      @@Aereto And that is the fun part, how many times haven't DAO's been broken by bad code. Or have crypto coins lost value because due to bad coding someone could withdraw a lot of value. And more fun, at times the code was so bad that value could be put IN the system but the code was borked such that no value could be taken out.
      Yup, some projects had such bad code that you could put money IN... but never draw it out. Not even the development team could do it.. so much ether stuck in the air...

    If this actually went to go to court it could go two ways:
    - Seth Green wins and in the process ruins the main selling point for NFTs in it being a deregulated decentralised ledger that no individual, company or country has control over.
    - Seth Green loses and the whole media circus around it only shows more and more that relying on NFTs isn't a good thing. Aka massively bad PR for the whole NFT and even crypto space.
    Except for DarkWing giving/trading it back or Seth Green just giving up this would be a massive lose-lose for the entire NFT market/players.

      @@TimTams_64 you are right on that, but thing is, how would the government seize nfts and cryptocurrencies, seeing how they are unregulated (currently) and impossible to revert any illicit transfer, unless you cause a fork in the system?
      unless the government raids the guy's house to get the password to the account that holds the nfts, its unlikely much can be done about this.
      also doesn't helps how, from a legal standpoint, its hard to know if a transfer is supposed to be legit or not, considering any transfer is called a transaction, so that would be pedantics that would have to also be argued with for a long time.

    it's funny how they advertised NFT as supporting ARTISTS while actually a lot of NFT's are also sometimes just stolen from Artist without their knowledge, as a Artist myself and hearing about it the first time from Artist friends it made me really sad about this way of exploiting the Art and Artist that made these wonderful pieces

      That’s a massive problem with NFTs, there’s no demand for proof of ownership of the image before minting. It’s too easy for NFT-bros to copy paste an image, mint it. When the artist catches on to what’s happened they have to rely on the NFT community to fix it, which is a seemingly very hypocritical excuse one.

    I love how NFTs have basically laid bare the complete, abject failure that is a totally unregulated market. You don't want grubby rules and regulations getting in the way of your market?     If it goes to court there's two options: Seth loses and there will be precedent that the whole scheme is dangerous, prices crash into Earth's core, Seth wins, and suddenly NFTs are recognized as worthless by the law. It's a lose lose for crypto bros if it happens, but I doubt the guy even comprehends the consequences of trying to get the law involved, will need some popcorn for that

      Seth winning wouldn’t render NFTs as worthless by law, just redundant. As long as the trade history is approved by the juridical system and thus the state, the NFT counts as a token that corresponds to the IP.
      But you know, if the trades are approved by the juridical system, there is another form of goods available that can be traded and counts as a proof of holding the IP. This being the actual IP.
      Also, there are actually more valued attributes of NFTs people mean when they say “code is law”. Complete lack of financial regulation making washtrading, tax fraud, non-disclosed advertising possible. The future of those is still open.

      Not quite true. More of a human inspiration + human action to fixed media. Most of the nfts are sort of interesting because the "traits" are made by people and clearly copyrightable. It gets interesting if the images referenced by the nft can be. Probably "it depends" is the right answer.

      @@shinji391 actually upon doing further research, somehow and for some reason this specific run of NFTs comes with the copyright rights. Im not sure why this project has it and others dont. Copyright isnt REALLY protected by law as it is. companies filing suits and protecting their own ip is what does.

      I hate the NFT art thieves the most. How do you solve it? "Make your own NFT each time you make an art piece" But what about old art? Well you gotta pull em down and race getting all of them with NFTs.. wich if you are a starting artist being stolen from is impossible vs the NFT mining rigs.
      NFTs are just fucking receipts anyway. Hanging a NFT on your art doesn't give them ownership at all and infact if taken to court, you will win as the owner of the art piece.
      But... again... that's a long path.
      I fucking hate what NFT scammers did to artists, but I seen other artists selling their own art as NFTs gain money to support themselves so it's not all doom and gloom, but again.. that's a very small percentage that does this.. LIKE VERY SMALL. Don't recommend the NFT market at all since it's a landmine field filled with gold nuggets.

    In many jurisdictions receiving stolen property is a criminal offense but if the party receiving the goods acted in good faith not knowing it was stolen they don't get charged. However, once they're aware of the fact that the goods were stolen if the receiver chooses to keep the property he may be leaving himself open to criminal and/or civil liability. Many jurisdictions have laws on the books that make it illegal to profit from a crime.

      It technically wasn't stolen. Seth gave permission to the scammer to his wallet himself and the scammer helped himself. Yes, he was deceived into it but often times if you're careful you can catch these fishy transactions when you're asked to approve them. So, he was a bigger moron than most people believe :)
      The wallet expressly tells you the contract is asking for full access to the wallet and you have to approve it. It also forces you to scroll through the text before approving the transaction! Those transactions are not normal. You don't have to provide that access during regular transactions.

    I'm honestly surprised that any production company would want to help make a show based around an NFT. The legal situation is simply horrible, as shown by the "theft". I mean what happens if Seth somehow gets the NFT back, and its stolen again? Production again stops. What happens if its when the show is airing? Is the show pulled because the new license holder says stop? Does the company have to make a deal with each successive owner? I can't imagine any company wants to deal with such a headache and I get the feeling that this show is dead, even if the NFT is "regained".

