If a person invest real estate,that is zakat paid on rent or regional value?

  • Answer By Dr Zakir Naik,As far as the view of the majority of the scholars is concerned, what they say that if the land has been purchased for selling so that you make a profit then all the scholars unanimously agree that Zakaat should be given on it as we discussed in the last answer.That the moment one year is completed the land that you purchased Zakaat has to be paid on it. But if you have land and if you give it on rent, means if you buy a house and give it on rent, majority of the scholars say that Zakaat is not applicable on the value of the house. Zakaat is only applicable on the rent you receive, the moment you receive the rent and if it stays with you for a period of 1 year and if it's above the Nisaab level then you have to pay Zakaat on the rent not on the value of the house, the flat or the land. But now a days most of the people that purchase land for investment, they give it on rent so here we had a dilemma that people who purchase land mainly the purpose is investment but if they think that they'll buy the land they'll sell after 4-5 years when the price rises so but natural they don't want to keep it vacant so they keep it on rent to a person who requires to stay in that flat.

    Agree, if zakkat on non agriculture land is not collected then people will start buying more and more land to save zakkat which will start race in real estate industry. Increasing that land cost and making life harder for poor people.

    mai real estate me investment kiya 2 lakh company bolti hai 15 month me 4 lakh return dil khe to app zameen bhi le sakte hai us paise ki dil khe app apni benefit lekr app company ko switch kr skte hai kya ye investment sahi hai

    I don't own a house but live on rent. I pay money from my income for rent then do I need to separate the money which I pay as rent from my total income and pay zakat on it. Or pay zakat on total income.

      @@mohsinwara235 I've been watching his videos for a while and i like it but his main thing is to stay in debt through credit card and use that to invest for properties... This is haram... So how else do you invest to buy? Just...save money and invest? Have a business and use the money to invest? Saving through a job to invest will take forever...

      @@sashamoon1711 bro for that reason, you have to own a business. And a startup will be best. Find a problem in your country and solve that problem with a little bit of profit. Then find investors or do alone. Don't spend the earnings on you but invest in more business that will succeed both in the short and long term. After all of this, you can invest in real estate with money u acquire from businesses.

      You don't pay zakat on your income. You only pay on the savings that you held for a full luner year.
      Meaning the amount u spent on food or rent, is already spent so no zakat on it.

    Asalamalaikum price of old house is 1cr and rent is 20k per month total 240k per year than 250k is the zakat whats the solution to be with scholars or with rental gain of 240k and 6k please

    If a person has invested some amount in to some kind of buissiness and he is getting monthly divident which is not fixed and he is using that amount for his wants and needs.. Is zakat applicable on the capital amount? Please give reference along with explanation.

      Yes, as long as saving is above 88 grams of gold in total wealth which is not being used for one calendar year, it will fall under Zakat, only , personal living house, a personal car/bike, or household items are exempt like clothes, kitchen items fridge AC etc. Rest if you have cash or gold/silver above the worth of 88grams of Gold, you have to Pay Zakat.

    if you had to pay market value of a rental property what wouuld be the point of even owning you would never make any money. imagines house is £500,000 and rent is £18,000 you would be paying £12,500 first year and most of the £18,000 would be used up

    pls answer. i bought a plot of 20 lakh. now its value is 40 lakh. i had to pay zakat on total curent value 40 lakh or PROFIT that is 20 lakh?

      Zakat should be pay on 40 lakhs 400000x0.025=100000

      bro you have to pay on the cost price which is 20 lakhs. Not the final value of the property. What Mohd Azharuddin says it probably not right.

    Who buys a house fully and gives it up for rent? I dont understand riba and interest. Without interest there isnt profit made from the other person. And if i buy a house for 200k assuming id have 200k saved up fully which would take 40 years+ and have someone in it paying $1000 a month. What profit did i make? It’ll take 16 year and 9 months to get 200k back. 56 years in total. And in the west we have to finish high school and uni. So we only start when we’re 25 so after 81 years of my life ive finally made profit.
    Now here is the “haram” way.
    I find a house that has a value of 200k but is bring sold for 170k with a low downpayment. Already $30k equity. Then i put down 5k-10k i can save that much in 4-6 months maybe. Ill br paying say 900 a month. Ill put somebody in for 1200. I make $300 profit monthly. 3’600 a year. And i move on the my 2nd home and i do the same. Now im making 7’200 a year from that. Or i can buy a duplex where 2 people live in it. Id have a 1700 mortgage and id make them pay 1200 a month. Each. $700 profit a month. Thats how much my mother made when she took care of me and my 3 siblings. We were in the west while my dad was still stick in ethiopia. See the difference. One is actual profit. The other isnt.

