      He's a gem! You have quite a few of them, actually. People who can calmly explain the law and the Constitution without bluster and drama, just the facts about the law and the Constitution. All democratic countries in the western world have people like this. It's just that you - the American people - need those calm, rational voices more than most of us right now. Unfortunately!
      I have been watching from afar in a state of constant infuriation and dread, and I can't even begin to imagine what it must be like for you guys to live in the middle of all things Trump, MAGA Republicans, lies, projection, hypocrisy, criming, cruelty, and constant, endless chaos. If only you knew how many millions of people in your allied countries have been cheering for you and crying and raging with you... We've always paid attention to American politics because you are such a big and important ally, but since 2016 it has been an obsession. Trump and his ilk must be held criminally accountable for at least some of the worst damage we know they have done to your country. You deserve AT LEAST that much after all you've been through!!! ❤

      Yes, but he is more positive, at least publicly, about SCOTUS even taking on the 14th Amendment question than I and many others are. I think SCOTUS will rule against Trump having full immunity but refuse to get involved with the Colorado case. That would allow at least some individual states to take Trump off the ballot but I don't know how many states have laws to do that or if they will include some he needs to get enough electoral votes. Wish somebody would answer that.

    So I am one of the newest political junkies, I went from not caring much, to I listen all the time now! It is fascinating and scare the pants off you serious all at the same time. I bounced between Neil, Harry, the Mideas touch guys, Andrew, Nicole and I always appreciate these discussions Katie. These decisions have such huge implications for us today and more importantly, for my children in the future.
    The state of poor healthcare for women in the state of Texas is what has put the blow torch to my interest. It’s truly sad that women in the state of Texas are now terrified to become pregnant. I will be encouraging my children to leave their home state and I will follow if this type of government legislation continues down.. as I say this, I feel my grandmother rolling over in her grave that this is the way we now have to look at her yellow rose of Texas state😢

      This is so true. My neice-in-law in NC is terrified about not having adequate healthcare available during her pregnancy. She had complications with her first child, and they worked out, but her health was endangered for a time. Women, whether they are in planned, desired pregnancies, or not, deserve the right to make these decisions with a healthcare professional without the interference of government.

      I enjoy hearing the dulcet tones and considered logic of Neal Katayal; I can’t say the same of Katie Couric -her voice grates like chalk on a blackboard, and her questions, especially the way she interrupts the answers of her subject, just rub me the wrong way. I put up with her to hear from him, but even so her ‘contribution’ diminishes the product to the degree I have to think twice before clicking. I may very well unsubscribe, that’s how much her ‘dumb broad’ act grates me. She is obviously smart, why act like an idiot?

    This was very helpful and I kind of feel like Neal! For some reason, I think these judges have a way to sever themselves from Trump and I think that’s something they have been wanting and this is the absolute best way to do it!!! I’m tired of people tiptoeing around him and his goons, worrying about how they are going to react! "As then-Judge Gorsuch recognized in Hassan, it is 'a state's legitimate interest in protecting the integrity and practical functioning of the political process' that 'permits it to exclude from the ballot candidates who are constitutionally prohibited from assuming office,'" the state opinion reads.

You answer in layman's terms for those of us who are not attorneys. I would love for you to be the attorney on a few of Donald's trials! I just wanted to share that with you !       Not all the 'felony counts' are equal! The Mar a Lago case has 40 charges - 32 of which apply to the 32 documents! So hatever the verdict is applies to each of the 32 charges! Similarly, not all charges are 'equal' if found guilty! Some, like MaL can result in up to 20 years incarcertion, as can the Georgia RICO charges - which is probably the one most serious case!

      Unfortunately, 91 felony counts do not equal 91 felony convictions. He needs to be proven guilty of these crimes, for them to be "actual" criminal acts according to the law. He could still be found not guilty of some of them (if his law team had any brains, which they don't seem to be that competent).

    Great interview. It was extremely helpful to hear about all of the cases in one omnibus interview. Neal offered a different take on the Colorado case from that of most commentators I've heard. His background and experience arguing before the court makes his viewpoint especially important. And Katie, what a nice reminder of what a great interviewer you are!!

    Isn't the other problem, maybe even the _real_ problem, that this despicable candidate has so much voter support? Does democracy work when the electorate is deranged?

      I debate the democratic tool called "persuasion" is built for that problem. Itll be a grind for sure, but that's why we shouldnt write off these folks and try to persuade them to see logic that is based on our shared reality

      There is always a percentage of the electorate that is deranged, misinformed, racist, etc. The main problem that US democracy has is Citizens United. Campaign funding transparency together with an independent press would solve the MAGA problem.

      There aren't as many as the media puts forth. Many have peeled away. They, this 15% or so, will always be with us. And this Trump cult is a real cult, and nothing you say will change their minds. They are thoroughly brainwashed and cannot be reasoned with. Let the FBI deal with the violent ones, and "f" the rest. We, the vast majority, needs to vote and be otherwise active in our Democracy.

      Exactly, learning recently about the 2025 document from The Heritage Society, and how they have been influencing all Republican Presidents since Reagan to get us to where we are today made my blood pressure rise. The control these dirty corporations have over our Judicial system (Clarence Thomas, Alito and possibly others in the Supreme Court alone) and the entire Republican Party has got to be changed. We need to clean out our government, all the Insurrectionist removed and any who have abetted them. The Heritage Society and The Federalist Society removed from interactions with our government for personal gains to control our government. So unbelievable, new laws need to exist, the people should be able to remove Citizens United imho.

    Katie, Letitia James is seeking a penalty of a STARTING BASE of $250 million and going up from there. NOT "up to" $250 million. Thank you for correcting your future comments on this fact.

      Indeed! I've seen both 'from' and 'up to' reported! And, of course, while that's what she is asking for, it's Judge Engoron who will be making the actual decision - taking little or no notice of what James is asking for! So it could be any amount! I'm predicting more than 250M and loss of NY Licences at least, but whatever it is, it'll be appealed!

    Seems to me people are making this question too hard. It is the Constitution of the United States that is the highest law of the land. The Constitution creates the three branches of government. More specifically, article 2 section, 1 creates the executive branch and the office of the President: "The executive Power shall be vested in a President of the United States of America." Therefore, the office of the President is an office under the Constitution.

    My problem with all of trumps court cases is he knows he is guilty and is not seeking a plea deal. Trump is costing this nation a fortune in legal costs and does not care. I hope that he is given the maximum punishment for his obstinance and what he caused this nation.

      No one is interested in giving Trump a plea deal. Even in Georgia plea deals were not offered to Trump and his immediate accomplises. The cost of justice is miniscule compared to the righteous outcomes with the hope this will quell anyone believing they could bring down the United States.
