Platinum and gold status is based of units sold or equivalent. So it’s 1,000,000 copies sold or the streaming equivalent, not sales in dollar amount. Hope that helps
@@Cocinaughty that’s not accurate. When I said “or the equivalent” I mean in terms of streaming to sales. Roughly (edited) 150 streams is equivalent to 1 unit sold. Platinum is 1 million units sold. Each platform pays out a percentage of a penny sometimes 2 Pennies per stream. The number made from a platinum record today is not 1:1 as it used to be. The amount of money the song makes doesn’t matter in regards to the platinum or gold status. Soundscan tracks sale numbers/units and not the quantitative amount (because singles can be purchased at different rates whether it streamed or bought for .99/1.29) the song made monetarily. If the song goes platinum, that means it has amassed an equivalent of 1 million units, not 1 million dollars.
Finding it a lil funny that you emphasize maintaining a solid relationship with OT and his crew, yet use his name in the thumbnail and claim he 'stole' the beat. I have no issue with you wanting Darez to get credited and even paid - but it leaves a bad taste in my mouth the way you handled the title and thumbnail even though you put quotes around the word "stole". Which I guess was the original intention of the song, but the producer who put the drums didn't pay or credit the sample makers
No it’s like giving your homie a peso and saying you free to spend it on anything, but if you’re monetizing it I want a cut. Free beats and copyright isn’t free no strings attached, and that’s stated. This beat happened to be free no strings attached as it was royalty free, but they usually aren’t.

If it’s a free sample kit, you already got paid. That’s the way the law perceives this situation. You placed that loop in a kit that was labeled as free. Meaning royalty free. It was also on a website designed to provide free sounds/kits for production. Meaning he does not have to pay you for that beat. I would have told you to take me to court so legally you could be told the same. You had no expectation of payment upon placing that kit on a site as a free kit! You can’t expect one now when there was no paperwork stating that deal. This works the same as if there was a contract. If you accept 5K upfront and 3-5 points on the backend, that’s what you get! Only way to alter said deal is contract renegotiation. The only difference in the two processes is you can’t renegotiate what was already given out as free! Free means free! No matter what!

Yeah as the comment above mentioned, you just need to give credit. The pack was released as royalty free so they didn't need to lose any money on it anyways. Depending on the license, even credit may not be required, but that's just human decency to credit the right people. What happened in the video was understandable since the person who made the full beat probably didn't disclose that it wasn't his own sample, and they ended up clearing the misunderstanding anyways. This video itself is misleading though, they should have started the video saying that the music was royalty free. Way too much drama for nothing.

