    He literally says he's not going to take him to jail over it, but when the driver laughs at the absurdity of that, the cop arrests him. That's pretty blatantly retaliatory.

      @@TonyHulk I, would like to make a point here, That Most Local Magistrate (Judge) do not have any training in law, other than the Political election laws. Local Magistrate are local people with NO background in the Criminal Justice system. i.e. Farmers, factory workers

      @@burlosborne3647 They are still a judge, they have to take classes, and if they serve more than 5,000 people they are required to be full-time. They have legal authority. They are perfect for these low level crimes. If the people have any issue they can appeal like other courts. Also, farmers and factory workers can very well have more legal knowledge than the police....as seen on this channel lol

      As I recall, he even SAID he wasn’t going to arrest him, but only issuing a citation. He changed his mind to RETALIATE after feeling disrespected by the citizen’s minimal exercise of his rights.

    someone close to me is a policer officer and i was disgusted to hear one day as he smugly described to us with a big smile and satisfaction on his face that he he thinks its funny when he goes to court for cases like this because he's paid to do so. He was so proud that he can arrest people and they loose their own time and money to fight it in court but he gets paid. Really grossed me out for life.

      Does this apply to all situations of flashing to warn people?
      If your family member was being abused by a gang and someone flashed their lights to warn them the police were coming, would you support that? Or do you just mean warning people about speed traps?
      Also, do you know how many children are killed each year worldwide by speeding drivers?

      @Living Art In the video he says that the law pertaining to flashing lights is in regards to having flashing lights, ie: emergency lights, on your vehicle, rather than flashing your headlights. Your sisters savior should be fine.

    I was once given a speeding ticket for sitting in traffic. I laughed at the officer because he said “You looked like you wanted to go fast!”… When that was played at the hearing, the judge, the clerk, and his fellow officers in the courtroom ALL LAUGHED at him… the judge threw out the charges and apologized. 😂

      @@Primus54 A magistrate is a judge. The only distinction is that they are given only limited authority to hear cases of a specific nature. Like traffic court.

      @@Primus54 um.. public defenders are the true heroes of the judicial system, NOT prosecutors, despite the propaganda. Of course there are crappy ones, like in any profession, but most seem to try their best for their clients despite being given an absurdly low amount per client and usually a flat fee regardless of the hours they put in. Take that vs prosecutors who have an entire police force and support staff at their disposal including lab techs and “experts”.
      And a magistrate is a “real” judge. They handle citations and traffic tickets usually but also set bail and bail conditions for individuals (regardless of crime) and do preliminary hearings after which your case will go to the Court of Common Pleas where they handle trials and the like.

      Russell Brown, I don't know about that. It setting a bad example that people cannot express that they disagree with a cop, infringing on their free speech. I understand that it's always a risk but getting cops used to people never expressing their differing opinions isn't good either. Cops already have inflated egos as it is.

    The judge gets an "F", for enforcing a law that doesn't exist. Perhaps he did that though to not give Mr. Headlights 6 months in jail. Corruption runs deep in that community.

    Earlier today Mr. Headlights Civil Rights Lawyer posted a video on his TH-cam Channel. They appealed the conviction, got it overturned and dismissed, and are now going to follow up with a Civil Rights Lawsuit. This lawyer is also in the process of digging up past unlawful arrest made by this same officer. Hopefully they’re able to expose more misconduct and win the lawsuit.

      Our officers still don't wear body cams, I have even gone as far as to let the city know how unsafe many of us feel and not because of criminals but because of our aggressive police force with no body cams, bullying the cities citizens and getting away with it because it's their words over a (guilty until proven innocent) civilian. And do they pay us back for our time or our court document fees or impound and towing cost? NO they make you pay it and if you lose your car or house or job because of them it's still the same they do nothing for their mistakes except profit, and I don't even leave my house anymore.

    As a cop, this sort of conduct is absolutely unacceptable, and embarrassment, and should be an example exactly how not to police the community you’re responsible for serving. It doesn’t matter if a person makes you personally mad, it is the individual who is a law-enforcement officers responsibility to maintain professionalism, as is expected by the community. I applaud individuals who are aware of the rights that each of us are afforded.

