case.
I'm very concerned that whatever settlement I eventually am allowed to get, will cause a problem with my SSD, as can happen and then you get even less...the settlement money is supposed to help me for the rest of my life-I"m only 50 yrs old. I'll be lucky to get $100K and will then be using it to pay for my own health care, as I haven't gotten much from WC, that's for sure.

Unfortunately, the Insurance companies tend to not re-hire those doctors very often. The insurance companies are motivated to hire very biased doctors who will tell them what they want to hear rather than an objective opinion.
