The scary thing is that a lot of startups work this way. They make big promises, and internally hope that they can be fulfilled. Holmes got in way too deep and didn’t know when to abandon the sham, before legal liabilities started to stack up.

Holmes took the stand in her own trial. A client taking the stand is risky and a desperate move. We don't know if it was her lawyers' idea or Holmes's but I think the reason they went with it is because they were hoping Holmes's manipulation would work on the jury. Thankfully it did not.

It amazes me how many times they let her get away with "I don't think so" to something so basic and important as "Did you ever enter into a partnership with Walmart?" How can she not know or not be sure?! That would've been among the biggest partnerships she could've ever made.

O hear ya, but what else can they do, though? It would be only a waste of time (thus money) asking the same question to hear the same answer? I wish she'd atleast relax her eyes & blink at a fairly normal rate. By now she's GOT to know how much it creeps us out. And that constant affirming head-bob thing. Pls do know I agree its FRUSTERATING. I mean she's either lying or showing what a woefully incompetent she is as to...like you pointed out...not know the answers to basic knowledge of her own company. In other words..her lies are making her look worse than what she probably realizes.

No one has commented on the most intriguing part of this. Elizabeth's entire career was based on using her female leverage to get ahead. But the leverage was completely neutralized by this highly intelligent women questioning her. I firmly believe Elizabeth had never encountered a smarter more aggressive woman during her lifetime. She clearly isn't comfortable being drilled by another woman. I'm sure this was a calculated strategy and it was the beginning of the end for Elizabeth. I'm sure Elizabeth was screaming inside that another woman was squeezing her nuts. Easily this deposition is the first time Elizabeth has been on the defense of another woman.

One thing that never seems to get told is that she didn't get thrown initial investment money because her presentations all over town were wowing people. It happened because her daddy dug into his Enron-executive rolodex and started calling super-rich people to ask them to invest. These are the kind of people who make $80 million a year on their investments. With that kind of money coming in, throwing $5-$10 million at Theranos is no big deal and if you take a loss on it 8 years later, it's a tax write-off that actually works for you. That's why it kills me that she was found guilty of fraud against a bunch of super-rich old guys that are so loaded that they don't even miss the money at all but she was found not-guilty of hurting innocent medical patients. What a bunch of jackals that jury is, I hope they realize this and feel like crap about it. I say shove them in front of a camera and make them explain it.

1:10:02 when she answers this question she has revealed subconsciously she is performing her role in talking with a prospective investor. "That's a great question" comes out as an uncontrolled reflex filler but somewhat muted as if she knows it's not suitable in the context of the situation. At 1:21:20 the discussion of the "null protocols" begins. I am certain Holmes knows right there Theranos has been found out but she invents a fantasy that it's about a QC procedure. It's significant that her counsel jumps in to try to help her out. Her telling answer was in replying that if a machine was programmed to give a result it would give a result. My take is that if it had null protocols, it was indeed programmed to look as if it were fully functional but in fact it wasn't.

This case is a great example of the glaring disparity in sentencing. She got 11 years at a minimum security playground, and is estimated to only actually serve 9 before she is released. The crimes she committed are very serious, historically large thefts and fraud. I work for a law office and we routinely have clients serving 5-6 years for beating someone up, or violating parole for a drug charge... but putting my subjective experience aside, a quick search of cases shows *the same court* that sentenced Holmes gives out sentences like 3 years for motor vehicle theft... Not that I am minimizing gta, but I would say stealing a car worth $20,000 - $40,000 is not nearly a fourth as serious as defrauding people out of $800,000,000

It would be very unfair if they reduce her sentence when so many young single women with very young kids sit in jail for 5 years or more while their kids are sent to foster care while Elizabeth has a rich partner and both her parants to care for her 2 children. I sincerely hope that she gets to serve atleast 9 years in the Federal jail.

EH is putting on her best "poor pitiful, innocent me" face but she's getting destroyed. These depositions were just the formality before the conviction. Holmes is a psychopath and is exactly where she belongs today.

If you can manage to watch all of her depositions this facade breaks up many times. It's hard to pull that off for the many hours she was deposed. At the start of each video she starts in a low voice but as the pressure builds her brain is firing off so fast that she can't focus on her voice. Brain starts losing so many cells that by the end one is on top of the other giving CPR.

1:14:00 I wonder if when she finally realised that the machines couldn’t run the tests (if she actually did ever finally realise that) if at that moment she had just of admitted that to the investigators, accepted defeat, closed the company and filed for bankruptcy (as she wouldn’t have been able to pay the investors back) if she would have gotten away with it? 🤷‍♂️

I sincerely believe when she began all this, she genuinely wanted to help people. She’s obviously smart but quickly got in over her head. Instead of just saying “this isn’t working, perhaps I should revisit this in a couple years” she kept going. Because of greed. Tale as old as time. For me, this isn’t about her incompetence and greed though. It’s about the thousands of people who relied on this faulty testing that she medically assaulted. That to me, is what makes her a crappy human.

It's not the technology it's the purity of the blood being tested simply not possible. How smart can she be?

I agree that I think she started out with good intentions. I think she really believed her product could someday work if she hired the right people. I also think Sunny, an already successful and experienced businessman when he first met her, convinced the inexperienced Elizabeth that a little bit of fraud is just the nature of Silicon Valley. That "fake it till you make it" culture is perfectly normal and expected. I think she convinced herself it wasn't a big deal & she really believed that until things started looking bad for her legally. It's probably true that white lies are expected in Silicon Valley, but you really can't do that in healthcare.

Elizabeth Holmes is the type of human expects something in return. Her goal is being billionaire, wealthy power and famous. Even though Her prototype idea would have revolutionazed the healthcare care industry and aid thousands of patients, she has other intentions. Once she could not make it work. She cut corners and endangered people's lives with her test. Remember thanks to whistleblower, Holmes was caught soon. It could have been worse if no one would have reported of her fraud. I believe If Holmes had finished her bachelor and pursued chemical engineering graduate studies. She would have accomplished and made her prototype worked. She replied on others to accomplish her dream since she didn't have medical or engineering knowledge. Without medical knowledge is hard to keep a direction.

@@nancyleehampton8 nah, women can spot a woman BSing from a mile away. The simple fact is, men will always give a woman some form of deference....this is why she only kept men on her board of directors and in her immediate inner circle....and in here in the SEC deposition, they had the female attorney, which Carreyrou identified as Asian, on his podcast, to do most of the questioning. She is not someone Liz could easily manipulate.

Agreed, everyone loves to hate on her cause it seems to be the popular thing to do. I think she believed this would work EVENTUALLY, hence faking/lying till you make it and the end justifies the means. I never thought using a drop of blood would be able to do so many tests because I’ve worked as a nurse and been around labs 20 years and see the amount of blood it takes for certain tests, 3-4 vials for certain ones and just a large drop for others, so I was surprised when I saw a company that has actually figured some of this out this year (forgot the name but everything has been validated and done the correct way). I’m almost more in shock over her Stanford advisor, who worked in biochemistry his whole career immediately getting on board without telling her this concept isn’t possible at this time, AND the fact the board of rich powerful men not insisting on having anyone with any biochemistry/medical expertise involved on the board. I think she worked extremely hard, if only she had used this hard work and energy on something that could work
