      Private prisons have nothing to do with the Bail system. I can agree private prison are a problem i can even agree the bail system could be better. Point is there not comparable really. Also i don't know if this bill is the answer algorithms have flaws it's know just look to social media as an example. Take that lady that got the robbery charge she would of failed that system and would of had to sit in jail. While bail gave her the means to get out. Is the bail system perfect no but i don't know if this is the way to fix it.

      @@danmacaluso6674 that's only if you pay the full bail amount yourself. What if your bail is set at $10k+, can you afford to be without that for a few months? You'd also have to pay for an attourney in the meantime too. A lot of people wouldn't be able to, especially those getting arrested who are statistically more likely to be below poverty lines.
      If not then you have to pay a bail bondsman 10% (usually, I've seen 5% though) of the bail price and you don't get that back. It's the fee they charge you to cover full bail which they then collect after your appear in court. It's one of those "It costs a lot to be poor" situations.

      Yeah, that was pretty unclear, but I think judging from the fact that she was bummed the fuck out and stopped the vehicle before police even arrived could be proof that she was unaware of her friend's intentions. I mean, it's not the first time someone have been used as a getaway without prior notice. It happens quite frequently.

      akihitochan those 8,000 jobs lost is the reason most people don’t like the democrats. Over the last few years (he’ll even just the last few months) Democrat’s have proven that they don’t care about people having jobs. The more unemployed people there are, the more they can convince you they will give you aid and housing, therefore controlling you. Democrats for the most part thrive on unemployed and misinformed citizens that are weak and helpless. They budget more money to help those helpless citizens, which makes the actual taxpayers have to pay more. If you wanna talk about an immoral and corrupt system, do an in depth real study of the democratic policies over the last few decades and look at how they are solely placed to weaken and control the citizens with no regard to how badly it effects the economy. Democrats are dangerous to the freedoms and rights we have in this country.

      Being in jail doesn't kill jobs. It only takes an existing job from a potential criminal and makes it available to someone else. What *_can_* kill jobs is bad economic policy.

      @@jchinckley I'd school you a bit on this, but I'll simply say this: Every person that sits in jail, is a person that doesn't work. Every person that gets jailed while occupied, creates overhead to replace that position, creating a net effect of increased vacancies. Second, a person that loses a job, is less likely to be able to reenter the job market, effectively increasing unemployment while stripping opportunities away from them. I could go further than that, and tell you how that would increase crime and hinder rehabilitation, but I think that's obvious by now...

      R Kelly's bail I believe was actually the total payments of child support he had not paid. Aunt Becky's fraud was a major financial crime, so a high bail wouldn't be out of the question

      Cash bail is based on ensuring the person comes back R. Kelly is broke so 100k is a lot of money to him. Loris is Rich AF so her bail was higher if she just had to pay a $5000 bail she would give zero shits.

      Because bail is about forcing someone to show up in court, not punishing them for the crime they've been accused of. R Kelly could barely even make bail; he's not a flight risk. Lori Loughlin has so much money that I wouldn't be surprised to find "non-extradition countries" in her search history.

    This whole thing is unconstitutional, just look at the eight amendment:
    “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”

      Who decides what is "excessive?" Let's put it like this: Would you oppose an extremely high bail or no bail at all for someone like the Christchurch shooter? Technically, under our system, he's innocent until after he's been through trial. We know he did this horrible crime. We know why he did it. Why would we not hold him and make the barrier for getting away as high as possible?
      In this case, the chick got out of jail after willingly committing a crime for $1000. If anything, she got off way to easily. She was guilty of the crime she was charged with (Though she seemed to think that being the getaway driver wasn't the same as being a part of the robbery), other than a few days in jail and the bond money, her life was barely impacted by the system. Can you really say that this was excessive?

      @@danagray9709 First she had to pay 5,000$ which is a very high amount for anyone not rich, especially some dumb 18 year old who did something really stupid. Second mass murderers dont get bail, bail is mostly for smaller and non-violent crimes.
      Edit: also im not defending the girl. What she did was definitely illegal, im just saying 5,000$ is not just some money you can come up with ease.