it’s all about principle, paid for or free. you are still not the original creator of the piece, you are not the owner. the goal is to be transparent and give everyone credit and respect they deserve for their work on the record. it’s complex it’s not simple
Does no one know about how free for personal use is different from business use? Like if you use windows 11 for a pc at home it’s one thing, but if you take the same copy of windows 11 and install it on a shitload of office computers it’s illegal? Plus it seems more like he just wants there to be credit for his friend.
The producer and the beat need accredited, no matter free or not. It can be used in anything, but if it isn't credited properly, then the other "producer" could say it's his own original beat even tho it wasn't. It's just not right.
There doesn't necessarily need to be a payment made either, but most labels in good faith will give the original "producer" a decent cut as well as their name on the track.
What are you talking about? The Johnny Dang track was just a fluke, could have just easily happened on a non-royalty free loop but it didn't. Producers have to put free shit out there sometimes. It's necessary promotion for their brand, and enables up and coming producers to experiment with pre-existing samples or loops. Nothing at all wrong with manipulating some MIDI notes to build your own song. The guy who created them didn't even notice it was his music!! Maybe that's because these guys create thousands of different sounds. They don't always know how "good" something is that they're making, so it's completely their responsibility to copyright certain things or choose to give them away.
Did you watch the video? They didn't get paid. Better business model: enjoy the process of creating music, get good at creating music, be a cool person, make connections to other cool, music creating people, create music. There's a one in a millions chance someone picks up your music and you'll make some real money from it.
@@reallyeffingcooltechnodudeOf course I watched the whole video. In the end, he’ll get a Plaque to recognize his contribution to the song. I took more offense to the title “stole”. OT didn’t steal anything. Another producer used it form a “FREE” pack and OT got it from him. If OT never picked it up, never would’ve seen the light of day. As Nas would say, they made it a hot loop, OT made it a damn hit! Not to discredit the creator but this likely took him less than an hour to make. It takes hours to lay down the verses, structure the beat around the lyrics and many more hours to mix and master the song. Now you make the video and promote the song. It was a hit with or without that beat. OT and Paul Wall have turned many instrumentals into HITS. To the credit of this channel and the producer of the track, they, as you mentioned, created a lifetime connection. Networking is key in this industry. OT made his track a hit and now he’ll get the recognition he deserves and hopefully will now have a way to support his family in a career I imagine he loves.
So lie about and tarnish the reputation of the artist to get people to watch you? That’s what the law will call libel. I know why he did it. @@OliveVeyah If your "works" is sampled, you do. His producer pack, which was full of loops/samples for others TO USE, is not covered by the copyright. For example, for every song (they often use hundreds of samples to make a single song), you'd have to list the entire creative team for each sample as "writers" or "producers", and they'd all get compensation. "Samples" aren't just loops sampled from songs, every audio clip is a sample, and most of them aren't recorded by the producers - they are bought/downloaded for free. He released that pack for free, for use. He has no claim to it, the same way he doesn't cite every sample source from every song he puts out - he doesn't pay every sample creator either.

Bro, as an IP lawyer you should also know that royalty-free does allow for a person to use a copyrighted work without paying licensing fees but it doesn't exclude moral rights, i.e. being credit. Yeah he may not get paid, but there were certainly claims to be made.
Unless the loops are marked as royalty free by the owner of the loops you must seek clearance, you can’t just use a loops and sell the masters to the loop without permission.
Free beat packs are often intended for non-profit use, such as for practicing or recording before making an investment. They may not be able to be distributed, performed, radio streamed, or monetized in any way. If you want to use a beat for commercial purposes, you may need to purchase a license from the producer.
the main goal was being credited. a platinum record that has it's main melody being your creative content without any hint of credit toward you is a pretty big deal.

this is legendary in its self 20 years from now when ppl mention this song they will tell the story of how this beat was created and how the stars aligned for a reason the universe and destiny are crazy
This isn't subject to any copyright claims, in my semi-educated opinion - I went to music college for audio engineering and music production, and took a few semesters of music/copyright law classes. Now, that doesn't make me a lawyer, but I have more than just an online search. If they sampled your song, or cut a loop out of published releases, that would be one thing. But he released a free sample/loop producer pack to the public - it is for public use. That is literally what the purpose of the pack being released was - to have other producers use it. In this case, I think it would be the same thing as you buying samples/loops, he just did it for free (self promotion). This is almost like a form of entrapment. I'd bet that if this went to court, Kyle would lose. EDIT: He released it as, free, and many are saying "royalty free." Now I've found a section in the website terms (listed nowhere near the purchase or product provided) that specifically lists "Royalty free is applicable only to songs under 5,000,000 streams, anything above 5,000,000 streams must be cleared with original creator." So basically, they wrote in a clause/exception for "Royalty Free" so that they could list it as royalty free but still make money/get credit for it if it was successful. Under 5 Mill streams wouldn't profit much. I'd argue that is false advertising, if nothing else. I'm unsure of precedents but I think it is fairly inaccessible and misleading.
the packs come with terms and conditions. he didnt even get credited for the beat at all. one could assume the producer made it himself, not even from a pack. i dont even think it would have been that big of a deal if he simply credited him.
When you get the beat it's free as long as you don't use it to make profit. If you want to use it for commercial release you need to buy or lease the beat. I'm a producer too
You can't use it for COMMERCIAL use. Using it to make a track, and sing in the bar or something is one thing. There are terms you agree to. Kyle would win most likely due to that fact it was commercially made.

