      Harish Salve is a brilliant lawyer. I am shocked that the BJP doesn't hire him in a more official capacity though I presume that might be to preserve his credibility (any lawyer who once joins a party becomes a Politician)

The famous quote "The only thing necessary for the triumph of evil is for good men to do nothing" is supposedly by John S Mill but it is often attributed to Edmond Burke. Although I doubt it was Mill, a noted liberal of his time.

    Please explain the issue of Prashat Bhusan case. Was the contempt called upon him only because of his tweets or because of some "other" reasons? (His work to show prevalent corruption in the judiciary). Moreover, why was the contempt case given to a judge whom Prashant Bhusan had earlier criticized at many occasions?
    These points raise grave suspicions.

      Democracy ke naam par har kisi ki gand me ghusne ki azadi le lo tum, Bhushan case is different he goes with petitions everytime to same court one which he do not have trust, now if you dont have trust then why you go with new new petition and whenever he loses case, he tweets...jaise chota bachcha rota mummi mera toy nahi diya supreme court ne...halwa hai kya...har bar...and I am sure court will not punish him since supreme court is not what bushan want to portray. And I wish and sure will get relief with stern warning...

      Hi Yash, the sedition law only prevents you from talking anything that degrades the integrity of the nation. That's because, we still are a young country and learning to be tolerant. At times of extreme internal disturbance, this is used. Everything else if protected under the free speech. Making a rhetoric statement on democracy because of these statements is too much of a exaggeration right?

    “Our democracy will not sustain if we can’t guarantee freedom of speech and expression,” Prime Minister Narendra Modi said in June 2014, after a month in office. Indeed, free speech is so ingrained that Amartya Sen’s 2005 book, The Argumentative Indian, remains as relevant today as ever.
    Yet Indian governments at both the national and state level do not always share these values, passing laws and taking harsh actions to criminalize peaceful expression. The Indian government uses draconian laws such as the Arm Force Special Power Act, the sedition provisions of the penal code, the criminal defamation law, and laws dealing with hate speech to silence dissent. These laws are vaguely worded, overly broad, and prone to misuse, and have been repeatedly used for political purposes against critics at the national and state level.
    The Supreme Court has so far refused to intervene in the matter or even pose pertinent questions to the executive and hold it accountable for its policies (or lack thereof) to abate the crisis. Even as the government is making patently false statements in court, including the statement by the Solicitor General recorded in the order dated March 31, passed in Alakh Alok Srivastava vs Union of India that as of 11 am that day, no person was walking on the roads to reach their home/village. Not only has the court abdicated its judicial responsibility, it has also demonstrated an unprecedented apathy and heartlessness to the plight of the most vulnerable citizens of the country.
    It was the Supreme Court which interpreted the fundamental right to life enshrined in Article 21 of the Constitution to mean the right to live with dignity and not mere animal-like existence. The nation expects its rights jurisprudence to advance with each successive generation of its Justices. It is, however, extremely distressing to see statements from the Chief Justice, according to whom as long as migrant workers are being provided food, they do not need to be paid wages, or the absolutely callous manner in which the Court stated that “it cannot monitor the activities of those walking on the road.”

    Do you know? By and large, contemners are let off by the courts with a warning or after an apology. In civil contempt case, it is always so. Even in criminal contempt cases,Very few are actually jailed. But Prashant Bhushan has stepped one too many judicial toes. Even he must learn to restrain himself, just as the judges too will eventually do so.

    Wonderfully presented. Hope Justice Arun Mishra and others are watching. If you are in public life and your role is continuous conflict resolution you need to be able to take criticism however unjustified you may think it to be. There will always be aggrieved group. The same goes for the Government. You can't be that touchy.

    While there might be some merrit to what you say, but it is also important to look at the intent of the person, and in Prashant Bhushan's case one can clearly see that it was malicious and to sow discontent against the court in minds of people. That to me is very dangerous

    SG has equated honest mistakes & criticism of decisions with repeated & vicious comments about Judges just because they did not agree with PB. Ignoring such comments will encourage others to follow suit. It is high time he gets a slap on his wrist at the minimum.

      Allow me to disagree with your conclusion. For 'a slap on the wrist' that you talk about would not desist people with malicious intent from disparaging the Judges, but what it might do is to silence the honest criticism. And, I don't think it's wrong to criticise judges. Infact the condition where our justice system is, where people have lost faith in judiciary so much so that a common man cheers when gangster or rapists are killed in staged encounteres not because they like this overreach of Police, but because they don't trust in Judiciary to deliver them timely justice. And, the biggest, or maybe even sole blame of this rests on the Judges who have not only done nothing to reform themsleves but have actively obstructed Parliaments attempt to bring about any kind of reforms.

