Blowing smoke at someones face is neither against the rules nor assault. Their are no laws against blowing smoke in someones face. I wouldn't like it sure, but legally I couldn't do anything about it. Nothing dick did the entire show was cause to be arrested or expelled. Only Jen should have been expelled.
If I were in Jen's position I would have calmly dumped the nearest beverage onto Danielle's head in the same fashion that Dick did to Jen. Not to retaliate, but because abusive people snap when they get a taste of their own medicine, and since his whole 'point' was to 'defend' Danielle he'd probably be more inclined to freak out which could have resulted in him costing his game, so it could have been smart. The entire Donato family is 'extremely dysfunctional' anyways. (To put into nice terms)

No matter your opinion of Jen, it was downright horrible how Danielle, Dick and Nick were treating her in this clip. They were way over the top. But again, I'm sure a lot of it was staged for TV. Production has been interfering for years now. And the way Nick was yelling at her, just awful. However, I can't recall how long after it was but, apparently the two of them (Jen and Nick) started dating. I remember seeing pics of them together for some photo shoot and reading how abut they were dating now. I'm not sure if that still stands but it did at some time.
That's what gets me. Why would she date that asshole? He was the biggest asshole of all in this scene to me. She and Dick already had issues so the tea coming from him was more understandable. But Nick was getting in something he should have stayed out of
