So they probably couldn't file a case because a crucial part of the investigation was to know where the "suspect or alleged rapist" is; in order for it to actually go to court. They also probably didn't have permission or the time to ask for permission, specifically asking other police departments to search for him before he left and escaped again, to continue their investigation outside of their local area.
P.S. sorry if you have to read the whole paragraph, but when you look at situations dealing with the law you have to understand how the law works and how an investigation can become a case.
