    The one that comes to mind is the one in FL where the guy's house got foreclosed on erroneously. Sued the bank, won, they didn't pay, got the bailiff to go seize stuff, and ended up with control over their HQ temporarily or something like that before they finally paid him what was owed.

    Imagine being on a plane that's all loaded up ready to go, and you hear an announcement: "I'm sorry, but we're going to have to cancel this flight because the aircraft has been seized by a bailiff."

    In Texas, a major oil company failed to pay their property tax on a processing plant for three years. A man paid the back taxes and became the legal owner of a multi billion dollar company. He put a lock on the gate and the security contacted the office. they bought their property back for over half a million in cash and stock. they always made sure the property tax was paid on time and in full after that. The man is reported to have said "thank you" as he got the cashiers check and stock certificate as he removed the locks from the gate.

      To the best of my knowledge, the concept of acquiring property by paying the back taxes is a uniquely US invention.

      ​@@thomasrogers8239England doesn't have property taxes, never has, not in the way the US has them. So it can't come from UK common law.
      The UK has a seperate system but paying someone else's council tax gives you no rights at all (the council may even refuse payment as your name is not on the account). Failure to pay your council tax in the UK also will not result in your home been repossessed without first going through about 30 steps before it (including likely sending you to prison, its actually a crime not to pay, one of only the few debt related crimes still on the books in the UK).

      "If you don't pay the delinquent amount, your home will be sold at a public auction to the highest bidder. The minimum bid must be at least the lesser of:

      (...)The winning bidder (or the county) then gets a deed (title) to your home, subject to the right of redemption."
      If no one else bid, the guy basically paid the back taxes and legally owned the business.

    My family got bumped from a connecting flight due to overbooking. The airline tried to appease us with a voucher for a future flight. Fortunately, I did a little research and got the compensation lawfully due, in cash and on the spot. It was several times the amount of the voucher being offered and practically paid for the trip.

      They are lawfully allowed to give you a voucher, or less - if that's what you accept. They are NOT required to give you anything more, unless you don't accept it.

Is it the lowest price in the last 90 days? Is it the price of the *very* coincidental flash sale that was just active for 60 seconds at the moment you were bumped?

    I was taking a shot every time Steve said "Wizz Air" but I died of alcohol poisoning at around 3:45 -- luckily my tickets to heaven were booked in advance on Wizz Air and the cancelled my fight so I get to stay in this mortal realm.

    This happened with either Wells Fargo or BOA. They wrongly foreclosed on a guy's house. He didn't even have a mortgage let alone through them. He won a large judgement and they refused to pay. So he got an order, went to a branch with law enforcement, and threatened to seize everything. They had no choice but to pay.

      This is the thing that worries me right now. Wells Fargo acquired my mortgage several years ago. I have 5 years left on my mortgage, and have never missed a payment, yet I am terrified they will pull a stunt like this on me once my mortgage is paid off. This is also the reason I pay by check, so that i have a paper trail of every payment in addition to bank records, in case they try to pull the old "we never received the payment" bull-crap.

    My sister once got a judgement that they did not pay, a sheriff went to their retail location with the judgement, not enough in cash register to pay judgement. Sheriff told them to start selling stuff because they also have to pay the sheriff for how long he is there. She said some customers got some great deals.

    This happens fairly often in the UK. They even have a few reality shows about bailiffs and high court enforcement officers collecting on judgements. It seems like once a season an airline is involved, sometimes even large name brand airlines. Plus, over there, if you make them chase you that added expense keeps on getting added on. One $1500 debt ended up costing over $4500. If they have to seize goods, or even bring in transport, that's added on, too.

      I saw one of those and the debtor was Delta Airlines. Delta got shut down at one of the major airports. Nobody was alowed to check in and no flights could move during a rather busy time until they paid. They ended up paying. 😂😂

      I have to wonder...if businesses are refusing to pay, knowing that delaying like that will cost them extra, they must do it for a reason. Perhaps they save more money than they lose because people give up?

    We had one of those locally a few years ago. Once they started loading furniture on trucks outside the secretary found someone who was able to cut a check to make it stop. Apparently the business called the cops and once they talked to someone higher up they were helping load stuff. Somebody notified the local news and it was broadcast on location.

    years ago my wife was rear ended by an uninsured driver. he didn't pay, she went to small claims court and got a judgement and he still never paid. 10-12 years later she gets a call from the guys new bride saying they just got married and are in the process of buying a house but have to clear up the judgement. She asked my wife how much it would take to clear the judgement. My wife told her the full amount plus interest. She ended up with a check for close to 20k, we remodeled the kitchen with the unexpected funds.

