    Pleadings are not statutes and legalism is not verbalism. Common sense should not be kept in cold storage when pleadings are construed.

    Sir Wants to know if Hon'ble Bench directed both parties to submit written Arguments along with relevant documents to petitioner on 23/07/2019 date of hearing and on next date of Hearing the bench has changed respondent contrary instead of providing the relevant documents which along directed to file written arguments after Sep 2019 and nov 2019 date of hearing .Moreover on 14 Feb 2020 written arguments has been filed by petitioner without receiving the relevant documents as directed by Hon ble bench on July 2019 order Contrary till today June 2022 respondent did not filed written arguments . Sir can you plz share is their any course of action you want to advice for petitioner

      Sir, will it mean “ in the same capacity “ ( this finds a place in Sec 11 CPC - res judicata ) ?
      That’s if one litigates in his personal capacity, he has to file counter claim also in the same status as individual, not as a manager, Kartha or managing trustee , etc.,
