      When you have Journals with dates and now received the video footage to match the Journals do you put them together? Does it help to create a new document to put the time and camera number along with it to show even more proof or how would you do that? Thank you so much for the videos! They help so much!

      I want to say thank you Branigan for a lot off helpful advice. Even though we all know this isn’t legal advice, there is still amazing great tips that everyone could learn from here.
      As weird as it might sound, I’m a trade union representative in the uk, but your advice here and the way off just thinking is exactly the way we are trained to think about the way we see our contracted companies here.
      Again, we don’t see this as legal advice but we do absolutely take it on board and even with different laws, we are not so different in the way we think. Thank you bro for these videos. The help people understand not so much from our view but from the same way I try to tell others with my experience, from the company view.
      Keep these up branigan. There’s a lot to learn from these videos for anyone that’s trying to defend themselves, even outside of California 😉❤️❤️💪🏼💪🏼

      Caution: I sent my work journal to myself, t notepad file had my thoughts and feelings the company fired me after they got a copy from I.T. The accusation was fraud dishonesty and breach

    Some employers actually think that employees don’t have the money or courage to sue them. Smart employers are careful not to mistreat employees and risk being sued. Problem is some non owner managers are morons that act like knuckle heads and do stupid things at work. Them the employer is stuck with a lawsuit. Employers need to train their managers! Employees need to report bad behavior at work. Even if it is your boss. Document everything and stand your ground! Don’t let anyone bully you at work, ever!!!

      I have saved documents , I have complaint in the past, I have gone to the government and here I am working in the same company even it is notorious they want to fire me :) they cant unless I give them a reason :)

    I have so much my attorney was like that's enough for now. I have a 47 minute phone conversation with my supervisor (as an 1099 I had a supervisor and regional manager) It was a full conversation about what is going on behind the scene and who was calling the shots and not labeling me correctly. Not wanting to pay me. He was cussing and just getting really mad. He didn't know I had already served them with a lawsuit after 3 long years of trying to get them to pay me correctly. 5 years and they made me an employee after I served them. They know they are wrong but I believe their attorneys are going to drag it out because they want that hourly rate. They better wise up because they have to pay mine as well. The price is up there already.

    I just now wish someone would have shared all this information l have learned from your videos. I would have handled my wrongful Termination way differently. For instance saving emails, texts, voicemails, work documents (Time cards, performance evils). Thankfully I had a great gut feeling of “something wicked this way comes”. Although saving 95% of this info, I could’ve probably had saved more proof that could potentially help me if I would have saved it and transferred the info without setting off any geek squad programmers…

    this was a great and very informative video! I subscribed! Do you have any videos for when Employers do not pay at-will employees.
    ( ex. substitute teachers) or videos where employers "gang up" on a new employee to force them to resign through intimidation tactics like deliberate bad evals? specifically, new Paraprofessional teachers that have seizures. I am thankful to find your videos! excellent videos!

    Thank you Branigan, I love all your videos! It will be great if you cover the topic of Non Soliciting agreements employees are asked to sign. There is a lot of confusion that non soliciting agreements are illegal in California while they are legal in other states. Now the question is if a former coworker is asking for a referral, is it ok to refer them to another job?

    For taking pics of documents, Adobe has a free pdf scanner app. You take a photo of a printed document and it turns it into a pdf. Really nice quality too, great way to save photos of printed things you can't take off site.

    Great video! So informative.
    I really need a good Employment lawyer in AZ. I'm being discriminated against while on ADA. Plus I had COVID-19 & was out for 1 month in January 2022 at the end of my 90 day and they told me I did not qualify for my hiring bonus since I did not meet the 450 hour requirement in the first 90 days of employment. Even though they sent email saying don't come to the office if you tested positive for COVID-19 and I was protected with ADA form from my Doctor. They still punished me by not giving me my promised hiring bonus. They did not consider the Pandemic or COVID-19. Is that lawful ? Plus after my email inquiring about it, they immediately within a day placed me on a Written Warning due to not meeting all my metrics. How could I meet my metrics if I'm sick calling out on ADA? They don't keep that into consideration. I really need some help!

    Is it considered sharing a confidential information if I filed a whistleblower complaint with OSHA, gave them screenshots from text messages and emails as an evidence and I wasn’t represented by an attorney at the time?