      Important point here that people on dashcam channels always miss. Just because someone hasn't gotten insurance doesn't mean they don't have to pay for the damages they caused.

    You can do this in the US as well. Check your local Small Claims Court limits, some are as high as $5-6000. You can sue, win a judgment, and if they don’t pay have the bailiff go to their location to repossess items equal to the value of your judgment. You can hire an attorney for this or if you’re savvy/daring you can do it yourself.

      In my case they didn’t have an attorney show up so I presented my evidence and was given a judgement. They don’t have an attorney show to make it more difficult for you to collect but its also fairly easy to win if you provide evidence.

      The limit is $20,000 in Texas. The fee to go to court is $34 and if you can show you can't afford that, the government may waive it for you. If someone owes you money and you can't afford a lawyer, that's not much of a reason to give up. I may have to do it myself soon.

    I sent the Sheriff out (cost be 50 bucks) to a property to serve a foreclosure notice one day after it was due. The creep was not going to pay me...I had a check the next day , and , it was good. 17K.

      Not necessarily. My parents are both self-employed (architect and accountant), and we once had a flight from Montserrat to Antigua (to get a connecting flight back to the US) cancelled the day of. My mom called a local helicopter sightseeing charter company, and they were able to fly us to Antigua. It was expensive, but my mom knew she'd be able to pressure the airline to reimburse her, and it did require some threats, but she got her money back.

    I almost did something similar when I sued a healthcare company for overbilling and won. They ignored my request for the refund check. I sent them a fax saying I would send the deputies with a writ of execution to seize and sell their computers, to cover both the $1,700 judgment and the collection costs this would incur, and good luck with HIPAA if that happens! They sent me a check by FedEx overnight.

    I was flying years ago from a small town in Canada to Tampa, Fl. and had to go through Toronto, I got to the gate in Toronto, and got bumped from that flight. There was only one flight a day with that airline going to Tampa. The airline refund for that part of the trip, and booked me on that same flight the next day, and said see you tomorrow. I said where am i going to stay, they said you have money, (speaking about the refund) you can get a hotel. I said it was your airline that bumped me, it is up to you to find a place for me. and a few minutes they booked me into a hotel downtown for one night. At least I stood up for my self. and saved over $100.00 in added costs. Even at a young age, I knew my rights.

    Years ago I won a judgement against an individual who then stonewalled paying. So I quietly put a lien against their house and then just forgot about it. One day some years later I received a call from his divorce attorney asking to pay me out as part of dividing their assets. Unfortunately I don't think you can do the same with an airline's jet.

      @@PromptCriticalJello Just seizing a jet so they can't make scheduled flight would 1. probably get you paid in a hell of a hurry, 2. be a delightful bit of irony, and 3. Cost them a small fortune compensating he people whose flight got delayed or cancelled. Unfortunately there's no way a jet is going to be seized when there's all sorts of other property with a value that's vastly closer to the amount of the judgment. There's also the practical matter of who owns the jet. There's probably not a registration in the glove compartment to easily show ownership, and many planes are actually leased (though less likely with a major airline).

      ​@@suedenim9208 In the US, it's easy to look up ownership info on aircraft if you have their tail number. The FAA maintains a public registry of that info. (For curiosity's sake, I have sometimes looked up the owners of helicopters and planes used in movies.)

      Bailiffs can pretty much seize anything and everything so long as it belongs to the company they are seizing from though the plane would be the last thing they try to seize as from an obvious view seizing it will make it hard for them to make money

    I've done the same thing, although the company I sent the bailiffs to had closed down. However, after a delay of several months, once you win judgement (which for that sort of amount you can do at the small claims court), after a month or so you then have to pay a separate fee to send the bailiff round. You then have to wait for several months (as I remember as it was a long time ago), and then you will get a sheet of paper with about 30 reasons why the visit was unsuccessful, and one explanation that they have received goods to the approximate value. Typically it will be one of the reasons why the visit was unsuccessful that is ticked! And if they do actually seize goods, then you have to wait a further delay for them to be auctioned. It's a really slow process.

    There's a show in the UK called "Can't pay, we'll take it away". After a judgement is won in the high court, private bailiffs show up to enforce-immediately-either by payment or seizing goods to cover it. Interesting show covers the operations of a bailiff company. They have episodes on TH-cam.

