    As long as it is not a financial burden to TTWT I would continue the legal action. Getting frustrated and dropping the suit is what that organization is counting on you to do. Fight the good fight Tim.

      I agree I think organizations count on wearing down people to continue without penalties. They may continue doing this if not held accountable.

      Suggest you add the officers of the auction to the lawsuit if you can. That would vet their attention.

    Continue the lawsuit. They will continue business as normal at that auction and there will be people who can not afford to purchase "lawyers" the justice they deserve. You will be helping people in the future.

      The suit could be settled, nobody would ever know the out come and they could still do business as usual. So the best way to help people in the future in a "ebay feedback" kind of way would be to drop or settle, for no money but for a public statement of wrong doing. That way it's on the record.

    I wouldn't drop the law suit. The auction company learns nothing and continues to do things that way if you do. If for no other reason continue so someone else may be spared. God bless

    The club knows if they drag it out as they are doing, you will in time drop the suite, the attorneys know human behaviors.

    Hi Tim, Don't let it consume you but don't let the auction company get away without taking responsibility either (After all - they profited from the (illegal) sale). It's not personal - it's just business. Thanks for all the great video content.

    DON'T drop it you will win eventually they are counting on you to drop it
    I had something similar happen to me about 10 years ago and I eventually won the case. the judge also made the company pay my legal fees plus my loss of income 16,000 originally 45,000 by the time it was said and done

    Hey Tim, I’d recommend to continue with the suit. Like you I’m a principled person. And have passed on litigation a few time, despite an likely positive judgement. However in This case, the principle would drive me towards litigation.
    Keep going, and increase public awareness of the situation. I’m sure plenty of folks, myself included, would share your position. Social perceptions matter.

    I owned a company where something similar to this happened to me. My company was in the place of the auction house in this matter that I will relate to you.
    I had an online company, and received an overseas order for about $1000.00. We packaged the product and shipped it. A few days later we got a call from the gentleman whose card number had been stolen, and used to make the purchase. After a 5 minute conversation with the gentleman, we refunded his money immediately. We then contacted the shipper to try to stop shipment but they said that they were unable to stop the shipment.
    So for us, we were out the initial cost of the product, we were out the $1000.00 purchase, and we had to purchase the product again to have it in stock again. So, the person whose card number was stolen was made whole. The people who stole the card number got what they ordered. The shipping company got their money. I was the only one who lost out on this whole thing, and yes, that amount of money was huge for me. We also had every precaution to protect us from this sort of thing using authorize.net and secure checkout, who by the way still made their money as well.
    I think the thing that I hate the most in your situation is that, if the Auction people would just talk to you like a normal person, and if they are even close to reasonable, then you would help to solve the situation even up to possibly dropping the whole thing.
    If I were the auction house at this point, I would tell you my side of the story, and offer you a one time 20% (or something) discount in written certificate form that is transferrable to anyone you want, or could be used by you of course.
    Imagine the good publicity that could be generated for them by one simple smart act.
    I think you should continue the suit if you can afford it, until they decide to act like normal human beings. I am really tired of "the good guy" always losing out. Also, the "turn the other cheek" thing was said to the folks back in that time to the followers in Jerusalem because the final destruction was coming upon the City in 70ad. Just like the flee to Petra statement, sell everything you own, do whatever the authorities tell you to do, those things aren't meant for us for today. He was trying to protect his people from the onslaught that was coming.
    On a side note, due in part to your videos, I recently bought a Ventrac 4500z. Made such a huge difference on our 9 acre property. Now I am thinking about selling the hot rods and getting me another tractor.........hmmmm.

    I would think since it was their neglect they are liable for 2x that figure plus your lawyer fees! I believe that's common-law If not they will continue to not care, telling you to pound sand, by not taking care of you the buyer! Not to mention a year out of a tractor while it is being dealt with!

    I would keep going with the suit to recover the remaining amount your owed. If you get more than whats remaining of the loss you can always donate it to those in need or to the church or keep it in a volenteer fund that covers the cost of some of the projects you do for so many of those out of the kindness of your hearts

    Given the initial act of not checking the title prior to auction in violation of the law, then keeping illegitimate profits and proceeds on the sale, why hasn't the state filed fraud charges against the owner or operator of the auction house? Seeking satisfaction of the law does more than recoup your losses, it serves as a punitive act to hopefully ensure they do not repeat this fraud on other folks like you, looking to buy equipment.

