@chris williams The church forbids priests to marry solely because in the old days, when a father would leave his land to his son when he died, many priests were donating church property; and, the church didn't like that!

I briefly worked for a construction contractor after high school. He was irritated that the contract he'd gotten penalized him $10,000 for each day he was late in meeting the deadline. I glanced at the contract and saw there was another clause right after the penalty clause he was stressing over. This one said he would be awarded a bonus of $10,000 for every day he delivered prior to the contract's due date. So he hired an extra team and finished the project 10 days in advance.
He gave me 10% of that bonus as a finder's fee.

Contracts should always be treated as if the other party is the offspring of The Devil and a Fair Folk. ALWAYS assume it's sinister and never assume it hasn't been messed with if it left your sight or changed in the slightest.

    • @CastroyPlaysFuncraft

Contracts are like an agreement. The reason you can change them like that is because it's like negotiating your conditions. Reworking a contract is the equivalent of saying No, but I will under these conditions.
For example, say you want to buy a dog from a friend and offered $200, that's your initial offer, they then say no, I'll do $300. That then becomes the new contract. However, if you then you say, how about $100 and I'll pay for it's shots and your friend agrees, those are the agreed upon conditions of the verbal contract.
You can do the same with written contracts, and as long as the other party is aware of changes, it's enforceable. So when your friend wrote the no layoffs clause, and told them he made some changes, upon not turning it down and failing to read it, they just accepted the conditions as written. Since they agreed to those terms they are now obliged to uphold them.

when I was a student i had a huge fight with my step father and decided to move out. I booked a viewing of a flat in student accommodation and hurriedly signed paperwork, it offered 6 month contracts and 12 month ones too, the longer the contract was the cheaper the rates were. The flat was tiny, like 5mx6m including a toilet with a shared living room and kitchen, 4 people shared. The contract had a clause where you could cancel within 24 hours if you wanted otherwise you were stuck for 6-12 months. I looked into the paperwork and calculated how much this move would cost me. It would have worked out £800 a month for a miniscule little pod with slovenly flatmates as the common areas were an absolute mess. I cancelled the contract with 3 hours to spare. I feel like I dodged a bullet lol

when it came time to move on, my demands became increasingly silly until they said "we no longer wish to work with you, also, because you're leaving you owe us $500"
to which i countered "i just read the contract again 5 mins ago, that clause only triggers if i quit, there is no clause if you no longer wish to work with me"
they tried to say "its in the spirit of the contract, so its covered if you quit too".

I was going for a car loan, they told me I qualified. I was told it was a standard contract. Well, we'll I got my stronger readers. I read every word at least 3 times. I found that the 5% interest went from that to 264.9%. I said" Is this a typo or the life of the loan?" I got a calculator out and started doing math. I have them jump up and grab the contract say it was an error. Then, they came out, with the correct with the right interest, but late fees etc went way up the other cost went up from like phone pay went from $3.95 and up to 19.95. I left and bought a nicer leftover with a credit union loan cheaper and at a lower rate.
Oh I called the Sheriff's Office, they sent in a undercover team a few times different people. Then with an iron clad case arrested the lot and the place went out of business. The owner got fraud convictions and was told he had to serve them consecutively. This was back around 2000 - 2002

My parents said that it was a good certificate when they read it but I looked up testimonial phrases and the result was extremely bad. I didn't know why my certificate would be so bad because I had a great time at my internship, my boss always telling me that I was doing a good job. But I also knew that I had the right to have my certificate changed if my boss smuggled bad things into it so I went to my boss and asked about it. Turned out my boss was really inexperienced at writing internship certificates. I got every phrase changed I wanted and received my much better internship certificate shortly afterwards.

Mine was more of a positive spin on this, though we did get a tad annoyed at one point. My fiancé and I bought a house a couple months ago, and one of the pages had a list titled "items passing with property", which consisted of essentially all the furniture in the house at the viewing. We weren't sure what that meant, so we asked the real estate agent, he didn't know; asked our conveyancer, she didn't know either but she called the seller's conveyancer and found out from them: we got to keep all that furniture, it was included in the price of the house. Sweet, no problem, deal done, right? The annoying part came when we got the call saying the seller had agreed to our offer, and that they wanted to know if we would like to buy any of the furniture in the house? We pointed to the contract and said that's our furniture, you already sold it to us. They looked at the contract again and agreed, THEN ASKED IF WE WANTED THEM TO MOVE ANY OF IT FOR US. Like no thanks, we can move our own furniture, your offer to move OUR furniture FOR US just came across as an attempt to get permission to take it. We're not unreasonable, if they'd come to us and said "hey, we didn't mean to include all that furniture in the contract, would we be able to get some of it back?" we probably would have been willing to come to some sort of compromise, maybe keeping just the table and giving them everything else. But no, they picked a route that came across like a dirty trick instead, so we kept most of it, gave a couple things away and tossed the last bit. This is why you read everything you sign before you sign it, even if you're the one who had it drawn up in the first place!

