The lady spoke something in the beginning which reflected great deal of experience and understanding at ground level which no book or news could possibly reflect.
Its actually partially true , my father told me the something similar about our family history ... We belong from a small town in eastern UP , my father became a doctor and we came to Delhi and i grew up there but he told me an anticdote that one of his grandfather's brother became a sikh even though we are hindus , he said that it was our culture one of our brothers usually became sikh called mona sikh . Although it ended by my grandfayher time , but still it was practised during 19th century among hindus

Article 370 is not totally abrogated. Only clause 1 exists which makes all powers except one (which legally binds Kashmir with other parts of India) of article 370 and 35A ineffective.

So when your children will ask you what do those kashmiri, whom you call Indians by force, do on republic day, independence day and when India loses matches or do they sing Indian national anthems. Tell them they don't care and they celebrate them as black days. they use firecrackers when India loses and they dont even know what is India's national anthem. When I was a kid I used to support indian cricket team, and my dad used to get angry. I used to read indian technology and actually love india. Then my uncle told him, dont say anything to him, one day he will see india and know from his own experience. And guess what, he was right. That is the picture you build for history. Well if you don't care about that then you can tell them, the distance between Kashmir and india is 0 miles but the distance between Kashmiri and Indians is the distance between two galaxies which can never meet. Honestly, Aborogation of article 370 would have been possible if there was a discussion and there were high chances that it would have been passed by the assembly although not overwhelmingly but would have passed. Before scrapping 370 it was still ok. Although people were not emotionally part of India they were mentally. Now it is emotionally and mentally zero support for India. you can use as much force but you cant turn our hearts and minds. The use of deception and force changed the whole game. It will be the last disaster of Modi after the demonetization disaster. He did this only for his election and people are blinded by nationalism that they don't see it. India's economic growth was slowing and he needed a boost for people to vote for him. He succeeded but will at a very high cost. You never heard the quote. You can take a horse to water but can't make it drink. I am not sure you even understand what it means.

There is this general clause which says any resolution in regards what is already passed by the constituent assembly of J&K cannot be revoked.
Read the following for more clarity :
Article 3 in part 2 of the Jammu and Kashmir constitution reads as, "Relationship of the State with the Union of India:-The State of Jammu and Kashmir is and shall be an integral part of the Union of India."[7][8]
Article 5 of the part 2 is about extent of "Executive" and "Legislative" powers of the state which tells that Jammu and Kashmir Legislative Assembly has executive and legislative power of all matters except those with respect to which Parliament of India has power to make laws for the State under the provisions of the Constitution of India.[7] Sectors in which Government of India can make laws for Jammu and Kashmir includes Defense sector, Foreign affairs, Finance and Communication.[2][3]
Article 147 of Part 12 is about amendment of the Jammu and Kashmir Constitution which states that, "No Bill shall be introduced or moved in State Legislative Assembly to amend or change above mentioned articles 3 and 5."
Yes it is not revokable at JK constitution. But Ram Jethmalani can talk in any side. But he did not justify why it should be there. Indian constitution can override JK constitution after removing article in Indian constitution on the basis of descrimination.

Sikkim was an independent country and It has become part of India in 1967. Kashmir is part of India why it cannot become part of India?
The princely state of J&K is already part of India because of the Instrument of Accession of 26th Oct 1947. However, the procedure had to be completed by signing the Instrument of Merger, which Maharaja Hari Singh would have signed. However, Nehru replaced Maharaja Hari Singh with his son Karan Singh and appointed Sheikha Abdullah as the State Administrator in 1947 and went to the UN in 1948 for holding a plebiscite in J&K in 1949; but the plebiscite never took place. Instead Article 370 was inserted in the Constitution of India to complete the merger.
There was a referendum in Sikkim.

The UN Resolution 47 for plebiscite on Kashmir was for the entire princely state of J&K and not the 40% portion currently with India. But Pakistan foiled all attempts to hold the plebiscite in 1949 after ceasefire was declared on 31st Dec 1948. Thus, to ensure that J&K (India) could function, Article 370 was included into the Constitution as a a temporary measure. However, a temporary measure cannot go on forever if Pakistan is not going to vacate PoK.

Maharaja Hari Singh had put Sheikh Abdullah in prison for his anti-Kashmir activities, but was forced by Nehru to appoint Sheikh Abdullah as the State Administrator in Oct 1947. Thereafter, to accommodate Sheikh further, Nehru forced Hari Singh out in 1949 and replaced him with Karan Singh (who was only 18 years old). This gave complete power to Abdullah courtesy of Nehru, followed by the flawed Article 370 being incorporated in India’s Constitution. Btw, Hari Singh died in 1961 in Bombay.

What a mountain of bullshit from both sides! The matter is very simple! Maharaja Hari Singh was the owner of all the land he ruled. He signed it over to the India. Since then, the Republic of India is the Ultimate Owner of that real estate. The Kashmiri people are tenants. It they do not like the landlord, they can vacate the land and move on to live under some other landlord who offers better conditions.

When siddharth started talking about land ownership in kashmir for the development, he ignored the fact that Jammu & Kashmir is in Himalayan Range and bringing industries would mean bringing pollution as well. That is why it isn't (or wasn't?) legal for outsiders to buy land in Uttarakhand as well. I believe it was a right decision to abolish Article 370 but allowing land ownership to outsiders is a bad bad idea.

Mr Ram Jethmlani wasted no time pointing out that he's a lawyer and Dr Swamy is not. Yet, he was wrong in saying that Article 370 is a part of the J&K Constitution and Dr Swamy did a quick Google and found out that Article 370 is not mentioned in J&K Constitution.

Article 371 granted to respective states were drawn in parallel to Article 370 by Manish Tiwari which is so uncalled for. I feel he needs to be responsible enough to make such a baseless allegations

True, but i believe he was just doing for sake of debate as he was assigned to speak in favor of 370. COZ you can see in the beginning when he started his speech you can clearly hear him asking whether he has to speak in for 370 or against. Whereas Swami spoke from the heart and always spoke sensibly

The conclusion is : Art 370 cannot be abrogated only when it violates BASIC STRUCTURE the test of which lies in the floor of SC. Till then it's matter of political willingness.

370 got abolished, it truly harmed the federalism of India.