    Tim, yes it’s frustrating but I would continue with the suit if at all possible. So many times people drop suits due to the frustration and time involved. Im sure their legal team knows this and recommends to hold out and make a situation last as long as possible. Whatever your decision, I applaud your decision to state only the relevant circumstances and refrain from going off and escalating the situation. I would have a difficult time remaining as matter of factly as you have. Kudos to you guys.

    Hi Tim and family,
    I followed your stolen tractor story from the beginning, so I can fullly understand you being fed up with it,
    and since you have recouped probably 75-80% of your costs, it would be tempting to just drop it now.
    The problem is of course, if you drop the lawsuit now, the auctioneer will no doubt do this to some else in the future.
    It seems the auctioneer is expecting this, they have their money, and after enough time, you should just go away.
    It sounds kinda like this auctioneer has done this before.......................
    Which is exactly why you really should consider continuing, and I say this as a guy living in Europe, who will never benefit from your court case.
    Except I will.
    We all will.
    So I hope you will continue with the suit, and take it all the way.

    As a new subscriber and now a follower of your channel- I’m very impressed with you and your family. Your morals and values are tremendous. Save someone else from the injustice of the actions of these people and take this to the point of a Judge telling you that you’re done. Don’t give up until then. Name names in your suit. Get new lawyer if needed. Find out if others have been affected the same and turn it into a class action if necessary. Go on every local news station (tv and radio) and broadcast this auction companies actions. They won’t like that. Good luck.

    I really think you should go after them , they need to be accountable for there actions, so they dont do it to someone else .
    The auction house needs to be reported to the attorney general in your state

    Sorry to hear about the situation you've gotten into. If you have already had your lawyer file suit against the club and/or their auction service or if you truly would like for them to be a better organization, be it the club or the auction service, then I would suggest to follow thru with it. Thus, they too should be held responsible/liable for the sale of & allowing the sale of stolen property/item. They should have had all of their "i" dotted & "t" crossed before they let the hammer fall on something they are selling to the public. As others have mentioned in the comments, they are hoping you'll drop it & let things go. The sad thing is, the length of time the suit will take to be resolved will be excessive & you'll have to be patient. What does you lawyer suggest at this point? Good luck & stay safe.

    I'm of two minds on this. There is a point to be made here and the auction company needs to step up and take responsibility but if this is becoming a mental and financial drain than I might think of letting it drop.

    Thanks for the lessons learned, Tim. I would have never known the procedures to check before a person purchases a tractor from an auctioneer. Sorry you guys went through all the legal hassle but we learned from your experience and again we thank you. If you're able to move on, drop the proceedings and continue with your lives.     Tim, making this group accountable is going to be a most difficult, time and emotion consuming prospect. You have recovered your purchase price but you will unfortunately never recover those sleepless nights and wasted time. Unless the State steps in and prosecutes them they will not change their behavior. Getting your attorneys fees and their commissions back unfortunately won’t stop them. It’s not even a slap on the wrist. Turn the other cheek brush the sand from your sandals and use your energy to make videos. You have done a great job informing the public about these predators thank you.

    I read several comments but not all of them.
    1st and foremost the decision is yours and yours only! Nothing any of say makes any difference at all in what it cost you (your family) regardless if your decision in the suit.
    2nd seek legal advice on what you will be able to recovery and is it worth what it will cost you ti get there.
    3rd I really agree with the feel of the majority if the comments I read. The auction house and the auctioneer (as I remember they were separate entities) failed to perform their legal responsibilities and have stump their noses at you that it is your problem. That is wrong!
    All that said, you have never heard me tell you that in this fallen world you would be treated fairly. In truth few will treat fairly!

    Keep at it! Somebody, somewhere, has to stand up for what is right. It is a shame that the thief got away so lightly. If somebody doesn’t stand up, wrongful behavior continues and more victims lose.

      The thief paid the $14k, plus $4k restitution on the other case, plus some probation. I don’t think this was too light.