First they tried to tell her it was advertisment, it was not, then they tried to tell her it was the terms and conditions, it was not of course and she had picture of the terms conditions which she then had me look through and read to the person as well absolutely nothing about it in there. Signing a contract when voluntarily giving your time is a standard practice. If there was no contract there is nothing saying you were accepting a job without pay and could be argued in court. Also depending on the job you may have laws you have to follow (like HIPAA) and without a contract there is no proof the employee/volunteer was made aware and that can go REALLY bad for the employer. A contract is supposed to protect both parties from legal issues.

@@werefrogofassyria6609 you didn't pay attention to the second half of my comment. Just because there is no consideration doesn't mean you don't have to abide by the contract you sign. If you volunteer in a research program and sign an NDA you are still legally bound. It's the same concept. If they are smart any big company would be sure to have ALL employees, volunteers, students, etc sign a contract that lays ground rules for working with them. It's common practice and lack of payment (consideration) does not just automatically make the contract void. If that was the case a whole lot of businesses would go under without people honoring NDAs (which are legally binding contracts)...

He tried applying for the second airline, which had a questionable safety record, and lo and behold, when he went for the application, there was written on a Blackboard the 10 mottos of the company. The first one wrote "NOTHING is above profit". Seeing that on a major airline was baffling enough, so my dad quit on the spot. November 5, 2020 I was to have major back surgery to install steel rods half way up my lower spine on both sides to allow me to walk again more than 50 feet. I was at Largo Medical and Surgery Center in Largo Florida. During check in they handed me an apple work pad with a prewritten contract on it for check in and just told me to electronically sign. I asked what it was and was told it was so they could operate on me in the morning and "was just the standard stuff everyone signs" I told them I would read it first. (I used to work in a law office there nothing that is just the standard contract you just sign. On the 5th paragraph it said I agreed to allow them to "USE ANY NON FDA APPROVED DRUGS OR OUTSIDE MIXED COMPOUNDS" and on Paragraph 7 it said that"AGREE TO ALLOW THE SURGERY TO BE FILMED AND USED AS THEY SAW FIT"....yea right. When I refused to sign because they would not be allowed to use wither of those paragraphs I was informed I would have to leave then! That the contract was written by their lawyers and that is the standard contract that they use in all 62 hospitals. I asked for a hard copy so I could line out the paragraphs I would not allow to happen and they told me they could only have me sign electronically. BS I then asked for a hard copy to have MY LAWYER REVIEW IT. After spending 45 minutes with "supervisors" I finally got a paper copy and was again told to leave since I refused to sign their computer copy and I would not be operated on...WHAT WOULD YOU HAVE DONE? How many people read contracts be it from a doctor, or a car purchase? You would be very interested in seeing what is in them, most people with a lick of sense would never sign. Other just go along and figure that it is OK otherwise why would they want you to sign...here is why ...they have written the contracts to protect themselves NOT YOU

Like every other year they did, they sent the same design for parts to be manufactured, quantity was always the same, but they worried about price changes, as minor services here and there can change over years.
Like every year they sent over a contract for the batch for security reasons.
Attached to the contract were the designs the contract was talking about, something caught my eye, the design was very slightly different.
If I would not have noticed it, the whole manufactured batch would have been thrown out as you couldn't undo a few of the steps in that production, and the small company would have been in the red by a very large sum.
We ended up arguing about this difference and why we weren't notified beforehand, and why the pricing doesn't fit anymore.

That being said, the bit about letting law enforcement enter your home sounds like a bit much.
It’s good when shelters keep their adopted pets on the radar to see how they’re doing, though. I think it would be irresponsible to do otherwise.

There is an animal shelter in my town that is constantly whining about how they can't adopt out any cats... It's because they expect your house to meet rediculous standards that nobody's house meets...
it can't be near a busy street even if you don't plan on ever letting your cat out...
all your windows have to have screens even if you never open them,

Something neat I looked up referring to contracts and crossing parts out before signing.
What you have been presented with is an offer; by signing it unamended you accept the other party's offer and create a legally binding contract.
If you amend it and sign it you have made a counter-offer that is now open for the other party to accept. There is no contract until they do.
    Two points to remember:
Making a counter-offer ends the original offer: it is no longer open to you to accept the original offer.
Offers may be accepted by actions: if you make a (counter-)offer and the other party acts like they have accepted it (e.g. by doing the things the contract would require of them) then it is likely that the offer has been accepted and a contract formed. Many disputes lie along this path

But this fall I was looking into renting my first apartment. Emailing people on craigslist snd getting discouraged about how many people never answered. But one day a guy responds back. His place is in a premiere spot in the town I want, within my budget and requirements for apartment size. He replies back the next day, “give me your contact info so we can work out the lease” and all. He and his wife are on vacation or something and can’t meet in person. But when I reread the email he sent, I realized he was asking me to send him a check for $1300 “in order to get the key to the apartment”. He even had the audacity to tell me he was trusting me with the apartment. I realized it was a pretty bad idea to pay someone before I even saw the place and just never replied.