    Heard a guy interviewed on L.A. radio a few years back. Got a judgement against a bank branch (thought it was Wells Fargo, but won't swear to it). They didn't show up to the hearing and defaulted, just didn't care. He got the judgement and served them, they ignored it. He posted notices he was going to seize assets, they ignored it. Sent Sheriffs to inventory the branch to inventory assets, including computers and office furniture, they still just shrugged and made no effort to pay or even contact him. But, the guy was media savvy, and issued a press release. It went viral and generated tons of bad publicity and laughing. And suddenly the bank was _very_ interested in getting the payment settled. Didn't care until the media covered it. Maybe a couple of similar incidents, since there seems to be some back and forth in the comments about details and what bank. But I heard this story directly from the man involved, in an on-air live interview.

    That is almost impossible to do here in New Zealand. I had a court order and to get the bailiff to seize property and evict a tenant. I had to note the property down, including serial numbers that was to be seized. How the hell could I do that? I went route of hiring a couple of huge gang members and we went around and turfed the guy out. He didn't have enough stuff of value to pay the debt anyway.

      It's usually similar in the USA. Evicting non-paying tenants can be very difficult (laws vary by state), and you got a better chance of seeing God than getting your back rent.

      @@the_mowron my family has done real estate where I am for a long time and have never had a problem getting a tenant out. I mean, there is a specific process that takes time, but it was just a waiting game until you can call the sheriff and they will meet with you while you change the locks.
      However, I know someone in another state where it has gotten very hard. He has got to the point were he just tells them he will give back their full security deposit if they are out in 48 hours and he says he has never had one turn him down and he keeps his promise as its costs less for him than the eviction process.

    I remember WOW Airlines that suddenly died a horrible death, and passengers were stranded in Iceland. Scary thing was I almost booked a flight with them. A lot of these lower tier airlines, seem to get away with murder nowadays. I know the aggravation of delayed and cancelled flights (avoid Philadelphia btw) . People actually book flight schedules for a reason.

      Always avoid Philadelphia airport. The only airport where i have had things stolen out of my tool box. Not only once, but twice. Plus, it's just a bad airport in general.
      And i'd be willing to bet that you were flying US airways. They were infamous for cancelling flights because there were not enough passengers. They didn't care that they were disrupting your entire schedule, they just didn't want to lose a little bit of money on a not very full flight. That's not how it works, i paid for a seat on that flight at that time, not some other flight at a different time.

      Back somewhere in the mid+ oo’s, I bought a helmet for bicycling to work in winter (Canada), shaped and coloured like what you wore (snowboard, Giro, Bad Lieutenant model lol). One time back near home, walking it on a busy sidewalk because traction otherwise, some guy walking past said to his GF “He doesn’t even know.”. But the days of spitting on returning soldiers seems to have passed. Cheers.

    This reminds me of the time a few years ago where the guy had a judgement against a bank, who still didn't pay up, so he did the same thing, showing up at one of the bank branches with a Sherriff ready to start taking office furniture and computers to cover the judgement, lol. It made news for a guy "foreclosing on a bank".

    There was another story about a company not paying up on s judgement in England. It might have been FedEx. The plaintiff then sent the bailiffs in and they started to confiscate office equipment until someone came with a check for the full amount. There they can do that. The corporate lawyers failed to appear causing a summary judgment then balked at the court’s judgment. So the plaintiff had the last laugh.

      But you can also apply to the court to have the judgment set aside if you can provide compelling reasons such as a non serving of the original writ because that is hedged by specific circumstances to make sure that the people against the claim is being made have received it.
      It is hard to do but possible but non attendance is not normally accepted as a reason to withdraw judgment, but Wizz are known to stonewall on CCJ's and have in excess of 400 unsatisfied ones outsanding according to a story run by Tony Hetherington in a Sunday newspaper about 2 weeks back.

    This is actually really funny. I work for a certain type of insurance company - we deal with thousands of claims every week and if you're in the UK, you've 100% seen banners and adverts advertising us. You've probably had one of our theme songs stuck in your head from TV, even.
    Just the other week, the bailiffs turned up at one of our main offices (because one of our agents accidentally lost track of an ongoing claim for such a long time.) It was such an embarrassing event. The bailiff guys didn't take anything - my buddy just went downstairs and cut them a cheque.
    But seriously, this type of thing does happen sometimes. Insurance claim handlers are often just minimum wage, poorly trained slaves to our corporate overlords. Human error and insane workloads and anyone can make a mistake. Hold your insurance accountable, insist you be given a timeline for your claim and chase them whenever that timeline is exceeded. It probably won't hurry things up, but if you show your frustration enough and make a WRITTEN complaint, you will probably receive some sort of compensation at the least.