    What’s crazy is as a trucker we often flash our headlights to let another truck or car it’s okay to pass us or move in front of us. I never knew some cops thinks this is illegal. We do it to communicate with other truckers or drivers.

      The code is clearly referring to additional equipment beyond factory. However, it's just vague enough that they can interpret it however they see fit. Many state laws are this way and haven't changed for centuries. This stems from corrupt political figures.

      This cop was shot in the leg and his partner was killed in a CRAZY gunfight with two men only a couple months prior to this traffic incident. No way he's getting fired. In fact, his department probably wasn't surprised by his behavior. So I put some blame on his department for letting him back on the streets so soon after such a traumatic incident. PTSD is no joke. Not excusing the officer's behavior I'm just saying in the context of PTSD it does help explain the overreaction to this situation that happened shortly after this officer went back to work after recovering from being shot. Hopefully, the officer is getting the proper mental care he likely needs but I won't be surprised if he isn't.

      My town used to pull over and cite people for doing that. They had set an unmarked vehicle before a checkpoint or a traffic enforcement and upon seeing a vehicle flashing their lights to signal incoming drivers, they would pull them over. Multiple drivers took that to court and they ruled it unconstitutional.

The issue here is that he was cited for flashing his lights, based on a law prohibiting flashing lights on a vehicle. Two completely different things, and a good judge would know that. The law is clearly intended to keep citizens from putting emergency type flashing lights on their vehicles, not from flashing or using their highbeams. Horrible cop and even worse judge that would rule against the driver here.

      Isn't there case law which deems it unconstitutional to prolong a traffic stop beyond the time necessary to fill in the citations and hand them over. The papers were already in Mr Headlights' possession again and the cop clearly meant to hand over the citation and release the driver. Hence a violation of the fourth Amendment was created.

You can get pulled over and have the cop check that he suspected you committed a crime, conviently targeting minorities. That a White man got pulled into this mess and tucketed is an accident, not the cause. There would be no way to disprove that the cop thought a Black man had an unsigned registration. It's just another way police abuse minorities. That is almost all of the reason we have these types of laws.

They can search and seize anything under any presence and since all it takes is an unsigned registration, I can guarantee that 90% or more of tickets issued for it are from minorities. Of course police will never release that data. And the idea that you can be arrested for not signing it? Yea... that is just prison profiteering.

    Fun fact: Magistrates in West Virginia are not required to have a law degree. It appears that not only do two of the three Nicholas County magistrates not have law degrees, but both of those magistrates are former sheriffs. The magistrate that heard the case, Michael Hanks is a former cop with no law degree. This guy never had a chance, and needs an appeal in front of a real, unbiased judge who knows the law and understands how to read a statute.

      @@ericmoreau4568 In West Virginia, magistrates, the judges you would find in a district court, are elected by the people and only need a high school diploma. They receive a "course of instruction in rudimentary principles of law and procedure" before taking office. A 1L in law school receives more education than these magistrates. A circuit court judge on the other hand must be an attorney in good standing with at least 5 years experience. Edit: Bear in mind that all of this varies from state to state. I'm referring only to WV.

    The most hypocritical thing about the entire situation is by the man flashing his lights, he's essentially telling everyone to slow down, which seems safer for everyone...Simply because cops are forced to make a quota of tickets every month, causes this officer to get annoyed that this man is possibly lessening the amount of tickets this officer may be able to write using the speed trap.     I live in a rural area where people routinely flash headlights at other drivers when there is a dog, cow or some other animal in the road. It's an effective way of warning people that there is some hazard ahead. Not only for speed traps.

      Cars driving w/out (head)lights on has been the primary reason I've flashed people. They can be a dangerous thing, cars driving dark, & most people who've done it don't realize their lights are off (due to streetlights, or they've only been driving a couple minutes) & that they're a hazard to other drivers.