    I keep seeing " *accidentally* became a getaway driver." Amber-Rose called herself the getaway driver. She didn't claim any innocence about the situation. She talked about showing the judge she was serious about rehabilitation. The robbery was clearly premeditated on her part, too. That's not to say she's not an upstanding citizen now, but let's be clear that she purposefully committed a crime.

      Icemarine972 no, she talking about how the cash bail system kept her in jail for 2 weeks without being convicted, not that she is innocent but she had the chance at redemption, took that chance, and now is advocating for a more fair bail system.
      The facts are, as clearly evident you didn’t pay attention to the video AT ALL, is that nearly 2/3 of the people in jail are not convicted of a crime, and that’s a problem created by a bail industry and court system that puts excessive bail amounts on people who don’t have the ability to pay and that leads to them taking plea deals that are not favorable, including pleading guilty to crimes you are not guilty of, and it hurts them because they can’t show to the Court that they are trying to improve their lives.

    Any algorithm that use Zip Codes as a determining factor is undoubtedly going to be biased, not just racial bias, but socioeconomic bias as well.

      I think that's kind of the same thing in terms of zip codes, the reason I say that is (lets use Chicago, where I live, as an example). The city is not only socioeconomically divided but GENERALLY, racial divided. The idea of that is definitely going to add to it as well. Though, I think algorithms in general aren't an idea way to go as it seems like it's not really being overseen by a manual process, I think it'd be good if they have a team manually doing it and an algorithm doing it such that if there are discrepencies between the people doing it and the machine then it can be ironed out by the commitee or A commitee such that things are less bias'd racially and socioeconomically

      I'm sorry but I have to disagree. Bails favor no one. They take advantage of the rich and destroy lives of the poor. Aunt Becky committed a non violent crime and still had to pay a million dollar bail. That is taking advantage. Bails are also 100% refundable regardless of being guilty or non guilty.

      Regardless of what system is used to determine who is held held until trial, clearly violent offenders and flight risk offenders need to be held until trial. Our system clearly isn't perfect, but don't compare it to utopian ideals that can't be put into practice. Holding some people until trial is a logistical and public safety necessity. Cases take time to prepare and violent offenders can't be handled catch and release.

      May be instead of scrapping the current system you fix it. You say it doesn't work. There is a good chance the new system would be worse. May be bail schedules should be adjusted and algorithm to be used to give better guidelines for judges. Personally I rather have the option to pay 5k and get out than be forced to be keep in jail because of where I live. Just because a system doesn't work mean it should be replace with a system that might be worse.

      Dalagante good job! The reality is that 5k can be done in payments and most companies will offer rebates leaving said balance at like 4K.
      If you’re to get arrested for a domestic violence in San Jose or Fresno your bail is 25k if you get arrested in Modesto or Visalia it’s 50k...a uniform bail schedule is a way to go

    Phil you really need to cover the story about the animal abuse that was being uploaded by a person called Preston McDuffle. He has uploaded videos of him abusing his cats such putting their tails in doors and shutting the door.
    This person still has a TH-cam channel after all the abuse he has caused to these poor animals. Please can you try and cover this as this story needs to be heard.

    It's a pay to play system, and it's not fair for those who can't pay. There's a snide term that floats around prosecution and court appointed attorney offices, called "Meet'em & Plead'em". They don't care about you. You are more profitable to the machine once in the system. Period... end of story.
    Let's change that aspect of the criminal justice system and bail will become a relic of a bygone era.

My dad was put into a holding cell for a few hours because he happened to look like someone who mugged someone and took their car.       I've had friends who were drug dealers and I didn't realize it. I learned (after their sentencing) that they had their wares with them in my car. Proximity doesn't always imply criminal association. What if her friend went into the store to grab a drink and came out having robbed the place?