      I’m currently dealing with a claim on my car. My car was parked at a roadside parking area. It looked like someone with a trailer swiped the entire side. I have comprehensive/collision. Should be an easy claim. It’s been 80 days. $3500 in rental fees. They closed the claim and reopened it. A week ago they said it’s a total loss. Im on 3rd agent. I have no car, no income . Bout to go buy a car. The day of the claim I was going to take my cat to the vet , a snowstorm came through and I didn’t go. I had to turn in a receipt that I actually took my cat to a vet 2 weeks later. Come up with pics of my car prior to accident. Which wasn’t easy to do. I said , we have a contract. The burden on proof this didn’t happen is on you. I turned in verification I was at a business 1/3 mile from where car was hit 15 minutes after I realized it was hit. I’ll try the demand letter route. The insurance commission hasn’t been any help

    Been there done that. One problem I had was to insure the property you want to take is theirs. Many times they can transfer all property to another legal entity to shield their property from collection.

      In the UK, a court could rule that to be intentional fraud. But to avoid all of that bother, sheriffs often seize property at least on paper on their first visit if they can't get immediate payment. That way, no transfer of property is legal since the property belongs to the court until and unless the full payment is received.
      The logic is that if they leave the equipment in place, the business may be able to trade its way out of difficulties and pay the judgement in full, but they need to make sure the equipment can't be transferred to someone else's name while this happens.

    There is also the "Till Tap", when a Bailiff is assigned to stand next to the cash register in a business such as a restaurant or retail store, and collects proceeds before cash payments make it into the till.

    If you enjoy flying but hate the airport rigamarole, I highly recommend calling your local small airport FBO (fixed base operator) and scheduling an introductory flight with a flight instructor. They will handle the takeoff and landing, take you up and have you do some basic maneuvers. I was immediately hooked and am pursuing my private pilot license. It's a fantastic hobby, and there's no TSA agents or airline headaches.

      @@firstname4337 Sure is, it's a pretty expensive hobby. Private pilot will cost around $4000; there are more expensive hobbies but it's certainly not cheap. You can purchase a little Cessna pretty cheap, but even so, the annual maintenance on plane ownership can be pretty brutal, especially the inspections. My instructor recommended fractional ownership or club membership once I pass my checkride as an economical way to build hours and get used to all the costs and maintenance before I decide to buy my own.

    My favorite story goes back to the 80's and has to do with Michelin Tires (French company) who had a judgement against them. The opposing attorney got a writ and had the court constables go down to the company HQ and chain the doors shut. No one could get into the building. The exec's showed up very quickly with a check book and paid the outstanding judgement. One does not simply thumb their nose at the American judicial system the court does have teeth.

    Hi Steve, another Appalling airline BRITISH AIRWAYS. Me and my wife were flying from Antigua to London Gatwick and were denied boarding because BA computer couldn’t generate our boarding passes. We were dumped by BA supervisor with no help with taxis hotels or transit visa which had run out 🤬 we spoke to BA live chat in London a few hours later from our hotel and they said sorry but get BA supervisor to rebook your ticket in the morning but your have to pay again. In the morning we got back to the airport but the BA supervisor refused ! I showed him my message from BA London so he backed down. He then spent 1 hour booking our tickets, I said to him will your computer be able to generate our boarding passes this time , he confirmed yes, but there was no seats for 2 weeks 😡 we had to pay for hotels food and taxis. We did fly but BA refuse to refund our money which is up to £4800. We are looking now for UK solicitor who’s field is bad airlines to contact us to take BA to court.

      If this is something which happened in the UK, all you really need is sufficient evidence to convince a court that everything happened, of costs incurred and that it was the fault of BA. You'd only need a solicitor if you can't personally appear in court and the court will not accept a written statement of evidence from you instead of a personal presence.

I bet they feel a little disappointed when to company just hands them a check; I'm sure they were looking forward to taking stuff. People like taking stuff, and if you can do it legally, that's just icing on the cake.

    Speaking of funny names et al, here is a story that actually happened.
    Trans World Airlines had just opened up a new route in the community that I was living in. They are more commonly known as TWA. They had a P.R. representative promoting the new airline in town so to speak. They had a table full of light refreshments, and were handing out free goodies. As I walked up to the table, the lady satarted in saying things like "would you like some TWA coffee?" or "would you like some TWA cookies?" and so on. Me, being a long time tea drinker..... (do you know where this is going?) I said (without thinking about it) I'd like some TWA tea.
    We both had a good laugh!

