    Great advice! Only thing missing that might be helpful is to reinforce with viewers how stressful and time consuming the process is. Going to HR is the first step in what could be a slow, agonizing process that more likely than not ends with unemployment. The higher the risk for the company, the more difficult they’ll make it. It’s intentionally uncomfortable, and it’s hard not to get emotional about it when your livelihood is at stake.

      So true, I wish I knew HR was not my friend and that when they say open door policy that means tell us everything so we can figure out how we can legally be monsters

      Yes. I had emotional drainage due to retaliation. At the end the dont fired me right away but put me back on my schedule and keep an eye on me closely. I wish they just fired me so I can sue them.

      Facts!!! The HR dept is NOT YOUR ALLY. I complained after 8.5 years and got put on my tail! I got a lil $ but not nearly enough for what I went thru.

    Great video. Every time I memorialized a conversation or filed a complaint via email I received a email back stating this is not the appropriate way to handle the situation. As you stated, everything they wanted to be handled via a meeting.

      Do not comply. Go to the meeting. Fine. But follow up with an email outlining all that was said. That way If you decide to sue, you have documentation.

      They don't want to respond by email, because it's evidence. You likely can't record a meeting and won't have proof of what is said which is what they likely want. 😢

    100% truth...people that say these things are not true have simply never experienced stuff like this...they think HR is "for them" to "protect" the employee...the truth is 100% opposite.. I have seen some good people fired because they was the victims.. I saw the "mean girls" in the dept get a new guy fired only bx he looked and talked just like one of their ex-husband.. Great video!!!

    Thanks for your expertise…this happens to us everyday. I’ve been working since I was 15, and in 34 years. I have been discriminated against 75 percent of the times and I walked away and let it go….never again💪🏽

    I work in HR and have always said this. I am transparent with people though I’m like here is the line and if you start saying things where I have to act as an “operative” I will stop you but by in large the role of HR is to mitigate risks for the company. Now if you have good ppl they do advocate for employees and try to ensure internal equity but sometimes their hands are tied too

      HR is only there to protect the company’s interest/liabily. They are not there for their for the employee at all. HR is nothing but the company Snitch/ kiss _$$

    Even though I understand this fully, it looks good in court that I went to HR anyway with my cases per the handbook. It's all in the documented emails of my rights being violated. I made copies. I have emailed HR about our unrecorded meetings. Good advice!!!!🎉❤🎉 I have everything I need before they terminate me, if they do.

    I’ve complained about all that when I served my employer by US Mail hours went down, false write ups, went to Indiana dept of labor hours went down even more, got EEOC involved afterwards two write ups with a final warning then I was taken off the schedule for 18 days, I took that as constructive dismissal leading to wrongful termination, I have text messages, tons of emails pictures, looking for a good employment attorney in Indiana, I had three protected activities in place with this company prior to all this, I have and EEOC meetings coming up December 9, 2024, I want ur help

      I just had my EEOC phone conference. Don't worry about a lawyer right now. EEOC will take your statement and determine if you have a valid complaint. If you do, they will let you know during the call. Then, they provide you with all of the information necessary going forward. In the documents that they send you with your complaint, it will let you know they will provide a list of employment lawyers. I was so happy they took my case. They said I was discriminated against under Title VII, 1964 Act.

      @@traceytracey3756 thats awesome frfr, i served My employer via US Mail shortly after they started retaliating cutting My hours down to nothing also got The US Department Of Labor On them and i included US Department Of Labor and EEOC IN all My emails to The employer and they received all response's i received from them i have pictures text messages Phone Records all Of a sudden write ups, and everything is from management only

    I went to Diversity Inclusion and Equity and Business Partner they said they did an investigation and put me on PIP and denied it and I was terminated. EEOC is asking me for a rebuttal now. This is Kings County New York.