      A white man driving the car used in a driveby shooting lawyered and played dumb - "I legit didn't know that the shooter was going to shoot out of my car" - and got the murder charges dropped. So criminal justice system gave him the benefit of doubt, but you cannot do so to a black woman? Are you sure that "the case of bad company" didn't apply to her? Maybe she was hanging around scum - and didn't realize it until too late. Or maybe her stupid ass knew he was grimey in these streets and was naive and too slow to not avoid being put in a situation where she'd be used by him. These hoodlums have no problem using black women's kindness & trust to drag black women down with them. Again, why are you so sure that when he asked her can she stop by the store for him, she didn't assume it was for an errand, that she didn't assume that he had the money & intention to buy whatever he needed, and that she damn well knew she was driving into a robbery? The point is there is no way to know. She was joy riding with the degenerate and he asked her to go take him to the store - she got caught up and need to pick better company.
      True story: my sibling's wife was hanging with her family and they ordered pizza. The delivery guy came and while the driver was at the door getting his payment, a [black] male cousin stole all of the pizzas for other customers from the driver's car and took them to the back door. When they saw the other pizzas in the kitchen, they were shocked & appalled at the cousin. Did you think those black women ordering boxes of pizza, which they paid for, had a fucking clue that their cousin was so greedy & grimey to do something like that? No. I asked her did she call the local store to attempt to return the pizzas, she said no, because people like you would wrongly assume and insist that she, and every black woman in that house, were "accomplices to a robbery ruse."
      Moral of the story is, I'm not saying that all black women are innocent, as in not sheltering black men. I'm saying to be careful in making sweeping assumptions on innocence and guilt when you have little information. There are thugs out here who act without consideration to the innocent people surrounding them. Not everyone has the foresight to "not take niggas to the store."

      I'm positive she meant to be the get away driver. She said when her friend went into the store to rob it and she waited outside as the get away driver. Also she stated something along the lines of the new system would have kept her in jail due to discrimination and being bonded out helped her fight her case(even guilty should be allowed to fight their case). From what I can tell she is a honest person, that just got caught up in a bad mistake, but she seems to have learned from it.

      In some ways, the bail system is almost entirely unbiased - whoever you are, however much you can pay, you get slapped with the same amount of bail.
      The algorithm system entrenches biases that are already there is police treatment or likelihood to commit a crime according to race.
      But I still think that anything to remove indiscriminate cash-for-bail is good, and the algorithm system is a reasonable one.

      Septimus ii I strongly disagree with the algorithm idea being innately reasonable simply because it no longer treats each individual on a by-the-individual basis, you’re reduced to your stat summary and your individual circumstances that are actually important, i.e. what you think, feel, what your intent was, etc, are going to be reduced in any system that reviews you by algorithm down to the color of your skin and the area you live in, which sort of holds you responsible for what all your neighbors do no matter if you choose to live their or not. I believe we owe every defendant, because of presumption of innocence, both a very individualized legal experience that remains as impartial as possible while being speedy and fair. Leaving their right to bail up to an algorithm that is essentially a profiling computer seems the opposite of a way to fix this problem.

      Only truly unracist and fair system is you are detained until trial. Personal I rather have a modified of are current system were cash bail is the an exception or add as extra incentive to show up to court. I don't see the point scrapping one broken system for another that is un proven. Take last few years of court cases and see what the new system would have decided. Then adjust until you can use past data to prove it was better.

And using past data to test is it is million times better than testing it under fire. There is a reason that every product, system or program is tested before it is released live.

Then when some get out after being found innocent or guilty of a minor offence that results in a small fine, they can look for a new job while trying to scrap enough cash together to pay the bills and hope to get one before the lights and water get turned off.     Was that one girl seriously implying that we should offer housing to criminals to keep them away from their victims? Instead of just putting them in jail? I'm sorry but the bail System seems broke and everything the other guy said about the algorithm sounds like it will work much better. Also I find in most stories involving domestic violence when the cops ask the aggressor to find another place to stay the aggressor usually ends up back over at the house and the Fight Continues. That girl seems naive to the point of stupidity.

