    Dr. Ann Wolbert Burgess is an internationally recognized pioneer in the assessment and treatment of victims of trauma and abuse, and author of A Killer by Design: Murderers, Mindhunters, and My Quest to Decipher the Criminal Mind.
    Among her many awards and accolades, in 2016 she was named a Living Legend by the American Academy of Nursing
    She has also worked with FBI Academy special agents to study serial offenders, and the links between child abuse, juvenile delinquency, and subsequent perpetration.
    You know the super successful Netflix show Mindhunter about the FBIs first days of criminal profiling - she worked with the real-life agents the show is based on.
    Dr. Jon R. Conte is a University of Washington professor and scholar whose area of expertise centers on mental health issues related to child abuse and trauma.
    Conte joined the School of Social Work in 1990.
    He’s a founding president of the American Professional Society on the Abuse of Children, Conte was honored by the association in 2012 with the designation of professor emeritus for life. In 2009, he received the society’s Ron C. Laney Award for Distinguished Service. He is a lifetime member of the APSAC Board where he serves as a senior advisor.
    Conte is the editor of the Journal of Interpersonal Violence and Trauma, Violence and Abuse: A Review Journal, and is the consulting editor for the Journal of Forensic Social Work..

      You're stating what a rational and mature person should do in the situation although I would argue that most people would probably act similarly to the brothers. When the police don't show up after all the gun shots and loud noises I think it's basic human instinct to try and survive.

    It’s insane to me how much money spending has more relevancy to some people than the incestuous abuse happening in that family. The brothers were raped by their father for years while their mother helped him cover it up and you’re all mad because the rich kids went shopping? C’mon now

      Well said! I have a relative that actually think like that! Everything comes down to money! Even when it comes to lawsuits. No one can sue for anything, regardless of how they have been harmed!! It’s all about the money and if u get it, u r the bad one, not the perp. Absolutely bizarre.I think it comes from years of political brain washing.

    I started to watch the testimony, and I will tell you as an abuse survivor myself, a domestic violence/boyfriend related abuse. I don’t think you can pass judgment on what you would do, unless you’ve ever been in an abusive situation as a child or an adult. I think they have served their time, and it’s obvious now with the Menudo singer coming out, specifying that Eric and Lyle’s father abused him they are to be believed and would of been in 2023.

      They would have been believed if they were trialed now. I mean people were believed with abuse allegations that weren't this severe. Folks, who are against them, have to realize this case was dealing with 12 year long sadistic molestation. Are you gonna be undamaged by that experience or what? Where is the same energy when pedophiles or rapists are trialed? The brothers were just easy scapegoats.
      That was literally incest happening, and that would confuse the hell out of any victim especially when it's your father who then calles you a faggot whilst having gay porn in his closet. The pro prosecution people are a joke. I wish they killed for money hah ,would have been easier.

    Omg, let the brothers out! They have served enough time for killing the most abusive parents we can imagine. We all know they were abused, the experts have spoken, sick of these prosecuters twisting the facts. And who in the hell was this judge who told the jury to disregard the experts testimony. New trial is warranted. I'm also sick of people not believing famous wealthy people are not abusive. Michael Jackson slept with young boys, which is a fact, but people think he was not sexual with them, omg! What grown man sleeps with little boys? I love his music, but that does not mean he was not a pedophile

      Erik AND his cousins Henry Lliano and Andy Cano found gay porn in the parents room and moved it. It was not found in Erik's room. Considering how the brothers were raised it is completely consistent that they wanted to protect their parents image. All they ever did post crime was talk about how great their father was. None of that is inconsistent with someone who has been abused and molested. Emotions are complex and even more so when it's your own parent.

      There's no evidence of the brothers ever being abused. The brothers are excellent liars, they proved it when they convincingly lied to police for 7 months before they were arrested. The succesfully lied to the 911 operator, to the first responders, to the investigators, to their friends and family members. But we are to believe that after they were finally incarcerated and faced the possibility of the death penalty, they suddenly discovered the beauty of truth and decided never to lie again. Seems legit. If you really believe that, I have a property on the Moon to sell you because you must be the most gullible person under the sun.

