    I stand in awe at the courage of parents such as the Kennedys. After undergoing the most terrible grief at the loss of their beautiful little girl they still managed to get up in the morning and try to live a normal life. What a
    wonderful strong
    courageous family.

    "ONE" of the reasons for the divorce? He locked her out of the room while changing Kylie's diaper "four or five times"? What the hell is wrong with her mother???? The first time he locked the door and my daughter was on the other side screaming would be the last... He'd be dead before he hit the ground. She saw the bruising? And didn't leave immediately? Disgusting.

      Missychan63 " He locked her out of the room while changing Kylie's diaper "four or five times"? " Yeah as u rightly pointed out, if happened once would 1. end the marriage and 2. seen a dr at least. But of course none of that happened cos is a lie. People lie and exaggerate. Encouraged to lie as well if an authority figure was wanting particular info ( Police ). People are easily lead down the garden path. Is likely Carroll not in QLD at the time of the murder. Two eye witnesses to the person in the backyard in the night in question, gave a totally different description to that of Carroll. Carroll is over 6 foot crew cut hair, yet the assailant was 5'5 5'6 shoulder length hair. All this was ignored by qld corrupt police force. Sadly cos a murder of a child took place yet the police force were inadequate at the time.

      How do you know she didn’t file for divorce immediately after she saw the bruising? All we heard was that it was one of the many reasons she filed for divorce. The most probable chronology is that that was the last straw. Seems like you’re just going out of your way to heap blame upon an abuse victim who did in fact do the right thing and remove herself and her daughter from this monster’s abusive clutches forever.

      It's sucks but is completely irrelevant to the current charges they are facing. If a jury hears they did something similar in the past more than likely they will rubber stamp a guilty verdict. Let me give you an example. A guy has just gotten out of prison for carjacking a woman at knife point. A similar crime happens and the police know this guy with a prior of doing the exact thing and with a vague resemblance to the description of the perpetrator lives 2 blocks from the crime. He was in bed so has no alibi. So the police arrest him. There is no real evidence. Now when he goes to trial do you think he will be found not guilty or guilty if the jury hears about his prior conviction? Whether he actually committed the crime is irrelevant. He needs to be found guilty beyond a reasonable doubt and his prior will surely poison the jury. That's why priors are not admissable during trials. They are however admissable during the sentencing phase and I would say that after a jury debates someone's guilt and then find out he has done it before they tend to recommend very harsh sentences. Jury members that originally questioned the person's guilty tend to lead the way to pushing for the max sentence.

    • @brandyjean7015
      @brandyjean7015 ปีที่แล้ว +5

      @@robertschumann7737 I do agree 100% that actual evidence of the crime is needed, not simply 'no alibi' & it's something this person might have done.

    Basing my opinion on Casefile's presentation, I tend to believe he did do it, and I think changing the law was absolutely the right thing to do - and long overdue! Double jeopardy disregarding new and compelling evidence is absurd. However, I do NOT think that he was proven guilty beyond reasonable doubt, and thus the acquittals were legally sound.

Obviously from info in this particular podcast and others murders in the state, Qld police struggled to solve a case without brute force, doggy confessions and heresay evidence. Nine yrs had past before Carroll was a suspect. A suspect based on no evidence whatsoever.

    I had forgotten this case in the ensuing years but as soon as I heard toilet block roof it all came back.
    We lived in a country town in the Far North and in summer the doors and windows were left open at night with only the screens shut. This tragedy changed that and we went into debt buying one of those clunky first generation evaporative coolers to keep the children cool and my husband drilled holes in the window frames into which we could insert removable nails/bolts to prevent an open window being opened any further for anyone to enter.

    Perhaps an unpopular opinion these days, but I staunchly believe that double-jeopardy is an important legal concept in liberal societies to maintain. However, the law could be modified much like the UK did with success. Essentially, the prosecution could retry a suspect if there was NEW and COMPELLING evidence brought forth. DNA is one way that justice has been achieved for families without destroying an important protection for suspects who, without the double-jeopardy protection, could be tried over and over again until an over-zealous prosecution gets the results it wants.

WTF!?The evidence hadn’t been kept safe and was contaminated. The jail informant wasn’t even verified before allowed to testify. The other witnesses of past relationships were unreliable and inflammatory. He also had an alibi that the police could not disprove. They were grasping at straws through the entire investigation. They had tunnel vision and did not do their jobs completely. Thankfully he was set free upon appeal. The real killer is probably still out there

    I was born in 1974. Regional QLD, , about 4 hours north of Ipswich. A sleeping child (angel) taken and left on the roof of toilets in a (forgive me) barren park and a very droll grey amenities block right up along the main drag in and out of Ipswich. I have gone by that very place several times since.

    I completely agree with the comments I'm seeing here But feel that there is more that should be considered.
    The rule of double jeopardy, in the U. S. A., is a safeguard against convicting innocent people. If a person is found NOT guilty they may not be charged with the same crime again. But if a person found guilty has their conviction overturned on appeal it is considered about the same as a mistrial, they can and should be retried.
    The hope is that the investigators, and prosecution will get it right the first time, and not file charges until they have the proper evidence to PROVE their case.
    I suggest that in Australia they reinstate the double jeopardy law in a revamped form to only include overturned GUILTY verdicts.
    It is better 100 guilty Persons should escape than that one innocent Person should suffer- Benjamin Franklin, founding father of the United States, {and my personal hero}

      Shows her face? More like karma shows her ass lol. More like karma shows that she's a bullshit concept cooked up by the wishful thinking of human sentimentality, err I mean "spirituality." Cases like this are proof that anyone who says platitudes like "everything happens for a reason" and "this world was designed intelligently by a higher power" is projecting their wishes onto reality. The world is a clusterfuck of dumb, blind forces with no real intention for good or ill, sometimes good things happen and sometimes babyfuckers win. We tell ourselves comforting lies cause the truth is too depressing for most people to live with.
