What in a race is discretionary? Spirit and letter of the law is where the Supreme Court has some discretionary power to make a decision if the letter of the law doesn’t align with the spirit of it when judging a case.

So how will anyone expect an election tribunal to forget about the voting and suddenly begin to call for evidence about a certificate that was never an issue before the Election Tribunal. Laymen can be forgiven for thinking that the SC could have acted irrationally but lawyers can't.