      Speaking as another kid from an abusive father, she doesn’t seem to realize that finance is a control method for abusers. Also, my dad didn’t end up in jail, but my mom struggled with him dragging out court proceedings to “make her pay” for leaving. Him living in another house and her having her own job didn’t solve the financial instability. When she said that, I just went “WOW you don’t have a clue.”

      Matterking I feel like in a lot of those cases, either the person is being ignorant by not knowing their buddy’s drug of choice or their friend isn’t a good friend and isn’t taking his own charge. Either way I don’t think there should be bail set for any recreational drug user.

    Sorry but the bail system is NOT a main reason for high incarceration numbers in the US. The cited number at 2:43 is "Prison Population Total." People in the bail system are held in jails and not prisons. The chart immediately after this is referencing jail numbers as if the percentages are of the prison population numbers just given but they are NOT. Some hasty research here shows how hard it is to scratch more than the surface without a criminologist or other expert. Misconceptions abound.

      I worked with a girl who’s boyfriend borrowed her car while she was at home he robbed a bank. She was arrested for accomplice to robbery. Can you imagine having nothing to do with the crime but cause its your car you have to go to jail?

    I work in a court system, and there's no doubt that the system is broken. However, my local judges look carefully at every defendant and decide based on objective factors (like how serious the crime is, past history of failing to appear for court, danger to the public in general or specific people, etc.). Then, when they get it wrong, we defense attorneys step in and correct the situation.
    Unfortunately, there are a lot of no-win situations. Domestic Violence is often one of them. Yes, sometimes the abuser is the sole breadwinner and removing them puts people in financial hardship. However, there are private and public programs to get the victims of this violence through that difficulty. Sometimes the victims can't get that help due to their distrust of the system or substance abuse issues. The judges are aware of that, and they know or are told of the difficulty they're causing for the victims, but the end goal is to end the abuse.
    Another gross one is child support. In my state, your bond amount is half your arrears unless there are special circumstances. Again, I acknowledge that it's a no-win. The other parent needs the money they're owed, and people aren't charged for non-payment until they've missed a buttload of payments, which means that the payee and the child have suffered a lot by the time they get to this stage. On the other end, the defendant loses whatever job they had and have to try and pay everything off after spending months in jail before getting a fresh felony on their record. Their ability to pay is painfully reduced, so the payee and child still don't get anything, and there's another person or group that hates the system.
    The main frustrating thing about these kinds of issues is that everyone wants to believe the people who claim they were wronged by the system or that their serious criminal charge came from some minor mistake that really wasn't a big deal. Look closer. Injustice happens, but I've had enough people tell me flat lies as I show them the HD footage of them committing the crime that I know the majority of it is crying wolf. Judges refuse bond to people who have seriously messed up and refuse to acknowledge anything questionable about their own conduct. It's a dark reality, but some people are better off in jail (both for their own well-being and that of the public). There's also the fact that the judicial system itself is not making profit on fines and fees. They don't just punt people onto probation for a massive windfall. Rehab and probation cost several times more than people pay for it, and the "system" spends millions of dollars each year just trying to get people to understand things like "hitting people is bad" or "stealing is bad." If you're new to the system and you can learn the lesson specific to your crime, you'll be fine. If it's your fifth time charged with a similar crime and you're still saying the process is a waste of time and just to get money out of you, you should probably get used to having your freedoms taken. And no, the judge isn't salivating and licking her lips over squeezing that thousand dollars out of you in sporadic twenty dollar payments over the next decade. Your case cost the system ten times more than that and she's just hoping to make the fine just enough that you hesitate before doing it again.
    Sometimes, being a lawyer feels like running the Kobayashi Maru five times a week.

      You can't assume that all judges are working hard to make the system better though. There are sometimes incentives to look hard on crime. Prosecutors are rewarded for convictions, not necessarily getting it right. I think your points are mostly valid and there are some excessively bleeding hearts out there, but I think saying the court is always the good guys is as disingenuous as saying all criminals are victims of the system.

