      @not fair He's clearly calm enough to ask multiple times if he can grab things (like his firearm paperwork, his ID, etc). The officer clearly said no. He was definitely not oblivious to the expectations.

      Losing my freedom is worse than dying to me. Those police happily with glee will cause the worse injury to another human (take away their freedom). If a person is a criminal committing some violent crime immediately I understand but looking for some BS excuse to stop and cause a citizen some sort of injury is immoral and evil. I used to feel bad when some police got shot till the past couple of years seeing how evil they are. Today I feel nothing when either side of that contest lose because they looked for it.

    It boggles my mind: the perp had no criminal record. Why not just get a concealed carry permit? I'm black and live in Jacksonville and it was fairly simple to get a concealed carry permit. After I submitted the paperwork, the permit arrived in about 3 weeks.

      It doesn't always help to obey the traffic laws. I have been told more than once that I am being stopped for not wearing a seatbelt when I never ride in a vehicle without it on. I was really being pulled over because I was in a "bad area" and they wanted to go fishing.

And saying he tried to murder them is a stretch as he may have just wanted to use the gun to get them to back off. There may be a hundred times more people that had a gun pointed at them then have actually been shot. Cops for example point a gun at a great many more people than they actually shoot, same even for armed robbers. I'm not saying that cops should let someone point a gun at them, I'm just saying that until that first shot is fired, you can't say for certain. And he never fired at them. So while it was an aggravated assault on a police officer, calling it attempted murder is a stretch.

      Give people the ultimatum of going to prison for 20 years or doing something drastic to escape, and you bet your smokey BBQ balls that most people will take drastic measures to be free. If BBQ was illegal, you'd literally be the guy in this video.
      Look at it from the officer's perspective. A cop almost died because he is legally obligated to arrest a guy for having weed. Imagine that being your life story; "Killed in the act of protecting the world from marijuana." It's seriously a pathetic thing to put officer's lives on the line for.

Perp knew there was more to the story. Looks like there was a 24+ capacity mag in the gun. Not what a typical law abiding citizen would have. Appears he was ready to go if a deal went south on him.       @@tbl8560 The problem here is you ignore details which leads you to make all these assumptions. There's no "likely" required here, he stated that he had his paperwork (for gun and car) & more than once he offered it to the cop.
      For me those are the primary and most important requirements. Weed is becoming legal and probably will be legal everywhere in the future. This man died for having crumbs of weed on his T that's bullshit to me, the cop could've chilled.
      If we wanna talk about how they put their lives on the line everyday and so on then in circumstances where its not necessary to be so damn strict, they should also avoid elevating shit.
      Bigger picture to me is two things:
      #1 A young graduate died
      #2 a bit of weed
      These things dont balance out. It wasn't necessary for the cop to want to take him into the cop car. Should've checked all paperwork then let the man go let's not forget that the whole reason he claimed to have stopped him was due to a seatbelt which is also another bullshit reason that leads to someone dying.

Yes there’s bad apples in every bunch but at the end of the day when you’re in danger it’s police, people like you and me of different races who have families and live amongst us risk their lives every single day. The liberal politicians and media continue to dehumanize them and incite people to hate all law enforcement. You’d be blind not to see the rampant crime in places where they were defunded, and the loudest anti police proponents have now walked back their vitriol bc of the majority of people oppose it and know full well what it would lead to. These same politicians pay lots of money for their own private armed security yet they want to strip our safety. Look at the mayhem cities who defunded police like Chicago, Baltimore, Portland, NYC, Austin and LA. Criminals perpetuate with total impunity there bc law enforcement are hindered from doing their job and they have liberal DAs who won’t prosecute them. Chicago like NYC inspired no cash bail creating a revolving door for criminals to avoid being taken off the streets. Highlight THIS!

    The hypocrisy of the community in situations like this pisses me off... their not mad when they kill a cop their mad when an attempted murderer gets killed??? Where's the logic in this? There isn't any it just shows their true motivation and heart. And fairness doesn't factor in

    Man I'm so thankful for badge cam footage. It clearly shows the caliber of the officer and suspect in these encounters. No longer can an officer be painted as a hero or villain undeservingly, and no longer can a suspect be painted as a victim or an aggressor undeservingly. I hate this young man went out like this, but sadly he did it to himself.

    How to avoid being shot by officers, easily don’t go for a deadly weapon or just comply with their orders.
    Do I feel bad yes, do I understand why the officers didn’t move in yes. Ever heard of “you can trick me once but not twice”. These officers definitely taking that to heart.

    I don't know about anyone else, but my heart does not go out to this guy. He died as a result of his own actions. He basically forced the officer to shoot him, and now the officer has to live with that. The cops aren't always right, but if you do what they say you'll most likely be alive to address those concerns later.

      They shot an UNARMED man. He dropped the gun and moved away from the car. So they were not forced to shoot him at all. At best, they made a mistake. At worst they murdered him because he pissed them off and then forced him to bleed out and die for their personal amusement.

      He was UNARMED the running AWAY from the firearm when they shot him OUTSIDE the car. So..., when they shot him he wasn't trying to kill anyone, was no imminent threat to the officers, and after he was shot and fully compliant, they USED HIS COMPLIANCE to kill him by not even allowing him to give first aid to himself.     From watching some of these videos, it seems like closing the person’s car door once you get them out would be a big help. Also, I saw an ER show once where the ER doc said that when people say they’re dying, they usually are, so it creates a sense of urgency for the docs.

