      Kung tutuusin ang katanungan at mga kasagutan na ginawa ng batas pinoy ay may kaakibat na professional consultation fees. Kaya lang dahil ang Batas Pinioy ay isang personal LEGAL AID at public Service program, ito ay naging libre o Pro-Bono. Wala akong alam na nagbibigay ng libre na notary public.Hindi hindi naman fair na nag bibigay sila ng professional services ay libre na lang. Bukod pa sa obligasyon na itinakda ng batas na maaring malabag ng notary public at ng lawyer, dahil sa malpractice, ay mayroong risk na matanggalan kami ng license to practice law.Paano na ang mga pamilya na umasa sa lawyer bilang padre de pamilya? Bilang halimbawa, kung pupunta ka palengke at bibili ng isda ay hindi maaring sabihin na libre na lang dahil wala kang pera. Ganoon din sa mga professional at kasama na rito ang lawyer, doctor, engineers, at iba. Ang pagkakaiba lang sa professionals at ung nag titinda sa palengke ay kanilang tinitinda. Ung nasa palengke, mga merchandise ung mga professionals naman ay kanilnag mga professional services. Take note na ung mga professionals tulad ng lawyer, bukod sa pamilyang sinusuportahan ay pa mayroon ding gastos , tulad ng rental sa office, sahod ng mga clerks, secretaries, drivers, gasoline, office supplies, etc.. Kung puro na lang libre or pro bono, paano na lang mag survive ang lawyer at mga professionals? Sana makikita ang pananaw na ito ng ating mga kababayan.
      Sa mga walang kakayahang mag bayad ng sebisyo ng lawyer, ay maaring dumulog kayo sa Public Attorney's Office(PAO) for free legal assistance and services. Kaya libre ang kanilang services sa hindi nakaka afford ng lawyer ay dahil sa mga taxes na nakokolecta ng gobyero na siyang nagpapasweldo ng mga PAO lawyers at ganooon na rin ang lahat na kawani at emplolyees ng pamahalaan.

    Napakagandang video po ito Atty, sana po ay gumawa din kayo ng video tungkol po sa buy and sell, nag flip ng property. paano po un tama pag benta o pag gusto mag buy and sell. balak ko po sana mag invest sa buy and sell, bale po paano ang proseso kun may ibebenta po ako bahay na di pa nailipat sa pangalan ko ang titulo, sabihin na po naten wala po talaga ako balak kase po gusto ko mag buy and sell ano po un legal na paraan for me (seller) at buyer. salamat po

      Maaring mo namang gawin ung naiisip mong buy and sell business ng real estate property. Upang maging exempted sa capital gains taxmang sales transactions mo ay dapat duly registered real estate ang company mo. Pag registered real estate company kasi ung mga real properties na nabili ninyo ay considered lang as ordinary assets at not subject to capital gains tax although subject pa rin ito value added tax and documentary stamp tax.

Marami po akong natutunan at naliliwanagan sa programa ninyong BATAS PINOY, lalo na po may problema po ako sa lupa ko na gustong makamkam ng taong ganid , tulad ng sabi ko sa inyo sa isang KASINUNGALINGAN SALAYSAY NA Ipinagawa sa isang Atty at parang pinaniwalaan ng DAR MAIN OFFICE, inspite po na ok at walang naging problema sa DAR TANAY.       Ang deed of assignment ay isang legal na dokomento na nag sasalin ng "karapatan" o real right sa ibang tao kung saan isinasalin niya ang mga ito bilang sa pagtanggap ng kabayaran at itinakwil na niya ang ano mga karapatan o kapangyarihan na niloob ng isang bagay na tangible o intangible man. Upang maging enforceable at kikilalanin ito ng mga concerned agency na may jurisdiction sa nilalaman ng Deed of Assignment, ay dapat pirmado ito ng Assignor at Assignee at mga witnesses at notarized ito.