    I am a target and they are going to do something to me. I feel so alone, unprotected, scared, depressed.
    After making complaints of sexual harassment, retaliation, discrimination etc they released it to everyone. I am so nervous about tomorrow.
    This has gone on for years.
    I took photos of the retaliation from Friday.
    I’m felt like a kid on a playground until I saw a white car from work follow me all the way home- 25 minutes and turn around right at my turn and leave. I was so scared I didn’t even go pick my son up from my mothers.
    Do I report this?
    Can I ask to see the video. I’ve called multiple ppl for help but no one will.
    They are going to do something to me. I know it.

      ⁠@@jep23452I checked in my local area and there are no employment lawyers just workers comp.
      I’ve expanded my search to all of Georgia.
      I hope I can find someone because I’m actually terrified to go into work.
      I can’t even sleep the night before and I’m getting so worn out and tired

      Record and document everything and get a dashcam for your car. After you have enough evidence, leave the job and sue them. You'll have all the evidence you need. Good luck

      @@jep23452 I'm from Canada. What is your advice? Same here being bullied, mobbed, gaslighting, harassed at the hospital for over 12 years. I've happened to be the top worker for 38 years and have never been suspended. These bullies are jealous and miserable people. Union, manager, HR and the police are all totally useless. Bullies are lazy bums and stupid managers are scared of the bullies. They say about me I'm crazy, I drink, I'm a stalker all bs defamation of character. The biggest mistake since they removed disciplinary measures. They should arrest the bullies and fire the manager. Action speaks louder than nasty words. It destroyed my reputation. I will never quit to make these lazy bums ever win. If I decide to transfer to another hospital and may start mobbing me once again, I don't know all the new managers etc. like in every department like now. So best to not change hospitals. I will never let bullies try to control me from quitting. Never let these low life lazy bums ever win.[

    I would like to know if one can use an Affidavit for certain events that occured? If so would the employer have to rebutt with an Affidavit?

    I have a very serious question. If a staffing company spreading the rumor to all the companies that you were terminated and they could no longer deal with you anymore.. 2 years later you go looking for a W-2 form from the parent company, and find out you would never terminate it. deprived of 2 years of income..what do I do next

    Now say I’m at a government paramilitary job . It involves a chain of command system. I asked my supervisor for ADA accommodations twice but she states “this job doesn’t require accommodations” even though I need them. In my evaluation or meetings they compare me to my coworkers who are faster learners . They call me lazy because i take some time to learn. If I go to HR they will blame me for breaking the chain of command. What would you do?
    I also wrote a rebuttal to a situation at my job of someone defaming me. My evaluation before my rebuttal was fine but after it I received a bad evaluation. Anything I can do?

    Now looking back at some things in hindsight, a former supervisor always requested a follow-up meeting "to discuss in person" because that was his preferred way. My question is, should I have asked if i could record our conversation that we're about to have? Is it ok to ask or not a smart move despite a target being on my back already. It most likely would've been declined i guess.. what are your thoughts?

    So true t documented everything and Defendant council is out right denying my requests for accommodations. After only offering unpair medical leave till my medical was going to cost $500 a month with no paycheck. Started abandonment of job willful misconduct charges because I requested accommodations to work from home. Nuts its them that did intentional infliction of emotional distress. Etc. said I cant sue a School district or their employers. Right. Wish I was in FLA keep up the good fight!

    you mentioned "every thing in writing", this no longer works against alot of bosses who will refuse to text anything that may put themselves at risk.
    i live in california. and it's illegal to ask for the pay and work conditions to be private, even asking for it to be private is illegal. even making a rule blocking employees from sharing working conditions may be illegal such as a policy of company is filming the workplace but employees are asked to not record ANYTHING. that would be an illegal policy infringing on the workers legal protection of being able to share the work conditions. i know plenty of employers who enacted these kinds of rules to attempt to suppress the workers, and these work places has the most misconduct from the employer itself.
    also this laws means that conversations with bosses can be recorded as long as work conditions and work related stuff is being discussed. legally it can't be asked to be private and thus reasonable expectation of privacy is removed. and thus it can be recorded. but alot of people in california dont know about this law.