      Exactly! These two cases are connected somehow, you can better understand one case when you understand another. What they have in common: untouchable and wealthy celebrity defended by his powerful image, pedophilia and same sex relationships are taboo items not willing to be discussed. Still amazed by those journalists who started to investigate MJ and his relationships with boys such as Diane Diamond. And also stunned by the Erik’s defense attorney Leslie Abramson. What she did at the first trial is unbelievable and due to her work we have the opportunity to understand the case and support Menendez brothers. I hope they will be freed!

    It always blows my mind when people assume because someone is rich or in a prominent position that they wouldn't do something so horrific. That's like insinuating that poor people are bad parents. Either way they've served more than most murders will ever serve. There are mass murderers who have been let out before. There's also a lot of people who murder someone they do or don't know for whatever reason and most of time get 30 yrs. Ridiculous!!!

    I always enjoy hearing from AB but perhaps this was a lucky accident. Dr Conte was an excellent guest with so much insight beyond his famous client! I liked the 1:1 format and think there could be a place for it when discussing difficult topics. I got a ton out of this episode. Well done!!

      Joel said himself in this episode that Dr. Conte probably knows more about trauma and sexual abuse than anyone else on this world, and he evaluated Lyle and his family for over 50 hours and came to conclusion he told the truth about the abuse. So much so he’s here still defending his release 30 years later. You think you know better than him?

    Joel, my humble suggestion for future connection problems is after 5 minutes of trying, just let your guest go and focus on the guest who has the good connection. I could only last for about 50 minutes, it was too annoying and I know it was anxiety provoking for you throughout.

      They were rich and grew in a family where spending great amounts of money was normal and even encouraged to uphold their images.
      Also, retail therapy is a real phenomenon. Lyle, the one who spent the most, was known to spend even more money than usual when he was upset about something, such as after the killings.

      Two of the countries most respected experts in the field of psychology and child abuse who interviewed both brothers for 50 hours, interviewed many family members, friends and associates and looked over every single bit of evidence in the case believe the brothers were acting out of the fear of being killed but I guess random people know more than them.
      Not everyone is abused in the same way and not everyone reacts the same way for many different reasons.

      That's the entire point of their defense. For imperfect self defense the person needs to have an unreasonable but honest belief. It would be perfect self defense if they had a reasonable belief.

    Problem is it's not a very good case for self-defense. The victims were just relaxing on the couch when they were attacked.

      Not according to the forensic pathologist who analyzed the crime scene. And even if they were, imperfect self defense is about the belief of imminent danger by the defendant, not about actual danger itself

    As much as the law says that nothing gives a human being the right to murder, nothing says there is also a right to abuse. At this period in time nobody would have believed claims against a powerful parent(s) - I hid abuse for 35 years against somebody because my mother believed that abuse claims from young girls against men were highly improbable and made up.

      People experience grief differently. Compulsive shopping can be a coping mechanism in situations of great distress. Plus if they killed them for money and this was murder wouldn't they want to avoid detection at all costs?And if you kill for money why don't you spend that money more wisely and not follow all your whims. Where were their smarts to invest that money into smth that would bring them more money? Oh, why don't you take the wallets (thay were depicted in the crime photos) of the folks you've killed if you are so greedy? Why would you attend the funeral of the people you have killed? And tell me ,why would a child ever kill their parents? ( don't tell me they were old enough to get away. Abusive households operate differently) Money is too shallow of a reason.     Erik testified years of 'drills'/abuse of having to sit in front of a mirror as his dad imbedded in his mind to sit in question and answer form, Jose would enforce he would unalive Erik, not just hurt, but actually unalive him if he told anyone about the abuse. The details of Erik trying to change the assaults by using various foods to minimize the reality of having to engage in these horrible acts with his own father are terrible.

    People can recover from family trauma - but no one recovers from being shot to death.
    If a person is being abused - better to confront that before loading a gun.
    If they are exonerated - it will set a precedent.Abuse is abuse and murder is murder.
    Anyone who plans to murder even an abusive spouse usually gets a long prison term.

      I agree with you to an extent. But, the older boy learned while on leave from University that the dad was still sexually assaulting the younger brother, so he confronted his dad, hoping he would let the younger brother leave home for University. Instead, the dad told him his younger brother could not go. Later the mother confronted them about threatening to expose the dad and ruining the family. That is why they believed the parents were planning to kill them for threatening to report the dad.
      They were controlled, manipulated, and sodomized by an adult male since they were very young children. Do you think they developed like an average young adult to make rational decisions?
      The spending spree, in part, was probably a sense of freedom and power to them against their parents.
      They should not have gotten off scot-free, nor should they have received a life sentence.

