I don't know what judge or jurry had a say so on this one but that man at best committed involuntary manslaughter
Even if it was his intention to spray dirt on the car as he was drifting by there's a very small likelihood that he even had time to change his trajectory by the time he saw the guy If the kid had stayed in his car like you're supposed to he would still be alive You would have to be brain dead to prosecute something like this bc in any racing you sign a bunch of waivers Unless they had some long standing beef and threats were made there's no way any legitimate prosecutor would take on this case

I'm no nascar fan and don't give a shit about Tony Stewart, but when you analyze the video with no bias, you can see and hear the car slid into kevin ward. It's likely that when stewart noticed ward, he yanked the wheel, lost traction and begun to slide. The engines revving quickly cuts out because he locked up the brakes. It does appear that stewart, though most likely panicked, at least attempted not to hit ward. Bottom line is, the guy should not have gotten out of his racecar, unless there was immediate danger, until track personnel got things under control. It was dark and he was wearing black, it was a stupid move to run out in front of oncoming racecars.