    You should continue your quest. This organization should be held accountable for their wrong doing. You have a good case and should have no problem recovering your expenses. This organization will continue this unlawful practice and you have the opportunity to stop them. To me it’s also a matter of principle. Look, let the attorney take care of it. Seems you’re in a win win situation and your running days are over. Best of luck Tim. You have a great family.     Are you kiddin me Tim?? this is great Y.T. T.V. Great content. Your viewers will watch for every development in this ongoing law suit. I.e. "The Day's of our Suit!" or "As the Tractor Turns..."
    Even if you just ask to be made whole on expenses and for a public admission of wrong doing and an apology.     I understand you wanting to drop the suit but that is exactly what the club is counting on. I'm surprised the state doesn't get involved because of the title issue. Everyone should be aware of the club and their way of doing business. I will probably never be in the area of their auctions but I would never attend one and will spread the word about them.     Tim, delay is a typical legal tactic. They wear you down until you just give up. Sorry for your problem. Have you examined small claims court? There you may get a judgement. Then you can enforce the judgement on their assets. You and your family provide an honest informational channel, that many and myself enjoy. Good luck!

    Ultimately yes I would continue if the auction company is the one being sued.How many times have they gotten away with this?But if y’all feel satisfied & at peace with how it’s turned out so far then sure just drop the suit.

If spent the last 20 years working in a negative hostile environment with some of the worst individuals this world has to offer. Quite frankly I have learned that other people will always try to beat you down and take what they want. It's not about making sure they pay or you come out even it's about whether it is worth the stress or your happiness.i don't care anymore about the criminal aspect that has tried to beat me down over the years as they will never cost me my happiness.     People help each other in many ways... and one of those ways is to make sure that those who do wrong are brought to justice so they can't do it or something worse to another person.
    The only reason to drop the suit is if you feel there's no chance for justice, in which case you'll have to be satisfied with spreading the word of your experiences as a warning to others.
    I'm sure you'll do what works best for you. Good luck regardless and thanks for sticking with it this long.

    Admittedly I may be using these verses a little too heavily handed, but please hear me out with the logic side of my opinion.
    I implore you to keep up the suit. That money you're willing to leave on the table may not be something someone younger and just starting out in life may be able to leave.
    I think we all have an obligation to stop crooks when they do something to us, not just for our own sake, but to protect the rest of the community from having it happen to them.
    In a way you become complicit in the wrong doing to whoever after you this happens to if you turn a blind eye to it.
    Anyways, I know the stress of dealing with the legal system can seem to be more than the money is "worth", so I won't think poorly of you if you do drop it. BUT I do think you shouldn't let them get a way with such a practice if you can weather the anxiety without lasting impact on your family.

    The high road is not always obvious to some however well intended. There's an old song that I'm sure you know called 'The Gambler' and the lines that i think say it all are
    "You've got to know when to hold 'em
    Know when to fold 'em
    Know when to walk away
    And know when to run"
    You already know what you want to do (and maybe have already done it). You have nothing to prove to no one. I say give yourself one more present this Christmas ... peace of mind. Tkank you for all you do.

    This is a principle issue Tim. You should absolutely carry on and push ahead with your suit. You have an opportunity here to not only recover your losses, but to also get this company to change its practices and behavior. Submitting and walking away may be easier for you at this point; however, I would encourage you to take it all the way. I wonder if a social media and local news campaign would help in your endeavor.

    Sometimes for your own peace of mind it’s best to put these kind of things behind you. I was sued for bodily injury years ago. My insurance company fought the suit for 3 years because I had a bullet proof alibi. Over those 3 years I dreaded going to the mail box or looking on my porch after arriving home. Letters and court papers were a constant reminder. My lawyer called one day and said do you want to settle? I was innocent. The settlement had gone from multi million dollars to 1,000. My lawyer said the insurance co. Would continue to fight if I wanted to go that route. Long story short, I settled with the caveat that the suit could never be opened again and I was not professing guilt. Best thing I ever did. The suit was nagging at me for 3 years and it made me bitter. Putting it behind me was the best decision i could have made. Let it go Tim. I can see it in your face and hear it in your talking that it nags at you just like mine did.
    My guess would be the local Ruritan Club really doesn’t know how to handle this situation and isn’t getting much help from the National Organization. There’s no excuse for what happened but I would guess they are decent people that made a mistake and don’t really know what to do.

    I agree with most of the viewers here. You should forge on with your suit to recover all your expenses incurred. The fact that the auctioneer kept his commission would make me want to pursue this even more. Good luck.

    I couldn't let it go, never. Someone needs to straighten them out because they'll do it to somebody else and as far as I'm concerned, they're just as bad as the tractor thief. Stealing is stealing. I hope it all works out for you.