    There’s no “Justification” to what he did and the officers “state of mind” here should be relevant, and should, in this case, invalidate the arrest. He was going to let him go, and then arrested him for his speech, or laughing at the officer, bruising his ego. And it doesn’t make any sense that the court decided to drop the charge that he was LAWFULLY arrested for and instead convicting him on the charge that was found to be unconstitutional in another districts proceeding. Shame on the justice system in this case. SHAME

      Based on what’s made clear in the recording, common sense says this was an abuse of power on the part of the cop. More disturbing is that Mr. Headlights was convicted. That shows a deeper level of contempt for the law and citizen’s rights on the part of those sworn to protect it.     NEVER go in front of a Magistrate. They aren't even required to follow the law, and 100% of the time will side with the cop.

    The only reason he lost that case was because he represented himself. They like to punish you when you don't participate in their dog and pony show the exact way they want you to. It's why even lawyers get lawyers.

      Very well put.The legal system is a closed shop where lawyers think they own the laws and courts themselves and don't want Joe public, with a modicum of intelligence, representing themselves in court.The courts are there for the lawyers' benefits and their protected interests,not for the public's interests, in many cases.They can't charge nice fat legal fees if every lay person defended themselves and the legal system through the Law society can't and won't tolerate that!

      Very true. It's a system that checks if you have money or not and if you have a decent amount then you can have some rights and be treated fairly in court. Or like you said you fail their dog and pony show so you get punished.

    I have looked at my registration for my state and there is no place to sign it. Also, 6 months in jail for not signing a piece of paper is ridiculous. Officer crybaby didn't even give him a chance to sign it. I would love to see an update of this because this man clearly has a lawsuit against the department.

    Yesterday while driving with my 13 year old, a vehicle in oncoming traffic flashed their high beams. I checked my speed and I was already going under the legal limit but I knew what the signaling meant. I told my son what was going on and how the other driver was giving us a warning. sure enough, 1/2mi down the road, a speed trap was in place. When I went back in the opposite direction , I paid it forward to other drivers and flashed my high beams. I told my boy, "it's what we do."

      Law get changed periodically making it challenging for cops to enforce laws that may have been amended or revised. Besides that cops are not lawyers it's up to offenders to argue their case in a court not with a cop.

    He literally said he was only citing him, and then when he laughed at how ridiculous it is to spend six months in jail for such a small offense (which he took as laughing at him), he then went from a citation to an arrest.

      I just watched a video about this on the Civil Rights Lawyer's channel. He helped represent this guy in appeals court.
      One thing I just learned from the video is that in a majority of US states, a magistrate judge (which is the type of judge you see in matters like these; like a district court judge) doesn't need a law degree to sit on the bench. In some states- all he (or she) needs is a HS diploma.
      That's scary as SHIT!!!
      Once it went to appeals court, (where there's a qualified judge) they didn't even get through the corrupt cop testifying and the REAL JUDGE stopped the trial dismissed the charges.

    Here in the UK, we flash our lights to 'let other drivers go' if they are waiting to turn or pull out, etc. we also flash to 'thank' other drivers for letting us have the right of way, pull out or turn, even with police, and they do it back. Its a form of communicating.
    So weird that this is illegal.
    We also drive around with constant high beams at night if in a poorly lit area or on country roads, and its not a problem, when cars are coming towards us, we just switch them off quickly so as not to blind the driver and flick them back on.

      And he's actually getting people to slow down. Aren't speeding tickets supposed to be a deterrent for speeding? You issue a speeding ticket so that people will be less likely to speed, thus safer on the road. Flashing his lights also gets people to slow down.
      This just proves that it's not about keeping people safe on the road. It's about power and money.

      Tribalism (in this context) is the collective "all cops are evil" thinking, which is just factually wrong. One decent cop = your position is dismantled, and there are plenty of responsible law enforcement officers around the world. I'm not denying the presence of bad ones but insisting that they are all bad (the small brain tier thinking known as tribalism) will ultimately hurt the cause of improving the situation.

    Gotta love the cagey way he cited the statute when giving him the ticket. He knew he was full of shit and was hoping the guy was too dumb or passive to argue it. Why do cops have to do this to normal people?
