      We are a Constitutional republic wherein the Supreme Court interprets the Constitution literally.
      And the Constitution protects the president from prosecution for official matters.
      Thus the GOP upholds the rule of law.

      if it was done in during and in the course of an official meeting regarding official policies then it is covered. If it was done seperately from all that, then it is not covered. Based on Hick's testimony the statements she witnessed happened during official meetings with top advisors on official matters. Therefore his statement regarding the matter during such meetings gets presumptive immunity. The only way its not covered is if he was not in an official meeting or official press conference when he said and if he was not engaged in any kind official business when he made the statements.

    The Supreme Court is supposed to follow 3 main paths to reach a ruling. 1). The Constitution. 2). Congressional legislation and/or precedent. 3). The intent of the Founders based on the writings and the clues they left behind. (In that order).
    In other words...if there is nothing to apply from the Constitution...they move to option 2 - Congress and any relevant legislation. They can also look at precedent. When none of these things apply because they don't exist, then they are supposed to base rulings on the intent of the Founders, based on evidence from the time period.
    That being said....there is nothing in the Constitution granting the President these sweeping powers of immunity. It doesn't exist. There is also no legislation giving this kind of sweeping power to the President. There is no historical precedent for this. This egregious ruling means that Richard Nixon's crimes would have been just fine. He would have been immune.
    The 6 member majority on the court are not legitimate justices. They are 6 corrupt politicians in robes...nothing more. They need to be referred to as such from this point forward until they are gone.
    What these 6 politicians did was create constitutional law and an interpretation of law out of thin air. They did it with no legal basis. They literally just made it up to satisfy their own personal ideological and political biases and to help their political ally. An absolutely disgraceful move.
    What they were supposed to do in the absence of text addressing this issue in the Constitution, and in the absence of Congressional legislation....was make a finding based on the intent of the Founders. While the Founders didn't really address immunity in the Constitution, they very clearly made it known that a President must follow laws and is subject to the law. They clearly stated that a President is answerable to high crimes and misdemeanors. If The Founding Father's thought a President has the sweeping immunity that these 6 Supreme politicians came up with out of thin air, then they would not have put that clause in the Constitution.
    Secondly, we know that the Founders were very leery of giving an executive too much power. In fact, we know that The Founders themselves were vehemently opposed to this, because they were dealing with an oppressive and intrusive King of England who tried to impose his will on the Colonies. Does anyone really believe that the Founders would have wanted to create a King? This is obvious. So if these 6 Supreme corrupt politicians would have followed normal protocols for reaching a ruling, they would have had to look at the intent of the authors of the Constitution and would have had to come to the conclusion that a President shouldn't have this kind of sweeping immunity. They could have only come up with a narrow scope (that wouldn't apply to Trump) that a President is immune from prosecution for orders or mistakes during a time of grave national emergency, like a war on American soil. Something of that sort that would very narrow in scope could be seen as legitimate. But not the lunacy that we saw today on July 1st, 2024.

  • @renostrano5842
    @renostrano5842 2 วันที่ผ่านมา +5

    Basically, you can make up any premiss, call it an official act and then have it bogged down in the courts for months and years. 🤨🤨🤨

    • @DailySource
      @DailySource 2 วันที่ผ่านมา

      Not only that, but your probability of winning in court is far higher because the supreme court just barred lots of things from being used as evidence … And also because the same supreme court will ultimately decide whether or not it was an official act and you have immunity. It will start in lower courts but of course Trump will always appeal it until it reaches his buddies on the Supreme Court, who have his back.
      Another huge problem is that there are lots of laws that a president can break while in pursuit of the official goals of his presidency, And now I think he cannot be held to account for breaking those laws. For example, if he is driving a car on his way to meet with Congress and he breaks multiple laws such as speeding, drinking and driving and reckless driving and as a result kills or maims a pedestrian, traveling to meet with Congress is part of his official work. I think this new ruling means that he is immune from prosecution because he is immune from any actions done while in pursuit of his official position.

    Since I was a young child in history class, I have wondered how fascist leaders where allowed by their citizens to wield such unchecked power. How did an entire country not only stand by but join in the mass murder of jews? Why do the masses learn to hate each other based on differences such as race or religion? It still goes on in many countrys. But America has evolved; very imperfectly; to use the power of law to help prevent such atrocities from happening here. Like I said I have always wondered and still do today.
    Something tells me fascists first take over courts claiming it is in the peoples interest. Although it is really to serve their own lust for power and brutally force their views on others. To say this decision is being over blown is nonsensical. It starts here. It may be too late to turn back. We must try anyway. Vote in every election no matter how big or small. Vote!

    The day before yesterday (June 30) was the 90th anniversary of the "Night of the Long Knives" in Germany, when Hitler and his clique had 90 people murdered of whom they thought they might be dangerous for them or who they simply disliked. It was the first time the regime openly murdered, and a crucial step to finalize the dictatorship. Shortly after that, he had the (puppet) parliament retroactively legalize those actions by law as some kind of 'state self-defense' against an (invented) coup. The SC ruling has about the same quality as that German law. Donald Trump knows a bit about German history. Be afraid. Be very afraid.

      @@DirtyRedMuzik He isn't wrong though we should be afraid.
      This ruling gives any sitting president Carte Blanc to get away with anything they wish... As long as they say its official business.
      And if the sitting presidents party holds majority in house and senate, they can and will have his or her back in their decisions.
      Hitler did the same thing in the 1930s after he gained power.
      He rigged the justice system in his favor, set up many of his supporters in important positions in government, had the system grant him immunity, and later would use the system to go after his opponents with claims that they were his enemies.
      And when he was done with all of that he dismantled Germany's government and built a new one based around him and his stooges' beliefs/ideologies finally installed himself as a more permanent leader. (in other words, he installed himself as dictator)
      Sound familiar? it should.
      Trump has the puppets in the supreme court as a majority as well as other parts in the justice system and has a lot of his bootlickers in important seats in government.
      What he lacks is a majority in the senate, but I get the feeling he won't need that for long.
      Hitler and Trumps cases are not the 1st in history either nor will be the last.
      A dictator is 10 out of 10 times born through all these steps outside an outwrite coup.
      It's an approach that is taken when a pre-dictator doesn't want it taken through fighting.
      They play their cards well and set the stage for themselves instead of having to fight for it tooth and nail.
      They set the system up to hand them complete control and rid itself of any checks and balances giving them free reign.
      Stalin, Putin, Julias Ceasor, Napolean Bonaparte, as well as King Henry the 8th are examples of this. (With many more examples of this)
      In other words, "Yes we should be afraid".
