If not, the judge will ask the Defendant's counsel whether the Defendant has been advised that the jury may or may not draw an adverse inference from the Defendant's decision not to give evidence. Second, where after a reasonable period of time the jury is unable to reach a unanimous verdict on which all 12 members are sure, the judge will direct the jury that they may return a majority verdict in which at least 10 of their number are sure.
