If Kari did her job and JUST her job from the start, none of this would've happened. From the HGR case she was unprofessional, refused to act like an adult, and the judge gave her almost the whole rope. She decided to hang herself with it in the Baldwin case, and frankly I'm SHOCKED that she's not being sanctioned yet.

The really sad thing about this stupid motion, is that I was still partially on her side before this. When this went down at the trial my opinion was that I didn't think the state had necessarily hidden anything intentionally and I also agreed that the rounds were likely irrelevant to Baldwins case. That said, I was fully in agreement that dismissal was the appropriate outcome. Someone made a mistake and Baldwin benefitted from that, sucks if you believe he's guilty but humans are fallible and it is what it is. I thought her choice to testify was odd and risky, but the cameras were on and I figured she wanted to explain to the internet that she wasn't trying to do something nefarious (and I still believe if the state was trying to hide evidence to harm his case they'd have hidden something far more significant than rounds that were never on the set). At this point, the case has been dismissed with prejudice. Even if she disagreed with that, what law is she relying on to be able to file anything at all to try and 'un-prejudice" it? If prosecution just says ok we will only charge on count 2, you don’t have to go through the appeal process, doesn’t that mean the prosecutors could still bring charges until the statute of limitations would end?

Years ago just 26 miles from here, three young men under 18 were having a drinking party. Another fellow dropped in and when the three told him he was to go buy some more booze, he said no, so the three, who were pretty much stewed beat the 4th to death, then decided to cover it up. So they loaded the body in the back of a pickup truck and headed for a neighboring State, some 8 miles South of town, after crossing the State Line, they thought they heard noise in the back of the pickup so stopped on the side of the road where they beat the fellow with a tire iron (after crossing the State Line) then continued to a near by lake where again to make sure he was dead, they took a rifle and shot the kid in the head before dumping his body in the lake. They were caught and like the idiots they were they quickly turned on each other. The trial was held in the State where the first beating was done. By the time it was over the County was bankrupt and needed to be bailed out by the State. The boys were convicted as adults and are still in Prison after over 20 years have gone by.
Aren't there other cases she can take and destroy as well? Like why keep on Baldwin when there other cases out there still ongoing and not dismissed with prejudice?

I am curious about an idea pushed again and again by Andrew Branca: that it is completely irrelevant to his criminal culpability how a live round ended up in his gun. It could be due to Hannah, it could be due to Kenney, it could be due to aliens. It could be willfully malicious sabotage, it could be pure accident. However it got there just makes no difference legally to any element of the case against him. The claim is that he is responsible for a failure to follow basic gun safety rules that he knew -- rules that exist *precisely* to prevent harm in the unlikely event a live round winds up in the weapon -- and that someone died who would not have died if he had exercised due caution in handling a dangerous weapon. You can see this clearly if you imagine two hypothetical scenarios, one in which there was sabotage, another accident, but in which evidence available to Baldwin was exactly the same. How could he be guilty in one and innocent in the other? His culpability depends on whether his actions were criminally negligent (=reckless per NM case law) given what he knew and believed and did on that evidential basis. It is true that there is a causal requirement for involuntary manslaughter -- his actions must be a proximate cause of death without any unforseeable intervening cause. But objective facts entirely unknown to him about things that occurred *prior* to the causal process he initiated through handling the firearm cannot affect his guilt or innocence. Morrissey's motion includes this argument, but it is rather buried amid the rehashing of the saga of the rounds and evidence. And the she was never presenting her case on the Branca basis, according to which she didn't even need to call Kenney or to present any other evidence about the source of the live rounds. And the judge was also not constraining the trial on the Branca premise. But ... why not? It seems a reasonable point to me. What is wrong with Branca's argument here?
Finally, a well though out comment amongst a thousand ‘I just know…’. The issue that hasn't been brought up is a comparative negligence of sorts. In prosecuting Baldwin it might’ve come up as intervening cause; how many times had Hannah previously loaded Baldwin’s gun with live rounds and he either didn’t cock and pull the trigger, or he lowered the hammer slowly and did not set off a live round. Perhaps he did so, and only 1 of 6 rounds was live and he dented the inert primer dummy round. Had Baldwin been prosecuted in a focused he would’ve been convicted. What are the odds that this was the first time Hannah loaded one of the guns with a live round. Sooner or later someone was gonna get shot, the live rounds had been on set for at least 11 days before one finally went off. The issue is that Baldwin took the gun from Halls, a person not authorized to handle guns on set, and then pointed it at people and went off-script for an insert shot. Only Baldwin knew where he was aiming, Halyna and Joel were looking at the monitor and the angles are difficult to extrapolate when you’re thinking of lighting, and framing the shot.
The thumbnail confused me so much I had to click on the video to find out what it was supposed to mean. Success? Only a few minutes in and I wish the judge from the Baldwin trial could be put in charge of the Karen Read trial.
I cannot imagine a live round being used on a movie "set" outside of a limited access closed set where you were filming for the bullet hitting a target to be edited or green screened into a scene.
I think that they knew about them, but not what they may have or how similar they were. Also, I don’t believe the defense is under the same responsibility of disclosure that the prosecution is compelled to follow. Found it interesting that she backed up nothing she said with actual law, for over 50 pages.

