    Remand means?

    • @legalvantage
      @legalvantage  2 ปีที่แล้ว

      Hii Joseph, first of all sorry for the late reply.
      Well, the term 'Remand' means to return or send back. Provisions regarding this are given under Section 167(2) of Code of Criminal Procedure,1973 (CrPC). You might know that police can not detain any person for more than 24 hours for investigation. But, what if police want to detain any person for more time. Here Section 167(2) CrPC come into play. If police wants to detain any person for more than 24 hours for investigation purposes or for collecting evidences, in that case they must obtain the order from Judicial Magistrate under this section. This order is called order of remand and that further detention will be remand of that person.
      I hope you have no any further doubt. If you want to ask anything further please feel free to ask.

    If a pplaintiff is out of station than how a civil case will continue

    • @legalvantage
      @legalvantage  ปีที่แล้ว +1

      Hello Vaibhav, if the plaintiff is out of station and is not able to attend the hearing then he must inform for the same to the court through their legal representative, and also should mention the time frame of non-appearance and request for the next hearing date accordingly. Details about Appearance and Non-appearance of the parties in civil suit is given under Order IX of the CPC. So, you can refer this for more details. I hope this will clear your doubts, if you have any other questions please feel free to ask.

    What is prosecuted means.. please explain in brief

    • @legalvantage
      @legalvantage  ปีที่แล้ว

      When a person is accused in criminal case and a trial is going on against that person then we will say, that person is prosecuted i.e., a criminal trial against him is going on.
      "To officially accused someone of committing a crime in law court".
      I hope it will help. Feel free to ask if there is any doubt 🙏😊

      The sequence of explaining it should be like PLAINTIFF vs. DEFENDANT, and then PETITIONER vs. RESPONDENT, COMPLAINANT vs. ACCUSED/RESPONDENT etc. In other words, the explanation should go in pairs, and why the one used in Civil is not used in Criminal and vice versa. You may consider reworking this.