      The the problem, actually two system dont work together. In Islam, trade is allowed, for e.g house is 100K $, Banks buys that house and sell you on monthly plan for 120k $ now. There should be no surcharge etc, Price of 120k $ is agreed with you and bank, here is problem of late payments which is also haram, however, there should be genuine reason to skip payments. However in this case, if you paid 50K $ and rest 70k $ you cannot pay, you are owner of that 50k $ in that case and not all your money is lost and if bank sells that land, its liable to pay you 50k $ and rest 70k $ will goto bank. However, if the home is 100k $ now and bank take each month 3% amount on total debt. This is considered as Riba (interest). Because in this case only consumer is crushed and bank takes all the advantage. In Islamic banking system, for e.g earth quake happens and home is lost, bank will also bear the loss as the user as well. however now insurance is there, but in traditional banking, bank always wins. I hope now you understood difference between trade and riba.

    Rental property yields 3-6% income every year. How can one buy another property using just 3-6% yield, out of which he has to meet his own living expenses as well. Also, how will you even pay zakat on a property without selling it, imagine a property being $1 million, how will you take out 25,000 a year when all youbearn is 40,000 in a year from the rent of the property . This scenario doesn't make sense.
    Try and lookup Javed Ghamidi, he is more sensible explanation on zakat on rental property.
    Zakat is not due on means of production, i.e. property is a means of producing rent. Same for agricultural land. But zakat is rather due on the produce, i.e. rent etc. Lookup Javed Ghamidi and it will make perfect sense inshaAllah

    5 Rights Of Quran On Believers
    The book of Allah, the Holy Quran has rights on believers These 5 rights of the Quran are listed below;
    1. To believe like it should be believed
    2. To read as it demands reading
    3. To understand as it should be understood
    4. To act upon it like it demands action
    5. To disseminate like it has the right to be disseminated ( to spread the massage of Quran)
    1. To believe like it should be believed;
    By definition belief means “to accept that something is true without any proof”. Merely reciting the Quran will not lead to believing it wholeheartedly. To understand and to act upon it demands utmost belief that it is Allah’s Speech. This level of belief will raise its significance in our lives.
    “This is the Book about which there is no doubt, a guidance for those conscious of Allah” [Quran 2:2]
    2. To Read as it Demands:
    Recitation of the Quran demands effort. Basic etiquettes should be followed like doing Wudhu before reciting, sit at a silent place and in a proper manner. Moreover, recitation should be correct like the language of demands proper Tajweed and Makharij. Pronunciations and delivery of words of the Quran needs special emphasizes which most of the people take for granted and read in their own style. A proper schedule should be followed like any other important task of life is planned and executed at proper times. Portions of the Quran should be learned by heart. These Ayaats should be repeated daily during 5 prayers throughout the day. Learning of the Quran has immense rewards.
    “Recite the Qur’ān, because it will come on the Day of Judgement and intercede for its people.” [Sahih Muslim]
    3. To Understand:
    Make it a source of guidance. To understand, translations are a good start. But the student of Quran should not stop there. True guidance can be gained when you understand its language because Quranic language is different and translation does not convey true essence.
    “This is a blessed Book which We have revealed to you so that they might reflect upon its verses and that those of understanding would be reminded.” [Quran 38:29]
    4. To Act Upon It As It Demands:
    Part of belief comes from actions. When you actually believe in something or someone you would do anything as is being commanded. Quran has that same very basic right on you. When you claim to believe, it should not be mere by words. It should be proven by actions. Whatever you gain or understand which is relevant to you should become part of your life instantly.
    “Indeed, those who recite the Book of Allāh and establish prayer and spend out of what We have provided them, secretly and publicly, can expect a trade that will never fail.” [Quran, 35:29]
    5. To Disseminate Like It Has Right To Be Disseminated:
    Your actions become the message of the Quran if they are in accordance with its teachings. What you learn from the Quran, it has the right on you to disseminate among your fellowmen. Ways of dissemination should be subtle and not in such a way that it hurts someone’s integrity or freedom to choose.
    “And who is better in speech than he who [says: ‘My Lord is Allah (believes in His Oneness),’ and then stands firm (acts upon His Order), and] invites (men) to Allah’s (Islamic Monotheism), and does righteous deeds, and says: ‘I am one of the Muslims’” [Quran 41:33]

    Brothers you are confusing us...Property owners pay huge amount in property taxes state and federal taxes and you guys intrepret rules as if we are still living in stone age apply the rules logically w properties which have loans and owners have to paid all kind of taxes...nobody owners properties free and clear anywhere...intrpret rules to today s society u always go back to ancient intrepretation ...is tax not serving the purpose of zakat and sadika?

      Tax money goes in all different directions. In politician's pockets (as a form of their salaries), for constructions, in defense, gov schools and hospitals, etc. However, it is not guaranteed the tax will benefit the poor. Here Zakat plays a role in ensuring money makes its way to the poor and not towards those who don't need it.

      @@EhteshamShahzad in my country we pay a large amount of tax and while it goes in politicians pockets as well as roads and hospitals, we have several programs to help poor people such as welfare, money for single mother with childrens, tuition help for student whose parent have low income, etc