Has nothing to do with Rust, and you’ve got the basics wrong. A legal dispute of over firearms ownership is a civil matter. Had he done something illegal it would’ve been a criminal issue, which is was not. The guy is collateral damage in an easily prevented tragedy. Hannah was using 5 different drugs that prohibit her from buying firearms, and handling them on a movie set. If the Feds find out she’ll get locked up for 2+ more years for lying about her drug use when she purchased the gun she got convicted of carrying into the Santa Fe bar. She’s the primary reason Halyna is dead, and Halls certainly fed up…Baldwin took the gun from Halls, a guy that is not authorized to handle guns on set and did what he did.

It sucks when the guilty go free, but you just need a strong reasonable doubt and she should go free. Halls, yes. Sarah, no. Halls had a duty to check the dummy rounds with Hannah, and he was not authorized to handle guns on set. Baldwin should’ve have never taken the gun from Halls, only an authorized member of the props department. Sarah’s only mistake was throwing out dummy rounds from Jensen Ackles’ gun, a panicked reaction. What would you have the prosecution do, charge her with evidence tampering when it was irrelevant to what was loaded in Baldwin’s gun? She also admitted to what she had done to Hancock, and they found it not material to the criminal cases. On days there was to be blank gun fire she worked as the Armorer and got paid a higher rate. When there was no gun fire, she worked as the Assistant PM.

If the evidence from that hearing is not conclusive for the prosecution, then allow a recall of the jury to pose the same basic issue: Did EACH OF YOU acquit(vote not guilty) on any count and, if so, which ones?

So they loaded the body in the back of a pickup truck and headed for a neighboring State, some 8 miles South of town, after crossing the State Line, they thought they heard noise in the back of the pickup so stopped on the side of the road where they beat the fellow with a tire iron (after crossing the State Line) then continued to a near by lake where again to make sure he was dead, they took a rifle and shot the kid in the head before dumping his body in the lake. They were caught and like the idiots they were they quickly turned on each other. The trial was held in the State where the first beating was done. By the time it was over the County was bankrupt and needed to be bailed out by the State. The boys were convicted as adults and are still in Prison after over 20 years have gone by.