    I've noticed officers leaving suspects in front of an open car door leading to terrible outcomes on numerous occasions. This is the latest example but I also seem to recall a similar situation in the Kim Potter shooting, and I'm sure others.
    Officers really need to move people away from the door to the vehicle and sit them on a curb while they sort things out. Leaving them the option to dive into the car if they want seems to me to be allowing bad situations to develop.

      I think the officer really wanted to send him on his way, but the situation just deteriorated to the point where he was gonna just put him in the car, and even then probably wanted to just issue of warning or citation before sending him on his way. The guy was moving and reaching all around, maybe thinking he could just speed or shoot his way out of trouble, which ultimately got him killed.

    This Is a complete mess. It all comes down to the cops, and this cop was doing a great job of de-escalation, unfortunately the driver decided to escalate this to a whole new level. It sucks that he put this cop in the position of "Judge, Jury, and Executioner" when he decided to go for the gun to murder the cop.

By standing in the door he gave the guy a chance to grab anything inside… And he kept repeating the same questions making the guy even more nervous. Just take him back, detain him if needed, and search the vehicle. How difficult can it be???

Before this point this guy had broken the law by carrying a concealed weapon illegally that is law. So if the individual would've held his cool, the cop would've cited and let him on his way. This guy was an idiot 100% and nothing can change that and don't excuse his dumb actions.

    Not only is it perfectly _acceptable_ to refuse a search, it's what you _should_ do regardless of whether there is anything illegal in the vehicle or not. There is literally no reason to *ever* let an officer search your vehicle. Nothing good can come of it.
    Edit for clarification: I am not advocating that you refuse to follow lawful orders, I'm saying that you should refuse any *voluntary* search.

    To me the most important lesson, and one that needs to be hammered home again and again by community leaders and everyone else: When you have an interaction with law enforcement, don't resist arrest. If your civil rights have been violated, take it to court. Even if you end up in front of a judge like this fella would have, what's better - a trip to court or a trip to the morgue?
    Look at almost every high-profile police lethal shooting case that makes the media rounds: if the person hadn't resisted arrest, they live another day.

    As a black 🇨🇦 female living in the 🇺🇸 I have been pulled over by LE. I immediately turn on my dome light and put both hands on my steering wheel and I speak full Canadian, eh 😊
    I answer politely in a very soft voice and always ask for permission to get ‘out’ my documents. They usually send me off with a warning. I thank them and apologize for whatever they said I did wrong. Works every time.

    I think the officer really wasn’t looking to jam this dude over the gun. Florida cops are often very chill about guns, it is the gunshine state after all. He didn’t slap the cuffs on for carrying the gun improperly even though he could. Bad tactics though, you should never talk to somebody next to the open door of their car, especially when you are going to tell them they might be in trouble. Could have avoided the whole thing by just walking him back to the police car before having that whole conversation about weed flakes and proper carry of the firearm, and still kept it chill.

    The firearm doesn't have to be in a holster AND in a locked compartment or container in florida - the officer misrepresented the law, likely due to being mistaken.
    The law doesn't require a holster, it states "securely encased" which could be in the glove box (locked or not) in a shoe box with the lid closed, or in a holster that has a snap.

    I will say, the young man had it coming. Reaching for a gun, with other guys that have guns… of course you will get shot.. obviously. But I will also say him laying on the ground being very cognizant in that moment of the fact he could (and ultimately did) die, while begging not to die, is kinda sad. I get that emotions are so high on both ends but that’s one thing I’ve never understood is how you’re supposed to stay still after being shot.       Both the plant and the gun should not be illegal to carry. One should not have to produce papers in the form of a permission slip to use the 2nd amendment.
      Change the laws so this guy would have gotten a ticket and be on his way.

    Great case review as always. ASP could use more emphasis from a MEDICAL perspective.
    After the perp was shot you can see him roll over and his white shirt is soaking with blood on his left chest/shoulder. This means that once the scene is secure Injuries (TAP IFFS) likely include an axillary junctional bleed (wound packing), chest seals (entry and exit wounds), and needle decompression (tension pneumothorax), oh yeah and blood transfusion.
    It’s a shame how poorly our medical colleagues share specific information with those directly involved and the public. Hospital systems and HIPAA laws are largely to blame.

    I have absolutely no problem with how it all went down, the officer was trying to be cool, and then they had to react. The one thing that does bother me though... You got the the guy. He's shot, bleeding out on the ground, pleading for his life. You have backup.... They could've easily applied life saving services while literally holding a gun to his head in case he still tried something.

    Also why a lot of states have made seatbelts a secondary offence meaning you can't be pulled over solely for not having your seatbelt. So many nit-pick things cops use to pull people over unfortunately mostly in rough neighborhoods and then use that to look for the things they actually want to (warrants, people with drugs/alcohol visible, and these sorts of things)

      Terrible that cops have a reason to catch criminals with warrants? If you follow the law you don't get pulled over. Pretty simple. Rich or poor it takes 2 seconds to put your seatbelt on.

    The only thing that you do when you say no for a police officer to search your vehicle is you make them towe it and get a warrant that's it

    My biggest problem with the whole "probable cause" thing is alot of times the officers will lie just to search a car. This happened to me 4 years ago, the officer said he smelled Marijuana coming from my car (never smoked a day in my life) which gave them "enough" to search my car. Of course they didn't find anything but it held me up for over an hour.. I felt extremely denied of my rights plus lost respect for police after that, so it frustrates me when people talk about "probable cause". If the cops feel like searching your car their going to no matter what you do or say, it's messed up.