      First I also feel there is a high time that we need judicial reform this is so evident by looking at some current cases as they take eons of time to settle down. But at the same time I don't feel there is a need to defame someone. He has lost cases one by one. It's unjust to say they are wrong when you lost the case. And keep mum when they give verdict in your favor.. If you have any evidences indicating that their position is compromised. Just put it in publicly. That's it..

    Appointment of Judges in High Courts and Supreme Court should be limited to One Year only. And should not allow them to make ego clashes in between the Advocates and other Constitutional functionaries. I support Mr. Prashant Bhutan. What he has done is the real facts only. Most of the present Judgments from the Supreme courts are not on the basis of Natural Justice or on Law. It can be seen in Ayodhya Case. Demolishing of Flats in Kerala. Here in Kerala the most sufferers are the common people who spent their hard earned money for dream Houses. what was really gained out of this demolition process. The Court should have punished the actual conspirators and put them in Jail for life time. Decisions must not only be fair and it seemed to be fair also. We afraid the lack of applying Judicial mind in most of the present apex Court Decisions. Very shameful .

      For eg. after George Floyd's incident, the American democratic index will decrease, but America is democratic. So that is not a major issue.

    Critisism of a Judgement is not wrong, even every person has the right to critise the judge, but what Prashant Bhishan did was he had cast aspersions on the whole institution of justice. He has critised the supremen court as a whole levelling really below the belt allegations!! Which is very different from any critisism of any judgement or a judge or any specific instance!

Because in democracy freedom of expression is the highest priority. If judges behave like lords and monarchs, they will have to send many citizens to jail. Defamation is okay because nobody has a right to insult another person.

    Whilst healthy criticism, free speech and agree to disagree are hallmark of a vibrant democracy, attempt to malign and arm twist the judges to apply pressure on them are deplorable. An objective evaluation of a judgment is welcome and very much essential. Personel attacks on judges will erode people’s faith in judiciary and undermine the institution. I agree with Mr. Gupta that the judges need to be magnanimous in accepting criticisms. Also, there is a need to draw a red line of propriety and decency that senior lawyers should not cross. I enjoyed watching this episode and, your unbiased and balanced assessment is laudable.

    It's not about SC or judgement. This PB tried to literally and knowingly tarnish the reputation of Chief Justice of India. This is not small matter and this pb is doing it continuously.
    He need to be punished. Freedom of expression (Art.19) is not absolute and come with certain restrictions.

    What all examples you have cited are criticism of judgment or basic human mistakes but what Prashant Bhushan has been doing is nothing related to judgments. He just questioned the very bases of Judiciary by commenting on last 4 cji or by associating current cji with political party. This has to stop PERIOD

    Many in media and intelligentsia are of the belief that this contempt of court order will create a precedent of sorts. Especially since it's done by the SC. But by targeting the judges rather than the judgement Mr. Bhushan has literally brought it upon himself. And please Mr. Gupta don't disrespect the intelligence of your audience by saying "just because he said something on Twitter..". While prosecuting him will create a precedent, not doing so will do the same. Just like conservatism leads to tyranny liberalism leads to anarchy. To maintain this push and pull balance a slap on the wrist was long due. 😎

Gogoi jab supreme court k bahar protest kr rhe they toh woh adarshwadi aur jab unhone bhushan k khilaf faisla diya woh beimaan. Bobde CJI banne se pehle acche aur bhushan ka case reject kiya woh dogle waah rey bewakoofon Kahan se late ho itna doglapan?

    SG, prasant Bhusan, kapil sibal, rajeev dhavan these guys think they are invincible and get away with all kind of contempt under the self appointed security cover of democracy and constitution. These guys should be in jail. Sg the SC does not issue any contempt notice to any normal citizens. Its these defender of crooks whom the notice is issued. So don't make a big deal.

      Yes all the so-called "liberals" and Left-aligned intellectuals who selectively pick up topics and cause friction must be hauled up and jailed. This include people in the media who have benefited from seven decades of Congress rule - I am talking of real benefits- luxurious bungalows in posh, upper-class localities of Indian cities, money, perks, foreign travel and other deals- and hide their loyalties while selectively raising issues about Courts, judges and the government at the behest of their providers. All of this is done whiled being silent about the Congress-Left corruption and killings that have put Indian democracy in danger- Do you wonder why the "Electronic Voting Machine" (EVM) does not hold any fascination for the Indian media and politicians nowadays?
      All of these traitors, self-serving intellectuals should be jailed- better- hung from the nearest lampost after a trial.

    The Stature of our Supreme Court is so high that it should not be bothered by such issues.It is now a fashion in our country to go after people who do not agree with one's viewpoint.The SC must continue its job of granting justice to the people which it has been doing so well over the years rather than giving cognizance to any petty comments.Its time is too valuable

    Prashant Bhushan thinks that he is above law and last word in wisdom. He cannot rub the courts on the wrong side all the time. He will be put to place by the court, else no one will obey them.

    Prashant Bhushan should propose the name of Chief Justice for Rajya Sabha, that will squash the contempt case.
