Looks like a bullhead to me. It’s tail doesn’t look forked so that rules out channel cat. It also has a more developed adipose fin compared to yall’s madtoms.
If they're not protected for breeding reasons you can practically torture any fish you want, and the illegal part is just catching them. Fish and insects have no rights, I'd be shocked if reptiles did even though you need a licence. If it's not a protected species or from a protected lake then you can do literally whatever you want with it. The government only cares about fish from an ecological perspective ((Check your local laws*))

I use to get a bunch of those same type in house of tropicals
They would come in with the feeder fish all the time
Most cat fish have a v shaped tail. Flat head cats and bull head have a more flat tail
