    And he paid for this attorney? Because he found the court appointed attorney ineffective? The paid for attorney can’t even speak a full sentence without mumbling and stumbling through it tho he’s had a year almost to prepare.

      You could see the defendant being reluctant during plea hearing, especially with the, "Have you been satisfied with the way you've been represented?" (3:28). I was a little shocked the judge didn't ask more questions about that during the plea hearing. Testifying could be allowed as it's verbal, while it could be found he didn't have the ability to understand a legal document due to lack of reading comprehension. I'm not surprised that his attorney couldn't articulate that, nor am I surprised that his attorney didn't decline the plea deal at the end.

      No the attorneys’ question about how long he’s known his brother wasn’t dumb at all. You’re assuming all brothers and sisters have good relationships or know each other their entire lives. There’s absolutely situations that hat are very common where the brothers know of one another but don’t hang out at all due to being raised in different households or states or different parents. That’s not a dumb question to ask a lawyer. The judge doesn’t know and you ask it to establish credibility or bias. That’s definitely a question worth asking, 100%!

      Step siblings plenty of siblings that never even met each other. I didn't meet one of my sisters until I was 19 and she was 8.... one of my brothers didn't meet 5 of his siblings until he was 18 and went to visit his mother in Mexico who he hadn't seen since he was like 5.     Ok, they need to change some things like, if you are convicted of any sex crime against a child the sentence should be minimum 10 years AND remove the possibility of Deferred. The same goes for Senior Citizens or the handicapped who are incapable of protecting themselves. Many Politicians/celebrities have voiced their opinion that this should be merely a "sexual preference" instead of a crime. We need to protect our future and make these punishment harsher than they are now.

      In the UK you get time off your sentence for an early guilty plea but sexual abuse of a child would still be prison.

    What an unethical attorney. Judge pointed out the fact she went through in detail what the plea was and he said, under oath, he understood. Even pointing this out he kept it up. Keeping him out for an extra year and running up the bill for the taxpayers to prove he was competent was totally unacceptable.

      That’s how the court works.. it was due diligence so he couldn’t weasel out of anything like he was trying to. Screw your taxpayer argument, the courts are going to be there regardless and the cost is going to be just the same. This was done by the book with the highest due diligence so his victim can have the justice they deserve. Judge Boyd doesn’t do anything unless it’s necessary and follows the law and court rules to the letter. She also has graduated law school, has been a prosecutor, defense attorney and now, Judge for many years.. I’m quite certain she knows what she’s doing. If you care more about the “taxpayers”, which, unless you live in a Brexar County, Texas… I’m certain it doesn’t affect you in the slightest, Karen. It does affect the victim, though, I’m sure.. a lot.

It was sleazy and delayed a plea deal a year. I do get what you are saying that he could come back later with it. I have nothing but respect for judge Boyd and never said anything about her.     Sexual crimes, especially against children, need to have a mandatory minimum sentence.
    The judge can have flexibility to assign a longer prison sentence but there should be a mandatory minimum number of years behind bars.
    They should also not be allowed to cut plea deals for a lower crime, often a felony sexual crime being dropped to a misdemeanor simple assault charge, which wouldn’t carry a sex offender registration, or have a record of sexual crimes.

    So tired of these predators getting light sentences. The victim has to deal with the abuse for life while the predator gets away with a slap on the wrist. I am 60 and have been dealing with this type of abuse for 50 years. Years of therapy, medication, panic attacks and attempts to harm myself. Just can't understand the courts at times.

It only dealt with whether or not Torres understood what was happening, whether or not he understood the charges, consequences, and choices to be made. Specifically, he was claiming that Torres did not understand the difference between a not-guilty and a no-contest plea. The lawyer was asking questions relating to his understanding of and his ability to understand what was happening.

    Judge Boyd catches this defense attorney out with surgical precision. He should've filed for a competency hearing -- period. Arguing IAC with an "incompetent" witness (and another who can provide nothing but hearsay) is an amateur mistake. It's almost like they're planning to argue IAC with THIS attorney!

But from what I thought I heard, he was speaking English and when speaking English, the proper way to ask that question is "Why didn't you finish high school?" When I speak Spanish I don't word sentences the way I would in English because it would obviously be grammatically incorrect. The same goes when someone is speaking English, they shouldn't word their sentence the way they would in Spanish because it is grammatically incorrect.

    When any crime involves harm to a child it should always mean automatic prison sentence and register as an offender probation or deferred adjudication should never be an option. In the unlikely event that he is successful on deferred adjudication it would mean there is no record of his crimes and he doesn't have to register as an offender.

    I didn’t graduate either! I can read but I realized some years ago I’m A.D.D and back in the 70s I didn’t learn like anyone else! I struggled an by the time I was in 10th grade math was to much for me so I quit 🤦🏻‍♀️well being that I was pregnant that came in to play lol But having a learning disability has nothing to do with what he did to a child! He’s caught and looking at prison he’d throw his own mother under the bus! Sick

    I cant stand anyone who hurts children or women. Im 61 and had a family member "hurt" me for years. It truly affected my outlook on relationships for years. I had good women that helped me through that and showed me true love and tenderness showing me what love is truly meant to be.

    Think you’re exactly right…he’s playing with the court…he’s a waste of time and money. Not sure this attorney is much better. That was a waste of time calling his sister…think they failed at what they were attempting to do. This guy has an attitude and I bet he was a crap shoot to work with….and I think he’s lying…trying to postpone this. The state’s attorney most of the time is not the best…hope she does better here. Another attempt at postponing this. This guy is smarter than he lets on….knows exactly what he’s doing…with sister’s help I believe.

    My brother in law was a functioning illiterate when he graduated high school. The school even told him that they were going to pass him even though he did not earn his grade. He had no behavioral issues, he was also an undiagnosed dyslexic. Sadly, this still happens today...

    I love that they want to withdraw the plea because of the ineffective counsel due to his supposed (then disproved incompetence) and this new EFFECTIVE counsel has him testify without having the competency hearing, priceless. Judge Boyd is so polite I would be so frustrated. Especially when they're asking for a second chance these victims never get a second chance; glad she doesn't give a break to these types of crimes.
