  • Today the Supreme Court ruled that presidents are entitled to absolute immunity for official acts while in office. Former president Trump is calling that a victory as he faces prosecution for federal election interference. Andrea Michell is joined by Harvard Law professor emeritus Lawrence Tribe, who talks about the real dangers of this ruling.

      Yeah , who would’ve ever thought they would go to and use the highest court in the land with the brightest minds to actually render a decision in this case. Every president in U.S. history has taken top secret and classified documents with them when they leave office. Unlike some who’ve never had a top secret or classified documents clearance to possess , take , hold such top secret and classified documents . And if I remember just recently it was discovered that a man named Joe Biden stole top secret and classified documents by stuffing them down the front of his pants to smuggle them out of a secure Skiff . Throughout Joe Biden’s fifty yrs of being a career politician he willfully, knowingly, intentionally and blatantly stole top secret and classified documents from more than fifty yrs . Hmmm 🤔 one just might call that a crime ! But we’ll see because I don’t think that one’s over yet. Not only did Biden knowingly steal these documents and had them in his possession he had amassed well over four hundred boxes of top secret and classified documents he now says his staff moved and he did know anything about. Hmmm 🤔 another huge problem for Joe Biden because not only did he not have a top secret security clearance to be able to possess these top secret documents neither did any of his staff or his son Hunter who was directly working with and was business partners with a communist Chinese national who had direct ties to the communist Chinese CCP ! But na that’s not against the law. And you want to go after a man Trump for taking top secret documents like every other US president before him took after leaving office really. Like the Congressional judicial oversight committees not done with dealing with this one yet. Like you say nobody’s above the law.

      @cowboycurtis2229 12 ชั่วโมงที่ผ่านมา

      No, the ruling applies to former presidents who, it should be noted, have always operated under the assumption of immunity for official acts. This ruling solidifies the notion that you can't go back and criminally prosecute a president for an official act that he did while he was in office. Because let's face it, pretty much all presidents alive today could be prosecuted for war crimes, but those are official acts that they took while in office, and so they are immune from prosecution.

    This ruling was almost no different than current believed law. They get immunity for official acts. The phrase presidential immunity was not coined or used by this court first.

    • @dmann1115
      @dmann1115 2 วันที่ผ่านมา

      On the contrary. The Constitution - which is capitalized, by the way - doesn't even remotely suggest presidential immunity. Meanwhile, there's ample jurisprudence and writings by men like Hamilton and Madison that points in the other direction entirely. No man is above the law MEANS no man is above the law! Ford pardoned Nixon because they both knew that he did not have immunity!

    ---- < All the ruling really says is that a President has immunity for upholding the law.
    Under 3 U.S.C § 301 (1) & (2), Article II duties /official acts are DEFINED BY LAW. So, an Article II duty /official act is not a crime. A crime is NEVER an Article II duty. However, the violation of procedural law is subject to criminal law. For example: Under § 301(2), a asking someone to break the law is not an Article II duty.
    ..... 3 U.S.C. § 15(e)(1)A(ii) says, " No vote of an elector described in clause (i) which has been regularly given shall be rejected."
    ... Under the PRA, classified documents, even if declassified are still the property of the government and never become personal property.
    A presumption of immunity shouldn't be any more than a "presumption of innocence" before conviction by a trial court, or proof of intent..required by the prosecution of any individual.