      There’s a balance in all things, I think. Judges, lawyers, most jobs really have a large number of honest workers doing their best. But naturally, people develop biases from news reports because news has more incentive to look at negative events due to the attention it catches. It makes judges seem corrupt and unfeeling, the rich seem privileged and ignorant, and the world looks like a far greedier, darker place.
      Naturally, nearly every workplace has some form of corruption in it, but people really tend to forget the good surrounding them. Wow, this kinda feels like preaching. Alright, now let’s all pray to Jesus our lord an- i can’t this is stupidwhatamidoing

Their judge and most of the court personnel are on a first name basis with the bio mom because of how long/often she's been around in both criminal and family court. The city is paying out the ass for all sorts of classes and programs in pursuit of reconciliation with the kids she still has parental rights to and she blows most of it off. I have no problem with them paying, but it sucks she barely tries and then lies about why she didn't show ("I didn't know the date!" "Oh, the one written on that binder we never see you without?" "..."). I don't want the judge to become jaded and stop pursuing reconciliation relentlessly where possible, but I can understand how it happens. The sad reality is that in many cases the person in trouble either just doesn't care or only cares while someone is watching/threatening them.

      I think it made a lot of sense. Usually you think of this scenario as the breadwinner is a father who is the abuser.But the wife didn't leave him bc she had no where to go. If the husband is put in jail he cannot hurt her anymore but also cannot work to bring in the money supporting them. IF they could allow the husband to be out of jail he could still work and send money allowing the family to pay their bills still and hopefully keep him away from her until he is sentenced rather than see her go into debt or lose the house or something during that time. Also there are people that go to work during the day and go back to prison for familys like this. I'll bet that could be another way of monitoring but still letting someone be a bit more free like ankle monitors but still watched over

      @@enigmalfidelity yes but youtube have something like 1000 hours of content uploaded every minute, nobody can fact check the algorithm efficiently, in a "bail" algorithm every one subjected by the algorithm is reviewed by a judge that will have the final power to hold the person, so 100% of the cases have human review, the algorithm became just a helping tool and not the only system that determines the case.

People who commit crimes usually don't have money to pay over to a bail bondsman, the algorithmic system and even the bias validation system mentioned is the fact you don't need to be rich to get out on bail. The statue of Justice is blind and the Algorithmic is the closest thing you can get to it. Also with updating communication methods you'd see a huge drop.

Bonds are handed out by a huge factors of things such as the crime committed, the suspects ties to the community, age, where they are from, etc... Is bond perfect? No, but blanket releasing everyone who committed a minor offense is plain stupid. If you are a get away driver your ass should sit in jail for court, if you get into a bar fight here is an NTA. If the judge deems it necessary I have no problem requiring collateral to be released from jail and garuntee appearance. If the legal system sees an overhaul it needs to be done via statistics and by criminologist and legal experts. Not social justice warriors getting domestic abusers released from jail.

    Hey Phil, constructive criticism-- I don't feel like I learned enough about why we should KEEP the bail system. I'm coming in not knowing anything about it and I feel like I learned a disproportionate amount about the other systems. I'm not sure if that was an oversight or your own bias slipping in, just thought you should know.

      This isn't constructive. The videos wouldn't be made better if all sides were presented as equal if some are better than others. The reason for defense for the bail system is simple. Take something as collateral so the accused is incentivised to return to court. The reason for for profit bail is also simple, they give give people enough money to pay bail. The problem is that is often exploitative. The interesting conversation is entirely in how can this be made better.

    Machine bias is a huge issue and it is very important in this topic, if you feed a learning algorithm all the arrests it is self reinforcing because the data is already biased. Policing has crime prevention algorithms too, they send patrols to neighbourhoods that have had crime spikes, police do what police do so it also becomes self reinforcing.