I am curious about an idea pushed again and again by Andrew Branca: that it is completely irrelevant to his criminal culpability how a live round ended up in his gun. It could be due to Hannah, it could be due to Kenney, it could be due to aliens. It could be willfully malicious sabotage, it could be pure accident. However it got there just makes no difference legally to any element of the case against him. The claim is that he is responsible for a failure to follow basic gun safety rules that he knew -- rules that exist *precisely* to prevent harm in the unlikely event a live round winds up in the weapon -- and that someone died who would not have died if he had exercised due caution in handling a dangerous weapon.
You can see this clearly if you imagine two hypothetical scenarios, one in which there was sabotage, another accident, but in which evidence available to Baldwin was exactly the same. How could he be guilty in one and innocent in the other? His culpability depends on whether his actions were criminally negligent (=reckless per NM case law) given what he knew and believed and did on that evidential basis. It is true that there is a causal requirement for involuntary manslaughter -- his actions must be a proximate cause of death without any unforseeable intervening cause. But objective facts entirely unknown to him about things that occurred *prior* to the causal process he initiated through handling the firearm cannot affect his guilt or innocence.
Morrissey's motion includes this argument, but it is rather buried amid the rehashing of the saga of the rounds and evidence. And the she was never presenting her case on the Branca basis, according to which she didn't even need to call Kenney or to present any other evidence about the source of the live rounds. And the judge was also not constraining the trial on the Branca premise. But ... why not? It seems a reasonable point to me. What is wrong with Branca's argument here?
Finally, a well though out comment amongst a thousand ‘I just know…’. The issue that hasn't been brought up is a comparative negligence of sorts. In prosecuting Baldwin it might’ve come up as intervening cause; how many times had Hannah previously loaded Baldwin’s gun with live rounds and he either didn’t cock and pull the trigger, or he lowered the hammer slowly and did not set off a live round. Perhaps he did so, and only 1 of 6 rounds was live and he dented the inert primer dummy round.
Had Baldwin been prosecuted in a focused he would’ve been convicted. What are the odds that this was the first time Hannah loaded one of the guns with a live round. Sooner or later someone was gonna get shot, the live rounds had been on set for at least 11 days before one finally went off. The issue is that Baldwin took the gun from Halls, a person not authorized to handle guns on set, and then pointed it at people and went off-script for an insert shot. Only Baldwin knew where he was aiming, Halyna and Joel were looking at the monitor and the angles are difficult to extrapolate when you’re thinking of lighting, and framing the shot.

if Baldwin's lawyers spoke with Tesky before trial, everything he said could be argued in the hearing. The problem was, it the state had already been caught lying under oath, and they had no chance to recover their credibility.

Has everyone forgotten that Seth Kenney had/has other legal cases against him? Ones involving him most probably stealing firearms from previous employer(s). How he was not investigated thoroughly in the beginning *and* everything he said was just automatically believed by law enforcement and Kari is beyond me!!!

Has nothing to do with Rust, and you’ve got the basics wrong. A legal dispute of over firearms ownership is a civil matter. Had he done something illegal it would’ve been a criminal issue, which is was not. The guy is collateral damage in an easily prevented tragedy. Hannah was using 5 different drugs that prohibit her from buying firearms, and handling them on a movie set. If the Feds find out she’ll get locked up for 2+ more years for lying about her drug use when she purchased the gun she got convicted of carrying into the Santa Fe bar. She’s the primary reason Halyna is dead, and Halls certainly fed up…Baldwin took the gun from Halls, a guy that is not authorized to handle guns on set and did what he did.

It sucks when the guilty go free, but you just need a strong reasonable doubt and she should go free. I'm sure you were just using a "turn of phrase", or even do believe she was fully innocent and set up (a very likely thing!) but not required.

Halls, yes. Sarah, no. Halls had a duty to check the dummy rounds with Hannah, and he was not authorized to handle guns on set. Baldwin should’ve have never taken the gun from Halls, only an authorized member of the props department.
Sarah’s only mistake was throwing out dummy rounds from Jensen Ackles’ gun, a panicked reaction. What would you have the prosecution do, charge her with evidence tampering when it was irrelevant to what was loaded in Baldwin’s gun? She also admitted to what she had done to Hancock, and they found it not material to the criminal cases. So she throws out something that wasn’t hers to throw out, something that’s worth $12

Second, Hannah was not forced to work as the Assistant Prop Master, Hannah wanted the additional three weeks of work as she was focused on getting hours to join the union. If she wanted to only work as the Armorer she would’ve gotten just over 10 days. Hannah chose to work as the Assistant PM and got another three weeks. On days there was to be blank gun fire she worked as the Armorer and got paid a higher rate. When there was no gun fire, she worked as the Assistant PM.