    You should ABSOLUTELY pursue it. You're right when you say the world is not fair. But, having accepted that, there's no reason why, in a circumstance like this, you can't make that fact be someone else's problem. In this case, the club.

    Continue with the suit including legal fees. When you win donate a portion or maybe all of it to a local charity or your church.

    I would like to see you keep the suit going. I attended a lot of auctions, unfortunately I have learned not all auctioneers are honest. If nothing else comes out of the suit than to educate the public about the pitfalls of auctions it will be a huge public service. I feel like in the end you will win the suit .       thomas cantral I’d guess more like 50-70% of auctioneers are not honest. Ghost bidding, incomplete facts regarding condition, quick gavels for friends, etc.

      @@LawnGardenFun we have a local auctioneer who is famous for goast bidding. A couple of years ago I caught him bidding me up on a car so I dropped it on him . About a year later it was at another of his auctions and I called him on it . We're not real close friends. Lol

    I've bought a few items at the Mt Erie auction. Please keep the suit against them going so maybe they'll understand in the end that they have to do their part in protecting the buyers. I hope people quit buying and selling there until they make it right.

    I agree with the one commenter who said life is not fair and you should continue to sue. If you continue and actually get their money it will do at least 2 things. 1. The club will be more diligent about insuring their items on consignment are as they should be and 2. It will make an example for anyone else that falls victim to that sort of cruelty. They can use this as an example and follow suit

    I agree with your decision to drop the lawsuit. The attorneys are the only ones who will gain from it. I would pursue action against the auction company with your state's AG office. There must be some kind of state license to run an auction house. And the auction company must have some kind of requirement to ensure they are not selling stolen property. If the AG's office finds them in violation the license can be suspended and they can no longer run auctions.

    Tim don`t give up. Make episode with details and place where you bought. That would take lot of customers from them. Business is strong as clients/customers are.
    I have worked in car sales industry before, and we always check as much is possible before taking any vehicle. If anything pops out later, that was ours responsibility.
    They failed at the first place, and they even sold to you, which could be even worse. Maybe they knew what they took, that why they sold, hoping nobody will check.
    So basically they should they both knees at once.
    They deserved to be marked as a terrible place to buy. Have you tried contact BBB (Better Business Bureau) ? They usually help or might give you a guidance.

    Try finding an attorney who will pursue this by taking the auctioneer to court and will collect his fee based on winning a judgement in your favor [similar to injury insurance cases: no win, no fee]. It seems like you have a good case, as long as you can document all the necessary paperwork from the auction sale.

    Keep the suit open and create a public record of the facts of the case... that will help educate other buyers to beware in their dealings. That would be a great public service.

    Tim, your channel started and continues to grow because you are down to earth, good, honest people just using TH-cam to entertain and educate people. Yes, you are definitely in the right when it comes to the tractor purchase but will fighting for a few dollars really help you in the grand scheme of things? Forgive and forget and you will always be the bigger (and better) person. Chalk it up to experience, move on and keep making good content. Just my opinion.

    Im sorry that you had to go through that I would not give up until I was satisfied in my own heart that I've done as much as I possibly could to recover as much money as I could out of the lawsuit but on the other hand you have to know when to cut your loses and say enough is enough and call it quits. Now thats my thoughts on it only.

    don't let the auction and the thief get away with anything. I had the same thing happen to me and went along with letting them off the hook, at the police department's advice. a
    year later I found another of my trucks at the same auction and had been sold to them by the same thief !

    I've followed this from the beginning. What I fail to understand is if "once the gavel falls" and the auctioneer is paid and "the title transfers to the bidder". Why you aren't the proud owner of a tractor and the auctioneer and auction house isn't having to make good to the dealership. The auctioneer should have lost his license and he and the auction house should be facing criminal charges from the local prosecutor and/or the attorney general.

      the winner is the dealer who recovered it they claimed the loss and got a portion that they had to receive unless they tendered a warrant for return of stolen property you should have held the tractor in escrow until your losses were meet or equaled make the dealer who lost it share in the recover fee's but the ag would recommend this here in pa that the route that would be followed the sticky point is it multi state jurisdiction but and thats why returning it in good faith only served the dealer

    Tim, we all believe you should keep the fight up. The auction company didn’t support you and they should have. There are reasonable expectations that auction companies are selling items with clear titles and earn their profits honestly. Auction companies that don’t, are no better than the thieves themselves and need to be held accountable.

