AsalamuAlaikum sir i am a student of law, i have a proposition and question that in section 75 ppc there provided offences of only two chapters, if a person has committed an offence under section 324 ppc and later on had convicted and after completion of his sentence he again repeated the same offence then why he may not be charged under section 324 ppc. What is the logic and wisdom of legislature? I am very grateful to see your kind answer.
Kindly deliver lecture on 561 inherent power of high court in practical way that what relieve we can get from high court under this provision for example protective bail come under inherent power of high court and so on and kindly explain types of bails in details and their practical implications.
Assalamualqum respected sir In magistrate trail offences under chapter 12&17 are understandable as these offences are triable by magistrate..and sec 246A is clear about tht.. But as no other offences except mentioned above can b enhanced then why section 265 i crpc regarding enhanced punishment is included? Asad khattak advocate
I think sec.75 PPC not applicable to already registered FIRs or pending cases before the court prior to the first conviction rather it is only applicable if a new offence of the same nature is committed after being convincted.