The moment I didn't: I was selling a house on land deed contract, 5 year contract. Was told by realtor over the timeframe, I'd essentially break even. He had the monthly amount they'd pay, and said plus they'd pay taxes and insurance separate. This was all of our verbal understanding. We had an amortization table and everything, so that at the end of 5 years, they'd get a mortgage on the property and mine would be paid off. We sat down with attorney, just said "anyone have questions, we all understand how this goes". "Yep, OK". They showed me page 5 which had a paragraph stating the buyers are to pay separate the taxes and insurance over 5 years. However, the third line of the contract that had the amount per month they were to pay stated all was included. I didn't notice this. Lawyer told me I was screwed and he felt bad but since that sentence is toward the beginning and more specific (idk how it was more specific since an entire paragraph was in agreement with me) that the judge would probably toss it out. By the time they got to finance the home in their name and my mortgage was to get paid off, I had to pay 38,000 out of pocket to cover the difference between what they owed and what I owed on my mortgage. I did it but was so mad about it. I was lied to and screwed. And they got a cheap house.
BTW it was my fault that I didn't notice, however, I was taken advantage of because this was the result of a sudden divorce and I was extremely stressed and not at all in the right headspace, so I wasn't thinking clearly; the realtor was able to take advantage of that and press me into the agreement. In hindsight, I should have just rented it out for a few years and sold and I would have probably made 50 grand on the property.

The training cost thing can be reasonable if you get a qualification that is worth something elsewhere too. For instance, I'm about to start Air Traffic Controller training with my nation's state monopoly of civilian aeronautical navigation services. Should I survive the training I will be awarded a Diploma of Aviation (Air Traffic Control). I will then owe them ~US$55K in my nation's currency that falls incrementally to $0 after 5 years (at least I think it's 5, can't be bothered digging through my contract to check) should I leave prior to the 5 year mark. This is to prevent me finishing training and then immediately getting a better paying job in the UAE with minimal retraining. My training is capital and labour intensive and I would be able to make use of it with a foreign employer so I don't mind owing them for the training.
However, if you're not getting at least a nationally recognised Diploma, that's BS.

When I get to a part that I don't understand due to excessive legalese, I simply ask the lawyer who wrote it up what it means in English. I cross out the legalese stuff with the red pen & on the post it note write what s/he told me it means. I attach the post it to either that part of the contract, or somehow refer to said part in said post it notes when I attach them to the end of the contract. I do this for EVERY SINGLE THING I don't understand. If things are on the up & up, they should have zero issue after all.

Walked out the door, while they're trying to tell me I won't be able to get anyplace else, as they had sent me through the hosing process. Ended up at a regular senior apartment that much nicer and less that 1/3 my income. Fortunately I had got on their waiting list 2 years before. The assisted living only had a 3 month wait and too many people dying. It also took numerous phone calls and visits to get my deposit back. Originally I had to move, as Bank America stole my house. I talked with an attorney and he wouldn't handle my case, as I didn't have the money. But the had just saved the houses of 15 families in Missouri. It's sad, but honesty is often discouraged in the corporate world these days because it can cut into profits, and if something goes wrong rather than owning up they're faster to point a finger at someone else than a pack of dogs will dive on a toppled buffet table. For some strange reason having staff that possess a strong personality of honesty, morality, and dignity seems to absolutely terrify the people in charge. This is befuddling since if customers KNOW that a business and the ones that work for it can be trusted they will often (as was the case with you) go out of their way to shop with them instead of someone that has a place right down the road.

I'm a freelance writer. Client sent me their 'standard' terms to sign. Several pages of legal speak. Buried way down in there was a section giving them the right to identify me as the author of anything, now and forever, no matter if I had written it, no matter if they had paid me anything for it. I politely pointed out that hiring me to write 5 SEO blog posts does not equate to the right to use my identity in perpetuity and they actually agreed and said they had just sent me whatever their legal team had given them, without reading it first. No idea if that's true but they crossed out that section and we had a long and happy working relationship.

