    After trawling through paper after paper and R v Smith and summaries of Hart and Devlin's writings as well as mills and the rest I keep coming back to this video to get a grip. Oh I'm overwhelmed with information and struggling to explain about morality but this video really helps me focus. Michael Kirby I salute you l.

    As someone whose analyzing and discussing the conflict of law and morality highlighted in the Trinity Western University vs. LSUC case right now, J. Kirby's concluding speech was moving. There is no life without liberty.

    The atomised individual and society "over and above" are not the only forms where society exists. There is family, local community, religious community, friends, work life, sport, wider society, local government, many different settings and spheres for different purposes.
    A common set of values could include shared recognition and respect for variety and differing values privately held. One of those values could be the privately held tolerance of multiple values. People can coexist and communicate and benefit society without being totally integrated morally, that's more akin to assimilation.
