The reality here in the Philippines that were being continued to deny is that Many Filipinos are too poor to access justice
As a result, the poor do not file cases knowing they are unable to afford a lawyer and it will take years for their case to get resolved. Because of a clogged judicial and court system, overcrowded prisons are the most visible problem plaguing the correctional facilities. Why the court is too slow? This analysis of delays in case processing in the Philippines notes that the causes of these delays can be grouped into four categories: institutional factors, the practices of some judges, factors related to court personnel, and factors related to court-related agencies.
As you know most victims of injustice are poor filipinos. The real problem in justice system in the country The vital flaw which undermines the utility of much of the judicial system is the problem of virtual impunity that prevails. This, in turn, is built upon the rampant problem of witness vulnerability. Either way, the lack of witnesses and other evidence together with disinterested and primitive investigating mean that few cases ever reach full trial in the courts. The police are the first and biggest obstacle to victims and their families obtaining justice in the Philippines.
Lack of access to justice or equal representation is a form of injustice and discrimination against the poor. Most citizens have the understanding that they have the right to an attorney, and that the poor will be appointed one when they cannot afford it.
So, i say why not welcome icc. it would be a good thing to improve the primitive way of investigating in the Philippines and people will benefit more through it. the Justice system in Philippines is poor, that is why the country is in this mess. it is what it is.

The question with the Ejk is that the police claimed that the victims were killed by them in self defense.Yet no cases were filed against against them by the DoJ or the Prosecution Service.When someone invokes self defense it means he admits the killing.Having admitted the killing he should be charged in court and prove that the elements of self defense attended the killing.Meaning the burden of proof is shifted on the police offiicer that he acted in self defense.If he fails then he should be convicted because he admitted the killing.What made the drug war notoriously illegal is the fact that the police officers involved in the killings arrogated unto themselves the functions of the courts to determine whether or not the killings were made in self defense by declaring themselves that they acted in self defense in the killings which is highly irregular and by their extra judicial invocation of self defense no cases were filed against them despite their admissions of authorship of the killing.The judiciary should no be blamed for this since no cases were filed before them for adjudication.The officers who are in charge of investigating and filing cases should be held responsible for these acts of ineptness in office including the superior officers of these police officers who acted as “berdugos” or executioners.These superior officers should have conducted investigations on their men and filed cases against them with the DOJ for the Doj to conduct preliminary investigaions on theses killers and file cases against them since they invoked self defense wich has the consequence of admitting the killing.Lutong macao ang nangyari sa “Drug War dahil ang mga pulis na pumatay ay sila na mismo ang nagsabi at naghusga na they killed thousands of victims in self defense yet they were not charged in court.

The SC decided back in 2021 "As guide for future cases, this Court recognizes that, as primary architect of foreign policy, the President enjoys a degree of leeway to withdraw from treaties which are bona fide deemed contrary to the Constitution or our laws, and to withdraw in keeping with the national policy adopted pursuant to the Constitution and our laws." Sen Risa was petitioner, and that case was dismissed for being moot.

Withdrawal from a "RATIFIED" Treaty should be a sovereign decision, as a rule - not done by a mere unilateral executive action. It is a matter of people's concern or decision thru the Senators, not a one man's concern or interest. Exercise of executive prerogative is only applicable to the handling of foreign policy by the President, because it is just about the country's strategy in our dealings with other countries, and such can always be adjusted to suit or conform with changing course and realities arising in our relations with other sovereigns, BUT NOT applicable to a multinational Treaty, like the Rome Statute, especially that it was already "ratified" and has become part of our legal system, just like our statutes. The process has to abide by the constitutional requirement regarding the making of treaties and in the withdrawal process, wherein the essential provision, as regard the Senate's "advice" and "consent", should be duly complied with. Otherwise it's unconstitutional, and the faulty act does not produce any legal effect.
