Hi Gerry, If a family member died from sepsis… Can the family sue the doctor(s) under Survivorship (cause of action) in NY state for the pain + suffering their loved one endured?
@@Kelly55216if I’m not mistaken normally within a month…but if you have liens with treating doctors or loans that were taken out it can take a bit longer
@@Kelly55216 The short answer is...it depends. Depends on whether this is from a private insurance company, a private individual, a municipality, a state, whether this is a wrongful death case or a case involving a child.
You mentioned records Gerry. If I signed 3 Hipa forms and got a fraction of my records from my previous doctors, but obtained my records on my own and still incomplete wouldn’t they be hiding something? Beside the phone number you provided how can I reach you to discuss my case? I’d like to walk on the beach again one day also. Thanks Mr. Oginsky

In a wrongful death case in NY we not only sue for wrongful death but for pain and suffering the person endured prior to their death.
