ACS Migration Skills Assessment: salary paid in cash

  • This video is based on a 189 visa refusal case at the Tribunal. There was limited documentation and salary paid in cash, but ACS in 2017 assessed the applicant as suitable under 261313. However, the department refused the case due to insufficient payment evidence. The Tribunal considered the case with fresh eyes, was happy with the payment evidence presented, and took a decision in favour of the applicant. It is important to note that sufficient payment evidence was not a requirement from ACS in 2017, but it is now mandatory. This case should not be taken as a precedent or an example, as we are not living in 2017.
    Case highlights:
    Bachelor of Technology in Computer Science from India
    Two jobs (Associate Consultant) for two or more years and Functional Consultant for over five years.
    The applicant entered Australia on a student visa.
    Finished Master's degree Master of Technology (major in ICT) and completed Professional Year (PY) in 2017; applied to ACS under Software Engineer (261313) and got a suitable outcome with two years deduction. So, the applicant claimed 10 points for the Indian experience in the EOI. As a result, the visa aspirant got invited for a Skilled Independent visa (subclass 189) and subsequently applied for it, but consequently got the visa refused. The visa applicant submitted payslips, an Employment contract, an employment reference letter, a final settlement report, form 16, a resignation letter, and salary hike letters. However, there was no bank statement with regular salary deposits from the employers. The applicant gave a significant portion of the salary ( in cash ) to the applicant's father, who used it to pay the insurance and used it for the applicant's brother's college fees and routine family expenditures.
