He was already in Brawl, they just didn't make him a full character because he wouldn't have enough variety in moves to make it worth it. Instead, he was one of those support characters you get from that one item that's like a pokeball for everything but pokemon. xD
I would've loved to see a reference to the original mario referee. Maybe DK would get a little up close and personal during one of the pre-round animations and the ref would call him out and pull out mario's hat. Then watch as DK would quietly return to his corner.