    I'll be curious to see how this develops. Within the US, for something physically real, just because you have it in your hands, doesn't make it yours, even if you unknowingly bought a stolen item. If the law finds out and can track down the item, you as the current "owner" will have to return it to the previous proper owner. The exact process varies some though.

      What I don't get is why he didn't go directly to BAYC & offer to do a show w/ an Ape if they gave him the rights to make one off the risky blockchain where stuff can & has been stolen before. They "own" the _"art"_ style, so Seth couldn't just make his own Ape, so why not say, "Look, I'm famous for my animation & comedy via shows like Robot Chicken. You give me the rights completely of an ape that can never be stolen or lost in any way & I'll make a show publicizing BAYC."?     It's unlikely that the NFTs could even have character IP rights associated with them at all. Many of them are nearly identical, so they can't really have distinct IP rights. Let's say I buy an ape with their mouth closed and I create a show with it. If someone else has the same one with its mouth open, can they sue me if my ape opens its mouth? Some of them only differ by a background color. How do the rights work if you don't use it?
    Can the ape legally change its shirt in Seth Green's show? It's not a good situation to be in, legally.

      The thing is Bored Ape made a contract stating if you own the NFT, you own the IP of that specific ape. Which means, yes, you can't do jack shit with it unless you own it.
      I don't know how that's *enforceable* when you don't literally own the content linked by an NFT, but it's probably a TOS thing of "you own the hyperlink, we honor your ownership of the IP."

      It's like owning the rights to Barbie, but only while she's frowning and wearing a purple shirt. And someone else owned the rights to her smiling and wearing the same shirt.
      Also, it's not clear the contract is even enforceable, since there's no assurances that all sellers are agreeing to the terms. Although I guess ultimately Yuga Labs owns the rights and their site just explains how they license the apes. They could change that own a whim, I think.

      I have a friend who is into it hard. He got lucky with some crypto--made close to $800K--and now he's all about this shit. He had lost tens of thousands over the course of a decade before he made any significant profit. He was pretty terrible at traditional trading of stocks and has abandoned that avenue. Literally can't argue with him about how stupid NFTs are though because he's the one with almost a million dollars.

    The best part is that the people who made Bored Ape Club have zero idea on how copyright actually works.
    They claim that NFT owners are protected under copyright laws but that can't be farther from the truth, since only things can be protected under copyright laws.
    Where am I going with this? Well, since all Bored Ape NFTs are made by an algorithm, copyright laws don't apply at all, there was actually one court case where a cameraman had his camera stolen by a monkey, the monkey took a selfie and the cameraman wanted to claim copyright on the photo, since his camera was used to take the photo, but it was ruled that since the monkey made the photo, copyright laws don't apply to it.
    So it doesn't even matter if the surgeon bought a stolen NFTs, copyright laws don't apply here at all.

    I really hope this goes to court _and_ that Seth wins. That would mean the NFT itself, the receipt, is legally deemed worthless. That it would not matter who's name is on it, it does not prove you own anything. I don't have enough popcorn for the shitshow that would happen when these scammers try to twist that into a positive.

      That's not correct. If you steal money you basically "own" it. If some proves in court you obtained it from them by immoral means you might be made to return it to them. It doesn't mean the money is worthless.

      It's really a lose/lose for NFTs.
      Seth wins and NFTs are no longer a new and novel decentralized record of ownership, because the NFT contract is overridden by law.
      Seth loses, and it proves that NFTs are incredibly volatile, and that you have no recourse in the event of scams or theft. That will send a chilling effect to any company trying to capitalize on NFTs in the same way.

    This is so funny to me. As a programmer, I've heard some actual good ideas for NFTs and tokenization as profit sharing schemes for creators. Group publishing, unique digital business cards, and searchable contract databases are some of the better examples. It's a landscape filled with moronic ponzi schemes though, in reality. The other problem is the technology, smart contracts are designed in pretty much the dumbest way imaginable, making them mostly useless. I hope in another ten years people start using blockchain for its true potential instead of this stupid shit.

      Ethereum has moved to proof of stake, which reduces the energy requirements greatly. It now only uses as much power as TH-cam, whereas before it was using as much as an oil refinery or a steel mill.

    If it went to court it would be a complicated case that would likely end up being about does the licence agreement still apply if the owner of the nft didn't agree to it and if the agreement doesn't apply who ends up with the rights. The rights only transfer because of the licence agreement which makes this a contract law problem involving a stolen asset.

    I’m hoping Darkwing has contacts with the hackers, and they steal constantly, he “pays” exorbitant prices, and they transfer the money back to him, and then can try to barter with the “well I paid this much, so what’s it worth to you?” Reminds me of the whole WATA game grading thing where they trade amongst themselves to artificially raise the price.

    Could not have said it better myself. True art is both priceless and valuless. If you are buying art for the sake of the art, you do not seek out famous or pristegious socialites to peruse their gallery. People who do that are not seeking art, they are seeking social status. If you want art you seek out an artist who you trust to create what you have in mind, or you see a piece that you really like and so you buy it, whether it's $10 or $1000 is not the point, it's the art. Historical art is another matter, and that stuff rightfully belongs in a museum.