    Was placed on leave with recommendations of checking into psychiatric facility with paid leave and I thought paid hospital but after getting out in a week or so I was then again placed on paid leave. They knew I had bipolar verbally and they said they'd help but I was fired .can I get help I've been out of work almost 9 months. I'm filing fully for disability and I'm humiliated and distraught .and can't find equal pay let alone the symptoms since have gotten worse after the stress of losing my partner,child,apartment and car I lost my life .I moved from west palm beach FL to Tennessee. I had a family member here who accepted me but I don't know what to do.any advice?

    A straight shooter. Dealing with this now; helping my dad who was just let go after asking for his job description because they discriminated against him by assigning his job to someone else and moved him to a made up one and then let him go soon afterwards.

    I recently sent an email to my manager in regards to racial discrimination, he sent it to HR they did an Investigation w/o me and asking me any questions . I provided my manager w minimum info .. they didn’t even know what exactly was said bower they conducted an investigation and said it wasn’t racially motivated , I do have every single thing that has occurred documented but I didn’t give them all of that information! How are they able to conduct an investigation w/o even knowing all of what happen. ?

      I had an witness however they’ve gotten to her . They did this in 3 hrs after my manager forwarded my email to them . I did say I’m the email that I have more detailed documentation of the multiple incidents.

    I completed about harassment and told thm I want it anonymous but thy said no only action taken was to separate us but he is a supervisor he should know better how can it be anonymous if he's been told not to be around me how can I not be around him and do my job how can I trust he isn't around me so I'm constantly looking over my shoulder... a sup. Took me to a place no one was to ask to kiss me so since I have no witness thy arnt going to do anything but keep us separated

    If its related to discrimination they will do subtle things to make your employment terrible to attempt to constructive discharge you or wait out the EEOC deadline and then fire you. Document your workload compared to other coworkers with what you did and the exact date. HR will "paper" your file. They will say "___ was a poor performing employee, here are notes from the managers". Its hard for your employer to gaslight when you have documentation. If this comes up in the position statement you can rebuttal with facts instead of just your word against theirs.

      Most lawyers.
      But get real. Law is a business. Yes, our firm does lots of pro bono work and goes out of our way to help poor people. But we're a 4 lawyer shop. We have to eat, too.

    I need an employee lawyer who can practice in Ark! Last 6 mos I documented and recorded everyday. 17 yrs with my employer and was let go same wk I filed complaint to hr and eeoc for retaliation, discrimination, fmla violations and harrassment. Recorded mgr threatening me 2 take another fmla day or I will be fired. 1st time ever, I was written up for using 8 sick days in 6 mos. All were fmla days and one was a employee given day we get every yr. Im a caregiver to my dad who's in hospice. Ton of laws broken & I saved everything even hr statn mgr was in violation of company policy 😢😢

    I have screenshots on my personal phone and my former employer hacked my phone in an effort to delete my text messages about payroll violations and improper deductions. I lost 500 gigs of years of family photos videos and my personal Data. This was done without my consent after I was terminated on my personal device.

    One thing he didn’t touch on…. If you can, get a witness statement. Tell them to only tell the exact truth about what was done to you and what they saw and heard on their own account. 🥂💯

    I'm in a position with a coworker name joe who dropped n bombs. He later went to HR and falsified a sexual harassment story on me and I was fired.

    I'm a long term employee , never had an issue. Been there 20 years. Now i have 2 new bosses who discriminate against me. I'm the only female and they isolate me and don't support me. I'm also autistic. So after watching this video, i feel hopeless. So laws don't really protect you. Discrimination is a joke and they win. 😞 i have 1/2 thick of documentation but for what??

    *IMPORTANT* Only employers with a certain number of employees (20 or 14) are subject to these discrimination laws. So, if even if you’re a protected class, you may not be covered, sadly.