    If they would have poisened their parents or some way less graphic and brutal than blowing them up with shotgun i think they would have been more sympathetic to brothers. The fact they blew parents away and also reloaded for more brutal killing just hurts them in public eye. Just a total ambush and vicious murder.

    I think the brothers were afraid most days and their parents caused their fears with abuse and threats . I believe that the brothers rightfully believed that the father would find them if they ran.

      The defense presented medical records, inappropriate photographs of the brothers’ genitals as children, witnesses, audio tapes and the psychological evaluations of trauma and child abuse experts that supported the brothers’ claims. Is that not solid evidence?
      And no one said what they did wasn’t ilegal, but life without parole is too harsh of a punishment given their circumstances

    I think they wanted money, and they felt that killing their parents would help them inherit money.
    I was abused and I didn’t kill my parents.
    I have a hard time believing this was self defense.
    Since we live in a world where everybody’s a victim and everyone should just get handouts, then let’s go ahead and let these brothers out of prison and see who they will kill next. Yep, that’s the right thing to do.

      So they didn't claim self defense, they claimed imperfect self defense.
      As for the money motive there wasn't one. The prosecution proposed that and a grand jury a year before the first trial rejected that based on lack of evidence. Then you have testimony from the brothers and family members that multiple people were told by Jose he kicked the boys out of the will a year before the killings. The brothers were told this as well as their uncle Carlos who was in charge of the Menendez estate. And when their Aunt Marta tried to comfort the boys saying the family would help them with the inheritance and the estate the boys were confused. She said to them that they were the sole beneficiaries and they said no they weren't because they were removed from the will.Then there was the fact that in January of 1990 Lyle was going to automatically become a major layer in one of Jose's companies I believe. Also if it was about money then why didn't they wait until Jose had the required doctor's appointment done for his life insurance policy.

      The older brother was attending Princeton; the younger brother was living at home. When the older brother came home for break, his brother revealed to him the father had been abusing him since childhood and continued abusing him sexually. The father was still making the younger brother have sex with him.This set off the older brother, who confronted the father, which set off the chain of events.

The mother had 8 areas of wounding although some of the wounds were suspected to be caused by the same shot so no they didn't shoot their mother 14 times. My best friend was sexually abused by her stepdad starting when we were in grade school and it continued until we were in high school. It RUINED HER LIFE.       He's been working as a child abuse and trauma expert since the 1970's and is one of the countries most highly respected individuals in the field. I'd sooner side with how he feels rather than a random person who knows very little about the case.

    It's pretty normal for a child to be concerned if red wine was spilled on their parent's carpet. I also think that Erik was gay. Not that it should make a difference if his father really molested him, but I recall information that they found gay pornography in Erik's bedroom. He claimed he was protecting his father from being "outed". For some reason this was not allowed in as evidence & the jury never heard about this. My first thought was...If you are going to blame someone for molesting you, why would you be concerned about protecting them. Too many reasons they could have moved out from home. Why kill your parent's at the age where you are about to become independent? And why kill your mother. This was premeditated too. These two guests are quacks in my opinion.

      So it's clear you don't know about how abusive families work especially when incest and sexual abuse was involved. On top of that with a family that was as obsessed with seeming perfect like the Menendez's. For example, former teachers testified about how Kitty would not inform the schools about the boy's especially Erik's learning difficulties and disabilities due to her and Jose's belief that "it made the family look bad."
      Also the jury in the first trial did hear from Erik about the pornography and where it came from.

    Not condoning their actions one iota,. But after watching the trial, I concluded that these boys were likely lying about the SA. However, many testified on the boys behalf about the brutal mental and physical abuse that those boys were subjected to in their parents quest to fulfill their own childhood dreams through their children. Dedication to the sport was not the boys dreams But the parents!! And the boys were not stone cold spoilt brats by any stretch. Real tears were sobbed during the trial. Specifically, they struggled with talking and hearing of the parents injuries. It is heartbreaking to watch..

      @@Ashley__Rose Before they were sent to prison they spent 5 years in the LA County jail in which their lawyers made sure they received adequate therapy through the the entire time. If you listen to Lyle or Erik speak in interviews today I think it's pretty clear they have developed maturely and have a deep understanding of why they did what they did and how else they should have handled the situation.