That's what you call "double dipping". Selling royalty free kits for money to producers but if they strike gold and get a decent placement you want a piece of that too. You can't have it both ways. If yall knew the producer was gonna get a placement guarantee you would have never charged him for the so called royalty free kit
Free for non commercial use. That's very standard for anything loops or beats. For example if you search type bests, they are all advertised as free without commercial use, so if you used that beat and it blew up and made money, it would no longer qualify for free usage and you'd have to pay up. Same way if you use that beat in a TH-cam video and that blew up, you'd owe money even though it's labeled as "free". Every producer, artist, etc knows this.

The streaming equivalent meaning that the amount of streams would have to garner 1 million dollars

Nothing at all wrong with manipulating some MIDI notes to build your own song. The guy who created them didn't even notice it was his music!! Tbh I’m tired of liars on the internet 😂‼️ it’s ridiculous
Boss man is highly used by a lot of people
@@tristc6909 i hear a lot of “ Boss “ living here in the UK, in the US its more like “ Fam , dude , boss , man “ but never “ Boss man “
let alone 2 random person who have nothing connected to say it back 2 back

Lmfao no way you don't reveal the loop was royalty free till the end, painted the producers in a bad light the whole video
This felt like a net flix special much less a youtube video. The production the editing the way you telling these stories now are so dope and clean. As entertaining as this was i also felt it was a good lesrning experience. Kinda gives you an idea on how to handle yourself in these type of situations. Not everything always has to be about securing the bag. Sometimes building new relationships can be much more valuable in the long run.
Well done kyle, handled this with class. Much respect and congrats to darez on becoming a plat producer!
Lol get his dxcx out yo mouth
"Free Pack" "want to get my friend paid because it's his pack" "I want my name on the credits too and we need to be paid"..... smh
There are rules to royalty free music.
@@mattk8810 there literally aren't. No one gets credited on a sample pack and royalty free means "we can't request any money from you".
Honestly shoutout to OTs team for even responding. Most new cats would ignore that shiz and block them. Then in most cases the new producer doesn’t have the resources to sue to get his cut.
Facts
OT seems like an understandable guy
well even if he did sue he's not entitled to anything. it was a royalty free pack, I could use this beat if i wanted and theres nothing he can do about it
@@ang_nguyn 💯
Brandon OT really impressed me from the get-go. Very professional and very good attitude. Thanks for putting out this video, definitely helps give us more insight into how to approach such issues. Thanks Kyle
So a royalty free sample… that a producer used as intended. How is that anyone’s fault🤣
u still need to credit the og producer
@@mveepb You don't. He released the product for public use. There is no chance at a copyright claim. He'd lose the legal battle.
@@SAwesome2 you do :3
@@OliveVeyahwas that what it said in the terms for use, if it wasnt then yh he doesnt actually have to credit
Who else was thinking, “He can’t just show that beautiful baby at the beginning and end it there….WE NEED TO SEE THE BABY AGAIN!” Thank you for the multiple shots with your precious miracle 🙏🏼 and congratulations 🥳🥳🥳
As a lawyer who dabbles in IPR, it would have taken about 2 minutes to figure out there was 0 claim here 😅
Thank you
He told us there was no claim in the first minute lol Then spent the next 20 showing us him extorting him.
Bro, as an IP lawyer you should also know that royalty-free does allow for a person to use a copyrighted work without paying licensing fees but it doesn't exclude moral rights, i.e. being credit. Yeah he may not get paid, but there were certainly claims to be made.
Literally anyone can say they're an "IP lawyer" in TH-cam comments lol. This doesn't make your shitty opinion worth anything more
@@nopersona000 correct, hence the need for 2 minutes to review the license terms that waive moral rights.
Free or not the producer deserves credit!!
depends on the license the "free pack" is released with
Majority of producers never get credit so what’s the issue
@@OfficialMoneyGordoyou don't think that's an issue..?
@@OfficialMoneyGordojust cuz it always happens doesn’t make it right, so that’s exactly what the issue is.
@@DarkNinja-bf6hkit is an issue that’s why I try my best to give credits where it’s due
I don’t understand how you put out a sample for free use then try to get paid when someone uses it
The loops are free to download but does not mean you own the loops.
Bro first u gotta give credit and its not free for distribution u still gotta pay for royalties
the main goal was being credited. a platinum record that has it's main melody being your creative content without any hint of credit toward you is a pretty big deal.
I can’t believe that I watched a 20 min ad
You had your lawyers ready just in case it got messy???? You said that shit was FREE!!!