Warning: Make sure you check EACH copy of a contract. Don't get stung by the Three-Contract Monty. Three-contract Monty is where the top copy of a contract has all of the correct information so you sign it and the two or three "copies" below it on the clipboard. Turns out later that the the "copies" had different terms.
Embassy Suites got me years ago like this for meals on a conference I hosted. I checked the contract, signed it, and then was hit the day of the conference with over a thousand dollars in extra meal costs. I KNEW the contract I signed included the full cost of the meals, yet, upon inspection, my "copy" of the contract did not. I couldn't figure it out at first, and then a few months later it hit me: The contracts below the top one were different and I had been had. Embassy Suites never got my business again.
The key is the clipboard, or some other method of concealing the changed-up contracts. Check and recheck everything. Also, if they don't have you initial each specific key term, be suspicious.

My brother is a successful high level salesman. He sold a software program to a company for like $1 million. Gets a check from their legal dept. for like $400K. On the back, in tiny lettering, was an agreement that cashing that check agreed that it was for payment in full. He took it to his accounting dept. & said, "Whatever you do, DON'T cash this check!"

Ohh Ive a good one.... we almost bought an apartment in France. It was a new build. It turned out we wernt buin direct form the developer it was being fliped. The agency had their own translator to help us.
We got a weird vide and refused to sign until we had a night to think about it. We also speak Spanish so we pretended we needed help with that.
In France there is initially a 7 day cooling off period when buying property ( there are several deadlines in fact)
We decided to take the contract to another lawer who took one look and told us RUN !! The way it was written was the apartment wasnt built yet and the owner had paid 50k so far to the developer..... we were going to pay 150k to the owner but only take over the contract meaning we STILL owe the developer the balance owed on the apartment.!!!
Also the 7 day cool off wasnt in the contract as it wasnt a property purchase but a contract purchase.
Man did we have fun absolutely ripping the real estate agent a new one.

2 things that happened with Spectrum:
    1. My bill was increased by $5 way after my promotional period. Called CS and they told me to cancel if I didn't like it. (In my area, they are sadly the best deal)
    2. We got a DMCA temp ban and we called to try to figure out wtf happened. The rep didn't want to do his job and muted his mic and waited for us to hang up. We stayed on the line for 45 minutes, listening to him unmute to see if we were still there despite us talking the whole time. My boyfriend was a supervisor at a call center and knows all the tricks. Rep hung up on us. We called back and got the sweetest woman in the entire world and got an answer immediately. Loved her. She told us that reps do get pinged for call lengths. And that the first red didn't even look up our account so we couldn't report it to Spectrum. But his supervisor at the center will still see it. What a pos. I get it, call centers suck. But just quit dude.

Friend of my father owned one small flat he lived himself for a couple of years and then rented it out and after everything paid he had just like 100€ left per month from the rent.
He sold the flat for 30000€ 2 years ago (he paid back in the 90s like 20k Deutsche Mark DM) so he actually made some money.

My parents once rented a small car in a supermarket event. It included a monthly 40€ coupon for said supermarket. My parents thought the rental price was ok and thought the 40€ coupon on top of that was really good. My 10yo ass read the offer in detail and found out that the base price was the said price plus 40€, so you payed 40€ monthly for a 40€ coupon, that you had to spend in said supermarket. To be fair, my dad has been using that car to get to work every day for nearly 5 years now, so that car was a fair investment. But every time I hear my parents talk about what a bargain that was, I have to remember them about this one

My mom asked me to take a look at her insurance policy, I am not a lawyer, so I don’t know what she expected I would find.
In the end though, what I did find was that her insurance had somehow, for some completely incomprehensible reason, added her ex-husband‘s ex-wife to my mothers insurance policy. 🤦‍♂️
At first they tried to tell her that they could only return the premiums for the last couple years, anything further back was too old. She said that since she was 100% certain that she never gave them permission to add the bitch to her insurance, their options were to present all of her records and give her a refund going back to whenever she was added, or she could talk to an attorney about suing them for defrauding her.
They coughed up the money. 🤣

And, if necessary, hire a lawyer to read and interpret in the case of real estate, cars, and membership, timeshare, etc. Lawyers are expensive so it's often wise to write down what you want from the lawyer and your budget and time limit for the result.

Eh, the reasonable ones usually do OK in court from what I have read: "do not work for a direct rival within the immediate area for a certain period."
The problem is that many NDAs are absolutely ridiculous: "Don't work for anyone in the state/country that has any connection to the field including, but not limited to: materials supply, manufacturing, sales, or maintenance of the product for a period of 20 years." Essentially stating that after working there you have to completely switch professions, or leave the country to get work.
The second type almost always get tossed out in court, while the first are generally upheld.
