I understand that we wouldn't collect US Sales taxes but what about Nexus and the Wayfair decision, etc? If we're storing inventory in several states via FBA, then that's creating a physical nexus and we may have to pay US taxes to the State, no? Then there's also economic nexus if we pass the transaction or sales dollar thresholds into a State.
You are on the right path my friend. You do have to keep an eye on Florida, Kansas & Missouri which are the states that Amazon currently (Apr. 2021) does not collect and remit Sales Tax for you. In Kansas, you have nexus as soon as you start selling to them, with Florida and Missouri as soon as you have physical nexus (your inventory is stored on an Amazon warehouse on those states, for example). Keep in mind that once you have reached the threshold for each state that Amazon DO collect Sales Tax, you are required to register and "file" the report with $0 owed because Amazon is doing it for you, but you have to let the states know that. I hope it helps! I've been doing A LOT of research for the past few weeks so I can be compliant myself.

Are you sure that as a Canadian (non-US resident) I don't have to collect sales tax? I read that you have to collect and remit sales tax for every state that you have a "Nexus" with. I read that most states consider you to have a nexus with them if there is an Amazon fulfillment center in the state, as that means you are using a US logistics service and that is part of what defines a seller as having "Nexus" with them. Do you know anything about this or can you provide a link to the reference you used to state that Canadians do not have to collect Sales tax in the US?

Hi Sara, that's a great question and I can help you with that. If you'd like to sell on Amazon.com it's better to ship directly from your supplier to the Amazon fulfillment center in the US because if you ship them to Canada you should pay an extra shipping fee from your place to the US which costs $50 for a 10kg box on average. For example, if you want to ship 2 boxes from Canada to the US you should pay around $100 to $120 for 20kg which doesn't make sense. Regarding your next question you can request an inspection from Alibaba and if you want a sample just ask your supplier to ship it to you. Usually, the sample is free but you should pay for shipping which costs $30 to $40 on average but it depends on the size and the weight of your sample. Cheers!

Hi Ali, how much fixed amount I should think to have to pay monthly? for example amazon fee (40$) + Hellium 10 (97$) + A2X + Freight Forwarder + .........
I'll come up with a new video on that topic. Some tools are really expensive so what I do with tools like a2x is to subscibe every 3-4 months to send my statements to qbo this saves me a lot of money that I can reinvest in my inventory.

Hi Sarkie! No, as far as I know amazon sellers are not allowed to deliver their own items. I've heard they only let shipping companies like Canada Post, UPS, FedEx to deliver items. You can open a case with seller support and ask them. They usually reply within 2 hours.

Hey thanks for watching. There won't be any transferring fees between a us based bank account and canadian bank account. It's all about exchange rates. Usually bank exchange rates are high compared to others. You can use ofx or any exchange company in your city. I worked with Vancouver bullion exchange a few times when numbers were high.

When you send inventory to FBA warehouse in the US, it means you have inventory in the US so you need a legal entity in the US. in other words you sell and ship to costumer from US to US and not form Canada to US . In addition, do you pay any customs when you send to US FBA centers ? what carrier do you use ? thanks
Hey thanks for watching I ask my agent on Alibaba to ship them straight to Amazon warehouse. Regarding customs for some products you should pay a percentage and for some categories there is 0 customs and duty.

It depends on your business type. If you're a sole-prop personal and if you're corporation business account. For small payments you can use credit cards and for large purchases use wire transfer.

Glad to hear it was helpful! It doesn't matter if it's a business or personal account. What matters is that if you want to get USD payments from Amazon you should have a US based bank account which RBC or BMO offer otherwise Amazon pays you in CAD.
That's a good question. I'd like to know the same thing, were you able to find the answer to requiring a US Credit card along with bank account? I think it would be wise for making the purchases overseas.
Hey Ali, thanks for the video and info. Quick question though, how certain are you about U.S Sales Tax as a Canadian Corporation? There is a lot of information out there that says that you DO need to charge and remit Sales Tax to the respective U.S States as soon as you have Physical and/or Economic Nexus, no matter whether you are Resident or International Seller. In fact, you do have to collect and remit Sales Tax with Kansas as soon as you start selling on those states and with Florida & Missouri as soon as you have physical nexus (inventory on Amazon warehouse on those states). Although you can continue with your personal bank account but since you don't want to mix your personal and businesses expenses, I recommend starting with a business bank account.

That's right. If you sign and submit a W8BEN form on Amazon, you don't need to get an EIN anymore.

I've applied EIN as you have explained in the video and have my EIN number now but I don't know if I've made mistake because the IRS had registered my Canadian private owned corporation as a C corp(as entity type) , is it right or do I have to register it as "Non regarded entity" to avoid taxation in the US. or I can keep the C-corp and fill W8-ben-e at the end of the year? Hi Sarkie! No, as far as I know amazon sellers are not allowed to deliver their own items. I've heard they only let shipping companies like Canada Post, UPS, FedEx to deliver items. You can open a case with seller support and ask them. They usually reply within 2 hours.

So I guess my question is if I do incorporate and saying that I don't require an EIN number, will the IRS be able to know that I don't pay taxes to the IRS because I'm Canadian with a Business Number or is it because the the IRS will see the W8BENE form and recognize I'm a non US citizen?

Hey thanks for watching. There won't be any transferring fees between a us based bank account and canadian bank account. It's all about exchange rates. Usually bank exchange rates are high compared to others. You can use ofx or any exchange company in your city. I worked with Vancouver bullion exchange a few times when numbers were high.

Hi beshr, usually new sellers start as a sole prop and hopefully once your business gets more sales open a corporation

Hi Ali, Thanks for the video. I'm confused about something ... When you send inventory to FBA warehouse in the US, it means you have inventory in the US so you need a legal entity in the US. in other words you sell and ship to costumer from US to US and not form Canada to US . In addition, do you pay any customs when you send to US FBA centers ? what carrier do you use ? thanks
Hey thanks for watching I ask my agent on Alibaba to ship them straight to Amazon warehouse. Regarding customs for some products you should pay a percentage and for some categories there is 0 customs and duty.

It depends on your business type. If you're a sole-prop personal and if you're corporation business account. For small payments you can use credit cards and for large purchases use wire transfer.
And yes I am truck driver so I have my corporation account..that will be ok for FBA or I will have to make new!

Glad to hear it was helpful! It doesn't matter if it's a business or personal account. What matters is that if you want to get USD payments from Amazon you should have a US based bank account which RBC or BMO offer otherwise Amazon pays you in CAD.

That's a good question. I'd like to know the same thing, were you able to find the answer to requiring a US Credit card along with bank account? I think it would be wise for making the purchases overseas.
Hey Ali, thanks for the video and info. Quick question though, how certain are you about U.S Sales Tax as a Canadian Corporation? There is a lot of information out there that says that you DO need to charge and remit Sales Tax to the respective U.S States as soon as you have Physical and/or Economic Nexus, no matter whether you are Resident or International Seller. In fact, you do have to collect and remit Sales Tax with Kansas as soon as you start selling on those states and with Florida & Missouri as soon as you have physical nexus (inventory on Amazon warehouse on those states). Please let me know if I am missing something here, and where do you get your information? I appreciate it man!

If you sign the form W8BEN form you don't need to pay taxes to IRS. You'll pay CRA.

Hi Jix! Apply on Amazon.com and after 2 weeks when it gets verified on brand registry you can use that for all of the marketplaces including Amazon.ca

Sole Prop, maybe business account then?
Although you can continue with your personal bank account but since you don't want to mix your personal and businesses expenses, I recommend starting with a business bank account.