    Before I was hired for Taipei Chinese Kitchen,a few new employees were suffered hostile workplace, Ms , Judy from Hong Kong,Judy’s provoked conflicts to new employees and forced employees to quit,those new employees never got pay.or got shares form customers tips.Judy only shared tips for Judy herself and Chef Lu and Chef Ma.

      Make sure the EEOC case is legit. I'm going through it now. EEOC will interview your friend to see what the issue is. When, where,how, why. EEOC will want to know why you feel discriminated, when it started ECT. If they feel like it's a waste of time they will let you know in 7-10 days through mail and email. That person that interview your friend will be the EEOC Case worker who decides if the case is worth looking into or dismissed.

      Make sure u have all your ducks lined up in a row. Email, documents review, recognition, PIP ECT . Timeline of events are on point. EEOC still can't find a solution u can ask if they will give u the right to sue, so u can take it to trial

      I’ve been doing with this for years. From the first incident, a copy of the email I sent to my boss in case it became a problem in the future. I have since always now since my situation didn’t change, and it would be other instances, I copied and CC these emails to myself.

    I saved everything from the day I started. I have 2 binders full of evidence messages dating back to 2018. Emails text and phone calls. In my state I'm the only one that needs to know the conversation is being recorded. 1 party state. I got the juice.

    I have a question, how come my supervisor, manager and HR is still working with the employer. When I filed EEOC and they gave me the right to sue? I thought companies would let employees go, especially when they caused the company to lose thousands of dollars?

    I would log into the free email account once in a while, so it does not get deleted as an inactive account by the service provider.

    Misclassified as 1099 and owed unpaid wages along with other things. I wish you would do a video about what else you can sue for besides the lost wages and the emotional stress it puts on you when you try to for 3 years for them to label you correct and pay you. They offered me nothing during my employment with them. No benefits no nothing. The made me an employee after they were served with the lawsuit. I left 3 months later because they started ignoring me.
    By the way I have all these things. They never issued pay stubs but have my direct deposit and pulled my hours off the system all years. I worked for them for 5 years.

    Please help, I need advice: I uploaded already my documents on EEOC website before AJ was assigned, and before PCI. I cannot delete them, and EEOC tech support advised me they have no access to federal EEOC. Will the AJ discard my case if I uploaded all docs without permission? And the Agency attorney already saw them all, probably. You never addressed that aspect in your videos....

I do have a question..would it be possible to make a video regarding at will employee offer letters?......I am currently an at will employee and work remote at one company and have an outstanding performance review but i have extra time during my work hours....I applied to a 2nd remote job that operate at the same time 9-5 as one income seems to be hard in CA. The 2nd job offered me a remote position too but in the offer letter it stated "while you are employed by this company you agree you will not engage in any other employment, consulting, or other business activity without the written consent of the company. In addition you will not compete or hire from our company" I am hoping to work remote both jobs but really confused of this outlined language as I also do eCommerce and other online business and not sure if I am breaking the law or agreement? I am also a bit confused since I understand that at will employee means that I technically am not signing a contract since at will is not a contract. Would I be in trouble for trying to make a living? Thank you! ❤️

      That's a great question. While I don't have time to do a video on this subject alone, employers are allowed to restrict what their employees do in these situations. If you are working at company A, they can prohibit you from taking a second job at Company B while you're still employed because they want your best efforts. There is something called the duty of loyalty. But honestly, its pretty fuzzy in my head as we don't come across situations like this too often. My recommendation for people in your shoes is to simply get permission. Let them know that you have another part-time gig and you work for this other company when you are not working for Company A. If you're a great employee, and they are cool with it, you're good to go. On the other hand, if not, or Company B is a competitor, they can say no. I understand that its not fair, but there is a significant difference between what is fair and what is unlawful.

      @@braniganrobertsonlaw I guess I will need to think this through as I believe it would be unlawful if I knew trade secrets or the secret sauce recipe but I dont know any of that kind of information. I mean how can one prohibit one to be involved in any other business especially for people who are trying to become entrepreneurs.....so much to think of and then I get lead to the actual wording of everything and think maybe the Blacks Laws Dictionary may have some loopholes, or maybe I need to look at Labor Code sections 2860 and 2863, like wouldnt I need to be considered fiduciary to the company for duty of loyalty to be applied to me?     The Agency refused to allow my union rep who is the only person who witnesses the management's discriminatory and then retaliatory statements and actions from being interviewed by the investigator and from having her statements included in the Report of Investigation. Is that legal? How do I have the EEOC AJ accept my union rep as a witness even though the Agency refused her testimony in the ROI?

