I am a retired high school teacher and I used the "Bad Day Policy" with my kids. Anytime they were having a bad day they could opt out of instruction by putting their head down and taking a nap. It was used a few times a year and was never abused in my 17 years of teaching. If a student was upset (boy or girlfriend issues, family emergencies, illness, or just "one of those days") there's no point in trying to force them to participate. One girl's brother got sick so they spent the entire night in the emergency room. The up side for the teacher in doing this was the respect you get from the class. Kids need to know that you genuinely care about them. And I did.