      As someone works in the field: This is a very good point, and one of the reasons why refining algorithms to prevent this sort of thing is a very active area of research. Bad algorithms have been around for a while, but we only started taking note of how much damage they were doing recently (see Cathy O'Neil's book "weapons of math destruction"). Once it was pointed out, we listened, and we are working really hard to figure out how to fix it!

    The system is insane! I almost went to jail while driving on my way to NYC just last month. I had forgotten about a speeding ticket that I got in NY a few years back, as a Canadian I was never sent any sort of warnings or anything and my licence was suspended and I wasn’t aware of it what’s so ever. When the officer pulled me over and checked my licence, he took my car keys and was about to impound my car and take me to court with a $5,000 min bail. Luckily I was able to convince him to let me go with a ‘driving without a licence’ ticket, but I can’t believe that’s even possible.

      It was probably originally put in place with good intentions at heart (a lot of that shit usually is) but then someone questioned why they were doing it a certain way when they could be making a hell of a lot more money doing it a different way.

      Bail bonds industry was set up to help the poor which it does. Say you have 50k bond a poor person could never pay that so a bail bonds person says pay me 5k I will pay the bond and you can get out. Without that bail bonds system the getaway driver would have had to sit in jail. The evil for profit bail system actually give more opportunities for poor people to get out of jail.

      The bail system is not "for-profit" but the bail bonds industry is. There's a difference. If you pay bail and come back on all your court dates you get your money back. The bail bondsman gives you an option to pay significantly less to get out on bail but you don't get your money back. That's where they make a profit, also they force you show up to court for them to get their money back if you don't that's where bounty hunters come in.

      Tossing $50k bail on a kid from a low income area *_and_* it was her first offense? Yeah no. *_That_* is the crime right there.
      They're all bitching bout how broken the algorithm in general is so make everyone look at it and fix the loopholes that fuck people over.

But she even said under the new system same person would have been detained until convicted. I think that 59k is looking more fair.

    Ive been arrested and the most frustrating part of the whole process is that they dont make anything clear. I had to go in several times just to see if I had all my fines paid. It feels like I stepped into the past. Nothing makes sense and I felt like I was just going with the flow. And I felt like I got lied to several times

    That lady from the bail project really pissed me off. Why is she sitting there talking about effective notification systems of when to appear in court? She missed the entire point of why the cash bail system is bad. It's not because of a lack of a notification system, it's because nobody has the money to bail individuals out in the first place. I hate when people only do Symptom solving.

    The criminal justice system is a huge problem here in the US, rooted in racism and classism.
    Lets not standardize the bail system, last time we standardized something, we ended up raising a generation of young adults that can't sew a button or do their taxes correctly.

    If you've ever been a victim of a heinous crime, I'm sure you won't be quick to support an easy bail system. And if you've ever been arrested for a crime you did not commit, you would understand why the bail system is unfair. It is difficult to pick a side on this one.

    Maybe be more careful with the next interview? This current one leaves it ambiguous as to whether or not the teenage girl actually was guilty of a crime (its unclear if she was aware or unaware of the robbery).
    This messes with the ability of many people to actually feel sympathy or put the issue being discussed into proper context.

    Right off the bat I have no sympathy for folks having bail set so high. And I'm speaking from a position where I had 15,000 dollar bail myself for stuff I did, with no previous record. Yes I'm not happy with having to pay bail to a bail bondsman but if I'm being perfectly honest it was fair. That girl helped to rob that store, no sympathy for her. And over policing wouldn't be necessary if there wasn't high crime in an area ALREADY, this idea that it's racially motivated is absurd it's the community that has the crimes, and reducing police in a high crime area just INCREASES the crime rate, look at Chicago!

      Poorer neighborhoods in the US are more likely to house minorities and be over policed, leading to more arrests for misdemeanors. When you factor in that some cops are racist or vindictive, AND a history of planting evidence, you get a very flawed system that gets ignored. They're saying that even if the new algorithm works, the data being examined is still biased against poor minorities.
