Centre has given the nod to increase the marriageable age of non muslim women in India to 21, meanwhile Muslim women are legally allowed to get married at the age of 15. Two different laws for two different religious communities in a secular nation. Where the state is separate from religion.

Very unfair and one -sided analysis of the UCC. Why SG didn't talk about why UCC still doesn't exist? Wasn't that a result of vote bank politics of another era? Current govt is picking up this matter for an election year but at least if implemented it will help millions of oppressed women of our country. UCC should not be uniform, which will kill the diversity of our country, but at least as a mature civilized society we should be able to dismantle these kind of archaic laws for the betterment of our citizens.

    SG's awesome logic
    1. Secularism, equal rights, democracy, compliance with constitution etc are sole responsibilities of Hindus
    2. Muslims must be allowed to enjoy special privieledges even if that is not allowed in Islamic countries.
    3. Islamic law is above Indian constitution.
    4. If you ever raise this, then it is nothing but polarising technique.
    5. Although we have elections every year, you can't talk about this and it will be called vote bank politics suitable for hindu fascist population.
    6. SG has not told this but it can be inferred from his logic, Muslims have rights to demand other benefits prescribed by Sharia laws. A good starting point could be Jijia tax for non-muslims in muslim dominated districts, no legal action if muslim commit any type of crime against kafirs.

Will not comment on other topics, but in this particular issue I believe it is important to contrast and compare with Pakistan and perhaps even Bangladesh, given that these three socities have the same origin and share a large portion of their history. Also, the same sets of people play the role of majority or minority in these countries - with their roles reversed between India and Pakistan/Bangladesh. So, when discussing these kinds of issues in one of these countries, the situation of the same issue in the others is not irrelevant. In fact, it is important to analyze and understand the situation in our neighbors because the parties involved in one country so often try to point to the situation in the other if it benefits their argument.

Monogamy is the right way to go, so no one is looking at Muslim men, their polygamy laws with any jealousy,
Point is that we look at these laws, and we wonder, why are you creating parallel laws there? Its an issue of principle. When all laws are equal for all, then what is the purpose of Muslim personal law?

I know for a fact that most Muslims talk to their clergy to get legal advice on their personal law matters. So, even if Uniform Civil Code is introduced, they may ignore it and continue to take the advice of their clergy. Heavens won’t fall.
Implementation of Uniform Civil Code, (not Universal Civil Code), is in compliance with the constitution of India. Why object to it just because congress had no guts to do it, and BJP gains political mileage out of it?
Incidentally, this matter is in the concurrent list. The States can amend the central law, to suit their State’s needs. There will be no constitutional crisis.
Live-in relationships too need a legal framework for settling the disputes between the partners. Right now, the courts are deciding such issues on the basis of contract law and good conscience.

    1. UCC will not affect freedom of religion and core religious practices but will affect areas of inheritance, equality of sexes, marriage and other civil issues. 2. While UCC get implemented, someone may chose to forgo its benefits and follow his or her religion prescribed rules but if the matter comes up before the Court, only UCC will be implemented. This will remove objections to UCC and leave the freedom to accept it or not to individuals. 3. Beyond this there is nothing in UCC; it is not against minorities; it is not because Hindu Code Bill is implemented but not for other religions etc. But in general, women from all religious groups will benefit from UCC. 4. Whether UCC is a part of Directive Principles are not, it is time to legislate on UCC and finish off one of the long pending issues.

  • @himanshubhaskar9797

I think a step by step approach is more feasible... We can start by raising the marriage age for all communities to a common number.
Then we can create common inheritance rights for women so as to make them comply with article 14 and 15.
These are low hanging fruits which have support in most of the society...

    "POLYANDRY IN TIBET
Tibetans, Sherpas, Ladakhis, Mustangese and other Himalayan peoples in remote areas still practice polyandry, a custom in which a woman can have two or more husbands.
Polyandry usually involved a woman marrying all the brothers of a family - the eldest brother chose and married her, after which the younger brothers automatically became husbands. The elder brother was the master of the household, and the younger brothers had rights only when he was away. Sometimes a woman would marry a father and son.
In Ladakh and some Himalayan Tribes in other parts of India, polyandry was officially ended in 1941 with the "Buddhist Polyandrous Marriages Prohibition Act." Earlier Ladakhis felt "Polyandry was good for Ladakh because it was a poor region and it kept the population from growing too large. They were made to feel ashamed of their traditions after the Act was introduced." After the act was instituted the population started growing at a rate of 16 percent. Today the economy is growing in Ladakh and so is the population.

Have been waiting for a CTC episode on UCC for a very long time, but am not better off at all at the end of this unfortunately. Would have been interesting to know specific major implications for Muslims AND Hindus.
Everyone in the country now seems to be an expert on triple talaq and polygamy but wouldn't there be other important implications? I live in the Middle East and am aware that as per Shariah law, Muslim women are entitled to a lower share of inheritance compared to men. But the practice amongst Hindus (Hindi speaking region at least) is that women hardly get anything (if at all) as inheritance from their parents. Will that change post UCC? As of now, a Hindu marriage is a contract as long as we have performed the ceremony around the agni. Will that be binding post UCC?

I was thinking that BJP just need to initiate the long delayed census (21) to create enough polarisation to win the 2024 election. Not that census is bad, but the anti-BJP side will probably come up in arms connecting it to CAA and NPR. Not allowing census to happen in itself should be sufficient to amplify the suspicion between various communities and will create necessary polarisation for BJP victory. UCC could then be parked for 2029, in time for Yogi’s coronation.