      Kung walang nakaregister na tax payer sa vacanteng lupa sa Assessor's office at hindi ito bahagi ng portion ng lupang nagmamay-ari ay maari ninyo itong applyan for titling lalo na after ma-verify ninyo sa LMB-DENR kung ALIENABLE at DISPOSABLE land ito.

    Atty. Mother ko may nabiling lupa at naitransfer na sa name nya yr. 1972, pero ng ilipat sa sa amin 1998 nagcontest ung kapitbahay, nabili daw nya 1965 may Deed of sale notarized, pero sabi ng vendor noon hindi kasama ung naibinta sa kanila, naunang namatay ung vendor. Nagkaso sila pero sabi ng Mother ko masmalaki pa magastos kung ituloy sa kaso ky ngsettled n lang cla na hati, nag offer pa mother ko na ibinta 1/2 share sa kanila pero d binili. 2002 namatay mother ko at ung claimer namatay n din pero ung anak sabi kalahati lang daw ang sa amin kc nagpirma mother ko noon sa settlement agreement. Seni-settle po namin ang Estate tax ngaun, pero ang computation buo pa din kc mother ko nakapangalan maski sa cadastro. Puwedi po ba namin singilin ung nagcla claim na 1/2 estate tax sa kanila kc po more than 200k ang computation base sa zonal val.?

Gaya ng sinabi nyo po tungkol sa registration ng sale, sa amin po Conditional deed of Salle po which hindi po namin nairegister sa ROD.May 9 yrs na pong hindi namin naregister.       Ang papa ko noon nagbinta ng portion sa titulo na mana niya kay lola pero patay na papa ko,yung bumili sa 2001 hindi pa pinatitulohan ang lupa na binili nila hanggang ngayon pero pina register nila sa Register of deeds kasama ang papa ko so sa likod ng titulo nilagyan sa taga ROD na nabintahan ng 1000sqm to pangalan sa nakabili.

    Sir magandang hapon po may tanong po ako.. Tungkol po sa bahay na kinuha ng asawa ko na hulogan sa SHDC.. DITO po batangas..naka hulog n po kami ng 86k n po yata ang problima po nmin nahinto po kami ng pag hulog dahil po sa pandimic po n to..1year n po kami hindi nakakahog.. Ang balak po sana nmin tuloy n min ang pag hulog kc pariho n po kami may trabahi ng asawa ko.. Kaya lng pi hihingian po kami ng 62k para daw po matuloy ang pag hulog nmin..     Nakibile po ako ng lupa sa aking kaibigan walang title ngunit mayroon syang certificate of award galing sa city housing,,ang lupang ito kangyang binayaran buwan 2x sa city housing peru hinde pa fully paid ibininta niya sa akin, ang tanung ko po paano mailipat sa akin pangalan ang certificate of award?

    Attorney, speaking of mga "taga pag mana", paano po maibebenta kung nakapangalan pa sa kanyang parent or grandparent ang titulo? Anong document/s ba dapat meron ang pinamanahan (maliban sa titulo) upang maibenta nya ang property na minana nya? Kailangan ba mai-lipat muna sa pangalan nya ang titulo?

    Atty ang kasunduan ba ng pagmamana atpagbebenta ayvoid kung hindi sila ang tunay na tagapagmana notarizrd at may car na. Nowhere comes ung tunay na mayari. Gusto ng bir na to go to thr court for the cancellation of Car andto nolify the first kasunduan ng pagmamana atpag bebenta. My question ayty is.       Maki pag ugnayan kayo sa inyong lawyer upang makagawa ng kaakibat na legal na hakbang ang nangyaring pag nakaw ng inyong titulo. Kung tutuusin pag nakaw ang titulo ay napa reconstitute ito. Kung ang naibigay sa inyo ng DENR ay Free Patent certificate, maari lang itong macancel kung mayroong paglabag sa mga terms and conditions nito. Kaya mas mahalaga na malaman ng lawyer ninyo kung ano bang legal na kadahilanan at "nature" sa sinasabing mong pag nanakaw.
