Parental controls can be put in place from the very beginning.
I have them set on my Son's Switch so he has to ask before he downloads anything at all.
If you're not doing that as a parent, that's kind of your fault.

They can't have one app with 2 separate ratings. If they have one app, it has to be rated M. The issue isn't parental controls it's the literal government age classification system

Why do they not make it when you needed a password to access those two mature games it seems simple
Because they'd have to resubmit the app to the ESRB for a new rating. It's easier to make another one.
They didn’t do this because of OS restrictions. It’s due to how the ratings work. If an app or game change rating after release they have to put a Mature disclaimer whenever the app launches. Im sure they wanted to avoid this as well as labeling the app as Mature on the store page for non-informed parents.
Finally someone who gets it. The amount of people who don't understand how age rating works is frustrating. Rare replay was age restricted because of Conkers. This app is a game with a collection of games just like rare replay. It's not that different

I live in Australia and it's rated M but our M rating isn't an age restriction. Our equivalent to ESRB M is MA 15+, R 18+ or X for porn
Parental controls apply to the entire device. Any other profile will still have to input a pin to access the app if it's set to be restricted
That said the parental controls aren't super smart and i agree, they could have made the options specific to a profile and restrict that profile's ability to make a new one. But this app was made after those bad design choices were made and the switch is on its way out anyway