    What if you downloaded emails and or a folder, but didn't need them for a lawsuit, and deleted them?

    what if I don't have my old emails and documents because they let me surrender my computer because they found out that my computer got compromised. That happened a couple of days after they offered me a separation agreement. They said it was a mutual separation agreement but when I read the draft, it said that I was the only one who solely wished to resign when they were the ones who wanted me out. They were saying that they wiped out my account so I can't use it anymore. Then found out later on that it was on quarantine and they were looking into it. they gave me a new computer with my new account that does not have any of my old emails and documents. it is literally a new account. I am still working in this company but would like to get out. I feel like they're doing something that I don't know and will surprise me one day.

    Thank You for your Extremely Informative Videos. You seem to be a Brilliant Attorney. I would like to see VIDEOS THAT ANSWER THE FOLLOWING QUESTIONS, and I would greatly appreciate it if you would please answer the following questions. My Private Attorney seems to be a Lazy Negligent Incompetent Attorney. I had no prior experience with Attorneys. I would like to know what constitutes a Good Attorney? Under what circumstances should you Fire your Attorney? What would YOU do if you had an Attorney such as mine? I have an Attorney who:
    1)Is so DISORGANIZED that he CANNOT FIND the WRITTEN FACTS OF MY CASE even after dozens and dozens of hours of looking for the Document, such that now the Document is essentially lost. I remembered the Facts when the Document was written, but now I do not remember many of the Important Facts. And of course my lazy Attorney does NOT remember the Facts either. Isn’t an Attorney supposed to be Organized and Easily Find the Written Facts of his Client’s Case?
    2)One of my Attorneys Took Notes and Wrote my initial Statement Of Facts regarding my Case, but after that Attorney left the Organization, my present Attorney Lazily REFUSED TO TAKE ANY NOTES about the remaining FACTS OF MY CASE. And when at my request my Attorney set up Appointments to hear me talk about the remaining FACTS OF MY CASE, my Attorney lazily REFUSED TO TAKE NOTES, saying that he would Remember everything I said; then later HE FORGOT MOST OF WHAT I HAD SAID. Also regarding the Appointments to hear the remaining Facts Of My Case, my Attorney arrived Late, took a Long Lunch, and Left Early to go Play Basketball, etc.; he was Extremely Well-Paid for all of that. Isn’t an Attorney supposed to Take Detailed Notes regarding the Facts of his Client’s Case?
    3)I had a WILLING CRUCIAL WITNESS whom MY ATTORNEY REFUSED TO BOTHER TO INTERVIEW, and he even Refused to take her Contact Information. Isn’t an Attorney supposed to Interview and keep Contact Information regarding Crucial Witnesses?
    4)It seems that my Attorney engaged in IMPROPER BILLING. At times my Attorney charged Exorbitant Amounts Of Money to Represent me, while NOT actually doing anything on my Case. What should be done regarding an Attorney who Improperly Bills?
    5)Generally my Attorney DOES NOT COMMUNICATE with me. Generally my Attorney says he does NOT read my Mail, read my Email, nor listen to my Voice Mail. What should be done regarding an Attorney who Refuses to Communicate with his Client?

    My employer deleted my emails right before my bully and I were gonna meet with Human Resources. I called The correct dept to ask about them and they apologized and said that they have to clean out memory. Which I thought was so wrong. I told them that they were extremely important to me and couldn’t believe they had done it .

    Thank for your educational guidance!I was forced and harassed to do unsafe work by Chefs to do their dirty work after 10:00p.m.Ms,Judy was never required to do Kitchen tools ( meat cuter,sharp knives) hides under dirty greasy deep sinks! However, Judy and Chef Lu demanded:Jen Shadle to do it with out rubber gloves within 10 minutes! Bullied and mistreatment all day,because Employers has affirmed that I Jen Shadle with full time: Hot Case attendant position.     I currently work at subway 30+ hours a week a couple times and I don’t have a break after 4 hours and I have to close the store by my self and I’m by my self In the store for multiple hours and I’m 17 CAN I SUE FOR MONEY??
