Its my first time hearing Wael. I absolutely 💯 ♥️ him and concur with his understanding of modernity. Its a strong pivot from where we are But what we're doing now is only destroying humanity and our world.
We need to hear more from him and introduce him to many others. Thanks for doing interview.

What thought? He whitewashed Islamic history and demonized all of the rest of humanity. The Islamic Caliphate was killing its own within a single generation. Who killed Uthman and Ali? The Quran is entirely devoted to telling Muslims to fight, that the disbelievers are out to get them. It's a terrible ideology that leads to constant chaos and bloodshed.

I wouldn’t call it “Sharia law”. From my understanding, one of the points of his works is highlighting how language is weaponized, and how the understanding of Sharia was reduced to being just a source of legal rulings. It’s called Sharia not Sharia law, as Sharia is a vast discipline covering the discursive practice where the social, political, economic etc. intersect with the moral and epistemological.
And then jurisprudence and rulings out of that is called fiqh, as you know.
Glad you brought Hallaq on :)

Of course you are helping Professor , the first step is targeting the routed perceptions of modernity that makes us think and see ourselves and the others in this world, then that will have to push us to figure out the system that better fit our lives and the world we live in, and that will be a long process !! First just admit this needs absolutely to change !!

At about 28:00, Dr Hallaq points out a very seminal point about our current “modernity”, and that is the fragmentation that is subspecialization in Academia (and I can only speak about the Western Academy). What is needed ( I would say required) is a consistent means of interdisciplinary communication rather than the emphasis on subspecializing with an occasional interdisciplinary emphasis -which is the model I have experienced. The disciplines - like the individuals- need to speak to each other a lot more.

Dear Wael, I listened to some of your interviews online and I found you fascinating intelligent individual who could build a better future for our middle eastern and nation-wide values. I need you to remember that its your duty to spread your words around the globe, because they should build an amazing culture we strive to in our dreams instead of going back forward old thoughts and actions. You inspire creative people to build a new practical systems based on what worked on the past. Currently, the middle east is living the past and keep living it again and again till they reach the heaven they dream about. But, people like you create heaven on earth, because this earth was like heaven before humanity started their own selfish plans. Keep doing what you are doing, I believe that The Islam should be upgraded to the next level by innovating Mathab researches that is not controlled by any power. A new Modern Islam Mathab needs to be built to save the lives and this religion.

the Islamic state is impossible for certain reasons but the choice to chose being ethical is eternal and almost personal, a practice that offers what a islamic state stands for.

Loved how @afikra pried on the question: How is modern state different from empires? Historically speaking, one can argue that societies were more exploitative and more violent in medieval and ancient world than the modern state.
Emperors ruled the empire like they owned it taxing farmers to death and enslaving people who couldn't pay taxes. I did not see convincing answer to the question about how the past was NOT "bad". If someone is criticizing modern state system, then we cannot the escape the question whether the past was really that great and peaceful? Looking forward for part-2!

Dr. Hallaq says that "we can live without states without living in anarchy", this may just be a semantic misalignment, however what most social anarchists ( contrasted with individualist anarchists ) would advocate for is exactly what Dr. Hallaq says in that quote, a form of collective stateless living with a strong focus on ethics and values other then profit ( the modernist capitalist episteme ). Anarchy is commonly derided and semantically confused with chaos as opposed to a legitimate political orientation that has existed for thousands of years alongside the development of what would eventually dialectically synthesize into the modern nation state form. I think that there is a surprising amount of overlap between anarchy and islam, the notion of non state polycentric law is evidently appealing.

Modernity includes many components: science, technology, philosophy, secularism, democracy, geopolitics etc.
For Muslims , science and technology are to be taken back , while others are just references and most of them to be discarded into trash bin.
That means modern Muslims have to hold full Islam and assimilate modern science to build up independence and strength to bring justice and peace and prosperity to the humanity!

He had no concrete answers for what sharia-inspired solutions for all-humanity would look like in today’s world. He is understandably consumed by his anger against colonialism and the modern state. But he channels that energy into desperately trying to beautify the history of Islam in contrast, excusing the jizyah (non-Muslim tax) as the price of protection under the Islamic empire in his interview with Radio Thamanya. And here criticising all secularisms without offering real and inclusive alternatives, other than I’m optimistic Islam *one day* could be reinterpreted in less ugly ways than it has often lent itself to. While he’s dreaming of that and enjoying his popularity among nostalgic Islamists, women, queers, and apostates are left to grapple with the reality of Sharia-inspired laws and culture on the ground, which he cowardly valorises from his comfortable Columbia office. I want to be optimistic too about my Muslim community reinterpreting their religion, but we’re losing our lifetimes waiting for them and his discourse only feeds their self-righteousness. We are sick of waiting for Islamic reform and romanticising its past . We want a secular state. Call it dawla madaneyya if it makes you feel better.

Allaah has condemned theft and decreed an appropriate punishment for it. The hadd punishment for a thief is to cut off his hand. Allaah says (interpretation of the meaning):
“And (as for) the male thief and the female thief, cut off (from the wrist joint) their (right) hands as a recompense for that which they committed, a punishment by way of example from Allaah. And Allaah is All Powerful, All Wise” [al-Maa’idah 5:38]
The Prophet (peace and blessings of Allaah be upon him) said: “The hand should be cut off for (the theft of) a quarter of a dinar or more.” (Narrated by al-Bukhaari, al-Hudood, 6291)
This Shariya punishment for theft must be implemented in America, for all Muslims of America, under the able guidance of the professor of Columbia University
