  • Following years of judicial misconduct and other serious allegations exposed in an ABC15 investigation, Maricopa County’s top judge has disqualified his entire bench from hearing a post-conviction relief challenge in a first-degree murder case. In an order issued on May 7, Presiding Judge Joseph Welty ruled that the “exceptionally rare” and “unprecedented” circumstances surrounding former judge Erin Otis required him to re-assign the case to a judge from another county.

    What is the underlying justification for "supporting/defending" this Judge/Attorney?
    If this woman is disbarred for example, for misconduct.... well every case she has EVER touched is subject to basically automatic reversal, and most likely dismissal...
    Imagine how many cases and lawsuits that will be affected and subsequently filed... ya, that's an economy sized can of Oh Crap.

    It would probably horrify us to really know what they’re doing on the bench while people’s lives hang in the balance and I’m sure there’s more than a couple, or handful, of culprits. These are just the ones caught.

    State Bar’s additional review means State Bar lets just sweep the complaints under the rug. And deny any wrongdoing by all or just a few members of the judiciary in the county.

    Dave Biscobing, it might be interesting to get some comments from a few of the judge and attorney members of the Arizona Thurgood Marshall American Inn of Court and the Phoenix Horace Rumpole Inn of Court, these self interest groups talk a high game on justice system ethics so canvassing a few might be illuminating and since no case is extant they can't use the standard demurral of 'before the courts' just yet.

    Until people start paying close attention to the judges who appear on ballots, this won't change. Do at the very least a Google search on each one before voting to continue their appointment.
    Voting requires thought these days. You can't just vote along party lines anymore.

    I'm not saying there wasn't misconduct, I had only a single brief experience, but would just like to mention that I was a juror in a case that Judge Otis presided over a few years ago, and several of us commented on how notably fair and professionally she and the other officers handled the proceedings.

    How is telling someone to apply to a job or telling them about openings they are qualified for misconduct? That is a stretch and it isn't improper at all. Some of these issues are manufactured and are more subjective than objective. While I think she did do wrong as a judge, there is no reason she can not move to another job and go through the hiring process like everyone else. If being human to a dirt bag who murdered an innocent is "flirting" then you truly are fishing. This Dave guy has even made stuff up in his stories and lied about stuff before to get views, I do not buy into all of this and it is clear what is being said does not line up with the facts. Plus if an investigation does not go your way and the facts do not support your allegations, you are just going to continue to lie and cry? The commission has made its decision and you have no real evidence to prove that the outcome was wrong other than a bruised ego.