    I realize it’s frustrating to continue the lawsuit but I would continue to wear them out till they pay you every penny you’re owed and the auction company gets some sort of consequence for being selling stolen property. They are dragging their feet hoping that you drop it. On a positive note, I’m glad to hear they paid you back for the purchase price of the tractor at least. Keep your chin up. God bless!

    Sorry for all that you guys have gone through . It's definitely a sign of the times when lawyers and large companies can take an issue that is so straight forward and obvious and turn it into a 3 ring circus. I hate to see bad things happen to good people and I say stay in the fight to the end . But I can understand if you've had enough and want to move on from this.     I must agree that you should continue the lawsuit. You are in a position now to help protect others that would have the same fate fall upon them as you have experienced. If you drop the suit that simply encourages this sort of behavior from the people who wronged you. If cost of legal expenses might be a problem I truly believe a Go fund Me page would help cover this as people are always ready to rally behind the little guy to fight the big guys. Especially in this case where the club is depending upon your legal fees to deter you from doing the right thing so that they can continue to do the wrong thing.     Wow thank you Tim. I really thought at a auction you were safe buy or bidding WOW still gives me the chills. I’m from Pennsylvania and actually did bid on tractors. Luckily I bought from a individual but even then I was worried about his to make sure transaction was real. Looking forward to your advice. But if this doesn’t Break you I Say fight the Fight stay in it there wanting you to drop out. And hopefully with the social media on your side you can teach a lesson. Because most of us can’t afford the fight or even knew this could happen! I’m like you if I was at a auction (and we have lots around Here) and Bid and I don’t care how cheap or How expensive (you could have spent more with same out come thank goodness it wasn’t more) when the hammer drops you own it supposed to be a good thing obviously if you were bidding in confidence thinking auction co. Was good and honest and did there part and there research other wise they should have reimbursed you then they fight it out with the thieves ok looking forward to hearing more. Great videos

    I would not drop the suit. Most businesses and auction companies carry a part of there insurance policies called errors and omisions. that is specifically designed to cover errors in paperwork on there part. I enjoy watching your channel and would be willing to contribute to a go fund should you be willing to continue the good fight. Also if you reach a settlement any go fund me monies should go to expanding the channel. I find your content extremely educational and entertaining, specially the trailer stuff with the Indiana state trooper. Good luck Tim!!

    I bought a brand new Case IH tractor back in Jan 2019. It had problems right from the start. The manufacturer refused to give me my money back. Finally I got fed up with ongoing problems, and put my foot down in August that I want my tractor fixed permanently. So the dealership picked the tractor up in late August. The parts to repair the tractor went on back order after that. I just got a phone call last week that the tractor is finally fixed. Yes, my tractor sat in pieces for over three months, and nobody (dealer or manufacturer) would help me- I just wanted my money back, never-mind all the money I have lost due to not having the use of the tractor. Anyway, the moral to my story is- don't let the auction company get away with not reimbursing you. We have to stand up to these types of companies or they will continue to take advantage of people!!

    It is frustrating , and as a retired Canadian Police Officer the prosecution is too quick to clear the dockets by wheeling and dealing with no regards for the victims ( you and many more ) . I think the Auction company should be held accountable.

    Tim, I understand that continuing with the suit is both exhausting and expensive. If auction companies are required to ensure that the goods they are selling are legally owned and legally available to be sold, then how is it that they have not been prosecuted for receiving and selling stollen goods? However, it would also seem that a suit would also be brought against the auctioneer that would now involve their insurance company for this type of action. Insurance companies have a tendency to prolong these types of cases as well. I’m not quite sure, as well, how this case is being prolonged , however, maybe instead of dropping the case, it’s time to acquire another attorney, that will be aggressive, in fighting on your behalf. My suggestion is to continue the fight. Continue the fight whether it be on principle, or to regain your losses, or both, but do not become weak or weary. But regardless my thoughts or the thoughts of the others on this site. First and foremost pray. Pray for Gods direction and protection. Good Luck! May God Bless you and your family! Merry Christmas!

    keep it going and file criminal charges against ruritan club for selling stolen merchandise. if a pawn shop buys something stolen and resells it they can be charged with receiving and selling stolen goods. I would think the Ruritan club is not above those laws.
