If this does happen to you , do your best to co -operate and be respectful to make the cops judge you on character. There is a video of a military vet who was in a similar situation and his behaviour controlled the entire encounter.

The problem is these cops are trained to go into self preservation mode for their safety. If they think you are a threat to them, they’re gonna drag you out of the car cuff you and charge you with resisting. They are dead wrong here. However, the best thing to do is cooperate, and stay calm. If they made a mistake calmly, explain to them they have made a mistake. Once they run you through the system, they will realize it and as long as you stayed calm and didn’t get aggressive, they will likely let you go.
They need to be charged for this, they arrest the wrong person, cops don't assault anyone like this, they haven't learned about what happened to George Floyd who died in the hands of police brutality by four officers. Imagine someone being arrested for no reason and they got the wrong person.

I don’t know much about the state laws where this incident took place but I do know that in my state and many others it is actually illegal to resist arrest rather it’s lawful or not. You may wanna go study the laws a little more. What they did was disgusting I must agree with that. However your logic on the law is a bit off.

The guy explained he was legally armed, didn't reach for his weapon or try resisting initially until after getting pounced upon and screaming for help... Even then he didn't really resist, he just didn't oblige them... which is his right. There really is no defending the treatment that guy received my friend. Especially after they found out their mistake, learned the gun was indeed his, as he stated... They then claimed that he was reaching... and gun gun gun was shouted... This poor dude. 25 year old single dad, grabbing food for his kids, he was probably having a pretty good day until he was dragged out of his car for no reason and brutalized. They're too lazy to double check the name on the ID matches the one on the warrant because they're not going to see any consequences for it anyway, it's just a lil more paperwork.
If he would have stepped out of the vehicle when they asked him, this would have gone a bit more humane. Also, it's usually procedure to notify the police that you are armed the first thing when you are stopped. And, what kind of registered gun owner just keeps a gun stuck in their pocket like that? If I was blessed enough to go walmart, once a month without my kiddos, it was a break. @suppaman12 I believe Mr. Hayes said he might have warrants for speeding, that was never mentioned by the officers nor part of the booking / charges. Hayes was ultimately charged with resisting arrest and unlawful possession of a weapon and held in jail for several days. The charges were dismissed more than a year later, according to the lawsuit.
They started off lying by telling their sergeant they were running plates and it came back “RED”, but they told Sylvester that they pulled him over because he ran a stop 🛑 sign. Which one was it?? Those cops 👮🏾♂️ 👮♀️ were all up by his car plotting on how they’re gonna blame him for something and make it justifiable for his arrest. This is why body cams should never be allowed to be turned off “FOREVER”
He was lawfully stopped on traffic violations and given lawful orders to get out. He resisted and that's where he created himself a criminal situation. Had he not resisted they'd have investigated and released and if not he could sue on the lack of due care and proper investigation into his name. But he never gave that chance he was too quick to give a reason to be arrested

To say he wasn't cooperative when he gave them his information during the stop is just not correct. He became defensive as anyone would when they're being asked to exit their vehicle for reasons unbeknownst to them. People always say it's resisting, but it's natural human instinct to not want to be restrained. If they had given him a reason and explained calmly without trying to pull him out, I highly doubt it would've gone this way.

It's not pinning it on him when he did infact resist. He was lawfully stopped and they asked him out the car which pensylvania v mimms allows cops to do. The problem that the cops have is that he gave them his license to identify himself. Through their incompetence, they failed to execute even the most basic functions to investigate. Pay the man and let him go. So sad.
I question whether this stop was "legit". You notice how the cop said "failure to signal within 100 feet" instead of "failure to signal"? That is a common, nit-picky tactic to justify stopping who they want. I've seen a bait car that got pulled over for not signalling within 200 feet (his state's law), and after he got all the bodycam footage and his footage and got out and measured, it turned out he started signalling at 230 feet. But the cop used the "200" feet thing to pull him over originally --- even though was actually signaling for the turn. Do you know your state's law for the distance to signal (honestly, I don't and I've been driving 30+ years)? Have you ever accurately measured whether you are in compliance each time you turn? These laws are designed to trap ordinary citizens or anyone the cops deem "suspicious". Will it hold up in court? Probably. But "legit"???

I am all for standing up for your rights, but we got to play defensive here. Resisting makes things worse and you certainly can’t argue it makes things better. Was it a wrongful arrest yes. But did resisting make it better. No. Comply. If he would have complied, he could have reasoned with them and eventually figured things out. He probably would have been released, but he fought with the police, failed to comply with their request. He found an entire new charge to be arrested. Hayes should have exited his vehicle as instructed and he would have been lawfully detained while they conduct their investigation on his identity. But he acted like a fool fought and yelled.

He's not innocent. He broke the law by refusing to get out of the vehicle. And then he resisted arrest. This is why it's important to know your rights. If he would've just gotten out of the car, they would've ran his license, seen that he didn't have a warrant, then either give him a ticket for the traffic offense or, more likely, just a warning, and then let him go. But no, he didn't know his rights, so he refused a lawful request to step out of the vehicle, and then started fighting with police. He brought this on himself. And I guarantee you this lawsuit fails. Legally, the cops did nothing wrong.

