@@jnscrews You can look this guy up - he lost this court case. The plaintiffs (TestMasters) won a decision against the defendent (Blueprint) and its witnesses. It was only 1% of sought damages, but still amounted to a loss, upheld in appeal. Kouri's actions might look and SOUND "cool" but this was as far from legal "ethics" as anything can get, and likely were top-of-mind during the Judicial review, and confirmation of the jury verdict. Judges don't think "wow, this guy reminds me of Richard Gere in Primal Fear". They see this stuff and think "this guy is an asshole".

Like I said, people are used to TV lawyers - they think "yeah, that guy has balls", but they don't realize that other lawyers, judges, etc., have OPINIONS about these types of lawyers, based on their interactions with them. Clearly, the other lawyers in this room were not impressed with his "stick your threats" style. And, as you said, he lost the case.... so "balls" be damned. The best lawyer I ever employed has been dead for almost 15 years, and he was old when I first hired him. He was quiet, respectful, confident, clear and knew EXACTLY what he was talking about - every single time. I was never a defendant - but he sure beat a lot of defendants on my behalf.

Apparently these supposedly smart lawyers need to re examine the purpose of having a deposition to begin with. Calling an objection to almost every question asked of the witness with the reasoning being that the question is argumentative or disruptive of the attorney client privilege is sophomoric and destructive to do process and investigative work which vitally important to get to the truth.

I had to be in a deposition once because I was a witness to a hit and run of a co-worker. The driver's lawyer tried to "tough guy" me and I literally bursted out laughing! It was so obvious his client was guilty, but he was fishing for me and the other witnesses to say she jump out in front of his client and faked her injuries. In the end, our co-worker had her medical bills paid for and got a good settlement.

He’s not his lawyer. This is a deposition and he was a witness who has no stake in the outcome of the case. I think there are a lot of laypeople in this comment section that don’t understand the dynamics of what took place in this video. The guy ultimately got sanctions for obstructing because he wouldn’t let the witness answer simple and fair questions. And he ultimately lost the case to the cool calm and collected lawyer. And he didn’t have balls. He was acting like a baby and being entirely unprofessional. That conduct would have never been permitted in a court room with a judge. In fact, with the way he was blatantly obstructing in this video, I’m surprised after they sanctioned him that he still even has a law license.

I recently spoke to a lawyer about this video. I asked him about this man-handling lawyer. He said (essentially); In cases like this, you ask all of your questions. Let the person and lawyer play their games. Then, afterwards, you have to petition the court to re-do the entire deposition since the client and lawyer were playing games and not allowing the questions to be answered. He said you also ask for a court-appointed person to sit in on the deposition, to make sure this pinhead lawyer doesn't do it again. And when the judge sees the stunt the bully lawyer is trying to pull by not allowing his client to answer any questions and domineering the deposition, he said it REALLY works against that bullying lawyer. He said, "The clients think lawyers like that are kicking ass. The client has no idea how badly their lawyer is F---ing up their case."

And so folks know the outcome of this incident: The actions by the attorney in this deposition (and further actions of a similar nature), Joe Kouri, actually COST his client SIGNIFICANT additional monetary damages and got Mr. Kouri sanctioned. This is from the judge's order: " The December 12, 2007 order imposing monetary and nonmonetary discovery sanctions is affirmed. The January 24, 2008 order awarding TestMasters $592,260.45 in monetary sanctions is affirmed. The April 10, 2008 order awarding TestMasters $154,952.85 in monetary sanctions is affirmed. The August 6, 2008 orders imposing monetary and nonmonetary discovery sanctions are affirmed. The September 29, 2008 order awarding TestMasters $738,035.10 in discovery sanctions is affirmed. The September 29, 2008 order awarding TestMasters $70,325.76 in discovery sanctions is affirmed." These are all sanctions the judge approved against Kouri's client SPECIFICALLY because of Kouri's actions that prohibited TestMasters attorneys from their legal ight to the discovery process. When your client's big mouth and bad legal skills cost you more than a million dollars in sanctions alone … time to look for a new lawyer.

There is nothing funny about it. The questions are going to get asked at some point. Arguing and fighting like that is not going to avoid this.
The witness has the right to refuse to answer and the lawyer can inform them of this. The lawyer trying to direct the client is not going to look good and it could also bring the the lawyer into the case as an actual witness or even as a subject.
It could end up being used as evidence of intimidation.