    I was lucky years ago. i won a default judgement for $250 dollars. Of course no attorney wanted to represent me. I was lucky enough to get in touch with a very kind attorney that not only collected my money but also his fees. It took 6 years by the time I was paid, but it was worth the wait.

    I just wanted to say thank you. Your comment about the District Court just prompted me to have a look at how the different courts work in the US compared to the UK and it was ineresting to see how Michigan works.
    Relevant to this video, according to the Michigan Court's website "small claims cases are heard by a division of the district court" and it's the same in the UK, although the limit is higher in the UK - US$12k compared to, I think, US$3k in Michigan.
    I was interested to read that the District Court covers both civil and criminal cases. In the UK, the equivalent civil cases would be heard by the County Court and the equivalent criminal cases would be heard by the Magistrates Court. A judge would not sit in both the civil side and criminal side at the same time, also there are no juries in criminal trials at this level.
    Likewise with the Circuit Court, ours is split between civil and criminal. The Crown Court hears the same sort sort of criminal cases that your Circuit Court does, as well as appeals from the lower level. A civil appeal from the County Court would usually go to the High Court.
    With civil cases it all gets a lot more complicated. The UK equivalent of the Circuit Court for civil cases is probably the High Court. But, in general, this is only for cases where the claim is for more than £100k (US$120k) or £50k (US$60k) for personal injuries. From the Michigan Court website, the Michigan Circuit Court deals with civil claims from US$25k.
    I was also interested to read that the Family Division appears to be wholly part of the Circuit Court in Michigan. In the UK, the large majority of Family Division courts are at the District Court level with most private law matters like divorces and child contact orders etc being handled at this level. Public law matters, such as a Local Authority making an application to safeguard the welfare of a child etc or high value private law cases around divorce are heard in the High Court.

    Wizz Air is actually a fairly large low-cost airline in Europe. Kind of like Ryan Air. I think they're based in Hungary and they're mostly known for random flight cancellations, delays and headaches.

    In Ilinois you can get a judgement, but you will never see a dime.
    Especially against former tenants.
    The only way to get your money from a former tenant is when the tenant finds out that they can't get a house or apartment because of past judgements and they cough up the money real fast.
    I have had that happen two times.

      @@2004RADMAN You can only seize property they own, and the property in the property room is usually either illegal to possess (drugs held as evidence, for example), stolen property (that still belongs to a rightful owner, but I'd find it wildly hilarious if they seized something you already owned to pay off your judgment), or other stuff that's being held or some reason but isn't owned by the cops.

    I feel like if I'd struggle to pay it. I'd go "I'd have to do payments because I don't have the money now." Seeing how garnishment is something a court can do, that would be a form of payment just the terms would have to get figured out.
    Now clearly you can't argue terms when you had time to start making payments or some act of good faith.

      Yes. I would imagine once the judgement was made you are contacted to discuss payment/payment plan. That's one letter you don't want to ignore or the baliff will turn up and there is no further opportunity to negotiate.

    You should watch "Pay or will will take it away" in one episode they went after Delta knowing they had a owned plane (not leased) boarding, that they were going to take away. the UK seems to accept cards and bank transfer, they don't seem to like checks.

    A few years back an employer screwed over every one of us and just closed the doors with no notice and never paid us our final money. We got writs of execution, but we would never get any traction with it, because before he closed the doors and we got our writs he moved everything out of his name and sold off all the company property. It still makes me angry to this day.

      Here in Canada there are limitations on what can be seized for personal lawsuits. For example: they can't seize any property that is used to garner income. I'm not 100% on this part, but I also believe that they also can't seize real estate if it's your primary residence. (Unless of course the lawsuit was over said property).

    Wizzair and Ryanair are the two ultra low cost providers in Europe. In this segment quite a few airlines decided that the customer support should is a very expensive (for the customer) premium phone number and make things slow.

      The "loser" will not be the lease company since the person/company against whom the judgment is given will have to replace those items. But I don't imagine there are enough ficus trees in pots to satisfy a sizeable judgment.

    A lien on the company headquarters has worked. The WSJ reported it in the 70s or 80s. It made the corporate annual report look bad to have a lien on your headquarters.

      That almost happened recently. Guy had tickets with Delta, flights were cancelled and so he asked for his money back... After over a year of it not coming, he took them to court and get the judgement - still nothing... So the guy sent in the High Court Enforcement Officers who turned up to Heathrow Airport and "arrested" the aircraft as the most valuable item around until the bill was settled