They arrested him because he failed to obey lawful commands after they stopped him for a legitimate traffic stop and then he refused to get out of the car (crime of obstruction), then when they went to detain him he resisted (crime of resisting arrest). The officers did nothing wrong. All he had to do was comply with traffic stop and he would've been on his way with a warning after they realized he didn't have warrants, or a ticket for fail to signal at the absolute worst. No judge in the country would let this lawsuit get past a 12(b)(6) motion to dismiss for failure to state a claim, and qualified immunity.

Law enforcement have incredible hubris in that they seem to double down when they make a mistake instead of owning up to it. Getting arrested or accused of a crime I didn’t commit and having to answer for it is probably one of my biggest fears.
It has to be the scariest thing ever, to be framed for something a crime you didn't do.
If this does happen to you , do your best to co -operate and be respectful to make the cops judge you on character. There is a video of a military vet who was in a similar situation and his behaviour controlled the entire encounter.

The problem is these cops are trained to go into self preservation mode for their safety. If they think you are a threat to them, they’re gonna drag you out of the car cuff you and charge you with resisting. They are dead wrong here. However, the best thing to do is cooperate, and stay calm. If they made a mistake calmly, explain to them they have made a mistake. Once they run you through the system, they will realize it and as long as you stayed calm and didn’t get aggressive, they will likely let you go.

If I was blessed enough to go walmart, once a month without my kiddos, it was a break. Hayes was ultimately charged with resisting arrest and unlawful possession of a weapon and held in jail for several days. The charges were dismissed more than a year later, according to the lawsuit.

He was lawfully stopped on traffic violations and given lawful orders to get out. He resisted and that's where he created himself a criminal situation. To say he wasn't cooperative when he gave them his information during the stop is just not correct. He became defensive as anyone would when they're being asked to exit their vehicle for reasons unbeknownst to them. People always say it's resisting, but it's natural human instinct to not want to be restrained. If they had given him a reason and explained calmly without trying to pull him out, I highly doubt it would've gone this way.

I question whether this stop was "legit". You notice how the cop said "failure to signal within 100 feet" instead of "failure to signal"? That is a common, nit-picky tactic to justify stopping who they want. I've seen a bait car that got pulled over for not signalling within 200 feet (his state's law), and after he got all the bodycam footage and his footage and got out and measured, it turned out he started signalling at 230 feet. But the cop used the "200" feet thing to pull him over originally --- even though was actually signaling for the turn. Do you know your state's law for the distance to signal (honestly, I don't and I've been driving 30+ years)? Have you ever accurately measured whether you are in compliance each time you turn? These laws are designed to trap ordinary citizens or anyone the cops deem "suspicious". Will it hold up in court? Probably. But "legit"???

I am all for standing up for your rights, but we got to play defensive here. Resisting makes things worse and you certainly can’t argue it makes things better. Was it a wrongful arrest yes. But did resisting make it better. No. Comply. If he would have complied, he could have reasoned with them and eventually figured things out. We need to think about the situation given and not the hypothetical where the cops get everything right.

He probably would have been released, but he fought with the police, failed to comply with their request. He found an entire new charge to be arrested. Hayes should have exited his vehicle as instructed and he would have been lawfully detained while they conduct their investigation on his identity. But he acted like a fool fought and yelled.

He's not innocent. He broke the law by refusing to get out of the vehicle. And then he resisted arrest. This is why it's important to know your rights. If he would've just gotten out of the car, they would've ran his license, seen that he didn't have a warrant, then either give him a ticket for the traffic offense or, more likely, just a warning, and then let him go. But no, he didn't know his rights, so he refused a lawful request to step out of the vehicle, and then started fighting with police. He brought this on himself. And I guarantee you this lawsuit fails. Legally, the cops did nothing wrong.

@@Syllabite it doesn't matter that they had the wrong person. they didn't stop him or arrest him on that other guys warrant.... They arrested him because he failed to obey lawful commands after they stopped him for a legitimate traffic stop and then he refused to get out of the car (crime of obstruction), then when they went to detain him he resisted (crime of resisting arrest). The officers did nothing wrong. All he had to do was comply with traffic stop and he would've been on his way with a warning after they realized he didn't have warrants, or a ticket for fail to signal at the absolute worst. No judge in the country would let this lawsuit get past a 12(b)(6) motion to dismiss for failure to state a claim, and qualified immunity.

Law enforcement have incredible hubris in that they seem to double down when they make a mistake instead of owning up to it. Once they realized they got the wrong guy and his gun was legal, they should have let him go. The fact they continued with the arrest just shows their egos are too fragile and they have no character.
Yeah because I know if they admit their mistake that they're going to have to pay or explain themselves to the superiors. So what they do is they add all these extra charges on him because he didn't want to get arrested like any one of us would act the same freaking way who wants to get arrested when you're innocent. I don't get how if they make a false arrest for wrongfully arrest you, anything that happens during that arrest should be thrown out immediately. Like them saying you're resisting or them saying you fought back, from what I've heard, you're allowed to resist any false arrest and you shouldn't be charged for resisting if it's a false arrest in the first place. So for him to have to wait 14 months to get the charges dropped is just despicable