Read the law pedro.
Yeah free for non-commercial use dummy.
It’s not free ANYMORE CAUSE THAT LOOP MADE A SONG PLATINUM
@@outsomnia You mean the same law that shows that Royalty Free copyright status means that you as the customer do not need to credit or pay royalties? Those same laws? That he himself said he applied his works under? Crazy. Its almost as if he is just upset he didn't get paid for work he didn't even do.
That's solid. All people involved are just awesome people making good music. Hell yeah
I swear music industry is endless copyright drama at this point, man, glad you managed to resolve this whole thing
this is legendary in its self 20 years from now when ppl mention this song they will tell the story of how this beat was created and how the stars aligned for a reason the universe and destiny are crazy
EDIT: He released it as, free, and many are saying "royalty free." Now I've found a section in the website terms (listed nowhere near the purchase or product provided) that specifically lists
"Royalty free is applicable only to songs under 5,000,000 streams, anything above 5,000,000 streams must be cleared with original creator."
So basically, they wrote in a clause/exception for "Royalty Free" so that they could list it as royalty free but still make money/get credit for it if it was successful. Under 5 Mill streams wouldn't profit much. I'd argue that is false advertising, if nothing else. I'm unsure of precedents but I think it is fairly inaccessible and misleading.
Yep. Entrapment for sure. I would change the title to this video though.
the packs come with terms and conditions. he didnt even get credited for the beat at all. one could assume the producer made it himself, not even from a pack. i dont even think it would have been that big of a deal if he simply credited him.
@@luigifan322 once you slap a free to use to something, don’t expect anything in return. It’s the basis for FREE!

If yall knew the producer was gonna get a placement guarantee you would have never charged him for the so called royalty free kit
so you released a FREE DRUM KIT and someone used it and it blew up & so now... "ITS STOLEN!". crazy despicable work
Yeah. It’s pretty slimy when he said, let me call my “lawyers”.
@@imonaroll9502 Just shows how much you don't know about law, let alone music industry.
free kits are not for commercial use you agree to it when you download it
Free for non commercial use.

After watching the video the word 'stole' just pisses me off in the title . Mexican OT looks and seems like a very humble person from all the interviews ive seen him on and thats just trying to burn his name.
He but air quotes on the word stole bro. That clearly means it's debatable. Nobody is hurting anyone's name. Both sides are good people.
Was confused the whole time bc said it was free from beginning so... Title was click bait.. USED* not stolen
You really should take the word ( Stole ) out of the video title. No one actually stole your song. They used a loop you created and the created there own rendition. But know one stole anything from you my guy.

They slowed it down n just put some drums on it. I’d understand if they sampled a bit of that loop to make a song……..but the whole track is the fucking loop, that’s blatant plagiarism and stealing, no credit was given to the creator. Like cmon dude
@@y3llowpersuasionz18 it's not sealing. They purchased a royalty free loop to be used as you please. Explain to me how that was theft. You can't be involved in the music game if you didn't know that. Secondly he even said it was a royalty free loop in the video.

Releasing the sample as royalty free, then trying to hit them up for money and implying that they did something wrong is pretty scummy.
It is kinda scummy to take someone’s work and not even credit them
Not when no one was credited and the requirements to use the loop are not being followed
you need to read the fine print in the tos on the site (section 5 to be specific). It's royalty free until you hit a certain amount of streams or purchases (of course you would never know if you meet that criteria until it happens so ig if you wanna save legwork and avoid being accused of stealing after the fact assume this guys loops are not royalty free.
