What should be my next addition to the Gator collection?
A gator helmet. Make a helmet with the same, how do they call it, the strap or whatever, and with some holes. And put styrofoam in it so it would actually protect you.

They're ups and downs are extreme compared to other shoe companies. I can see why they sent it because they're probably developing gloves.

It's just a legal thing, basically if they let it slide that you used their name and logo once, the next company that does the same can hold up your case and say "see, they're not defending their brand" and they may win their case and get to keep using the name and logo, and/or the name and/or logo can fall into the public domain, which would be bad for their business
You can't use a company's name and logo even if it is an unnecessary invention.

"Defending your brand" shouldn't even be necessary when there isn't actually a threat to your brand. It only needs to be defended when there's a threat.
There are no good reasons for this stupidity, only legal reasons. The current laws behind the current systems of Patents, Copyrights, and Trademarks are just stupid.
And don't even get me on how not a single legal entity seems to even acknowledge the concept of "Fair Use".
If there were a video game called life, getting a cease & desist letter would definitely be an achievement.

Years ago I bought a domain called paypalscraps.com with the idea of turning it into a kind of gag site where I would ask people to send me the leftover change they have in their paypal accounts. I got a C&D letter from paypal before I even had time to code the first page.

From what I can find, the CROCS trademark only applies to kneepads, sunglasses, luggage, and footwear. Can they actually stop him from calling them CROCS?
More just them flexing their corporate muscles I think. I'm pretty happy to have changed the name being able to build out whatever I want at this point.
As long as he is not trying to sell them or convince anyone they are actually made by CROCS, no, they can't. It isn't even a parody issue, since that is copyright not trademark which is what this C&D is concerned with.
@@UnnecessaryInventions companies always go this route even if they have not even a 0.0001% chance of winning a legal fight, they gamble on the other side being scared enough to just back out, wich in my eyes should be illegal to, if they do that to scare of people of using specific names shapes although they have no legal basis to do so , they should get punished for using such practices

Hey just some advice, do NOT use latex gloves when using the resin, it can actually go through the latex. You need to use nitrile or other non latex gloves.

I looked up parody under trademark laws “In legal terms, a parody is a literary or artistic work that imitates the characteristic style of an author or a work for comic effect or ridicule. It is regarded as a criticism or comment on the original copyrighted work. In simple terms, it has to convey to the audience some type of message about the original work.” So from what I’ve see in the video it is covered and that they wouldn’t be able to take any legal action. I mean they probably would still try, but technically it is covered.

Inb4 you get a C&D from Gator Grip. It's an actual thing already and has been around for decades. The irony is that it, like the glove, it also fairly useless.
"First sale" covers the reuse of the genuine rivets. They actually didn't have a case if the rivets were original.
I love the fact that this would have cost them a fortune. Lawyers are the only winners here.
Out of curiosity, how much money do you usually spend on each project (including prototypes)? The 3d printing materials alone are pretty expensive already :O
The printer is expensive, the plastic is CHEAP. 100$ of the wire or the resin will last you a LONG ASS time.

1:35 Wait it only cost $13.50 to 3D print the WHOLE thing? Whattt is 3D printing always that cheap?
Once you have the equipment/printer, the filament isn't very expensive. But it was also printed on a $2k machine. So higher start up costs but low cost per part.
I have a spreadsheet that calculates all expenses (with everything including stuff like lcd wear and power costs) and this actually came out to $35. But If you try to get it done from a service they'd charge you about four or five times that much.

You should make a hand the size of the gator grip with a hollow space that you can put your hand in. Like a big version of your hand

That was more like advertisement than a cease
The problem with crocs jumping on the band wagon and not sending the cease and desist is that if they don’t take steps to protect their trademark they risk losing it to genericide. It’s not that they want to flex their corporate mussel it’s that the way the law currently works they have to or risk losing their trademark!
That was the point of the whole preamble of that cease and desist before they actually told you to stop. Basically lawyers talk for “man we don’t want to do you like this but dat’s the rules, so sorry man don’t hate us.”
The other thing in that letter that it sounds like you might have missed or misunderstood is the part about trade dress. That was not talking about the buttons with the croc logo that would still be trademark at that point. Trade dress is the style itself being associated with the brand and trade dress protection is much much harder for a company to get than trademark protection, any company with trade dress protection is going to defend it vigorously!
A classic example of protected trade dress is the old style glass coca-cola bottle. Even if it did not have a logo on it many people will associate the shape of that bottle with the brand coca-cola.
However it sounds like they are not actually interested in giving you a hard time and just want to do the bare minimum to make sure they don’t fall prey to genericide.
