- The United States is facing criticism around the world for its latest threats against the International Criminal Court.
President Donald Trump has signed an executive order sanctioning the ICC's staff and their families.
The US, which is not a member of the Hague-based tribunal, is angry at investigations into suspected war crimes in Afghanistan that could implicate its soldiers.
Secretary of State Mike Pompeo called the ICC a "kangaroo court".
The International Criminal Court has rejected the sanctions as an unprecedented attack.
So, what's behind president Trump's move?

If the glorious defender of freedom is so holy, why is it scared to be held accountable for US war crimes across the world?
Wars are supposed to be run by generals and not by lawyers. The countries which couldn't defend themselves during WW 2 now run the ICC. The Netherlands is the most hypocritical example in the Hague. They were very happy and applauded the bombing of cities including hospitals during the last world war.

I always thought every country is part of the international criminal court and they could be held accountable under the UN
1st year law student here so I'll do my best to answer your question :) ! Pretty much the ICC can only investigate international crimes (war crimes, genocide, crime of aggression) if it has either the consent from one of the 2 opposing parties (in this case Afghanistan or the USA), or an order from the UN Security Council. Afghanistan automatically provides the ICC consent to act on their behalf in investigating the USA for international crimes because Afghanistan is a party to the Rome Statute which is essentially what gives the ICC its powers/jurisdiction.
What Trump tried to do here is threaten to place sanctions on members of the ICC if they went ahead in investigating the USA's potential international war crimes.

This is an easy one. The Vice President of the ICJ is Xue Hanquin, a Chinese Communist Party (CCP) Member. No bias there, right? Let's look at the prosecutor. Her name is Fatou Bensouda from Gambia. As of Oct 2018, Gambia owed 20% of their debt to, you guessed it, China. Many countries in Africa owe a lot huge debts to China through the Belt and Road Initiatives (BRI). Let's take a look at the President of the ICJ. Abdulqawi Yusuf is from Somalia, which has a long history of friendship with China and they are indebted to China under numerous BRI projects. The appeals court judge who read the decision is Piotr Hofmański of Poland, another BRI debtor to China. I'd say the US is under investigation directly due to CCP interference and manipulation.

It is assumed that the ICC has competent legally read judges and administrators not to have strayed itself into this grey area. The US is not a State Party to the Rome Statute of the ICC (Rome Statute) which founded the iCC in 2002.. This is an area of International law which has no force of law unless the party submit through recognation / ractification. The US is not a party, hence it does not submit itself to the jurisdiction of the ICC. The ICC could refer cases of US errand servicemen back to the US for their due processs and will have no jurisdiction to pursue the case. However, therein lies the problem. What if the US refers an international criminal to the ICC for prosecution, like recent cases of genocide in the Bosnia? Isn't there a contracdiction here, you may ask. There are contracdictions certainly but for now, the US is seen after WW2 to be the only "Force" moral enough to stand on high ground to set stadard for the free and at times to act as "Police Force" of the world to upholds the rule of law. Usurping this equilabrium of harmony by those in the ICC would be suspicious particularly, at a time when the Chinese CCP had been accused of having "infiltrated" and "corrupted" most UN bodies. There seems an awakening globally of awreness after the Covid 19 to connect the dots.
